HomeMy WebLinkAboutOrdinance 7557 ORDINANCE NO. -755 -7 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE NORTH/SOUTH ALLEY A WIDTH OF 16 ' AND A LENGTH OF 125' FROM HOUGHTON AVENUE NORTH TO THE EAST/WEST ALLEY ABUTTING LOTS 1, 2, 3 AND 29, BLOCK 43, ARLINGTON HEIGHTS, SECOND FILING TO THE CITY OF FORT WORTH; PRO- VIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS : SECTION 1. That a portion of the north/south alley a width of 16 ' and a length of 125' from Houghton Avenue north to the east/west alley abutting Lots 1, 2, 3 and 29, Block 43, Arlington Heights, Second Filing to the City of Fort Worth, be and the same is hereby vacated, abandoned and permanently closed as an alley. SECTION 2 . That the fee to the land in the above described alley is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are re- served therein for any and all existing utilities including existing gas facilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. Subject alley right-of-way, acquired by dedication, is neither open nor improved and contains gas facilities. The gas company requests an easement be retained for that portion of the alley in which their facilities are located. The City Plan Commission has reviewed this request and recommends its approval with a satisfactory replat of the vacated right-of-way with abutting property, physical closure of the alley with standard curb and gutter at Houghton Avenue when street improvements are made. A satisfactory replat has now been submitted. The owners of the subject property have agreed to participate in an assessment program for the paving of Houghton Avenue. Recommendation It is recommended that an ordinance be adopted vacating the subject right-of-way as requested.
