AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
EAST NORTHSIDE DRIVE
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING, AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising grading and filling same and by constructing thereon the following to -wit
EAST NORTHSIDE DRIVE From Trinity River Bridge to Samuel Avenue Bridge,
a hot -mix asphaltic surface course on a concrete
base with seven -inch high superimposed concrete
curb on a sixty -foot roadway Six -inch thick con-
crete driveways will be constructed where specified
together with concrete curbs, gutters driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed together with storm
sewerstand drains and other necessary incidentals and appurtenances all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor contract therefore has been made and
entered into with __Ashland- Warren. Inc. ,
and
WHEREAS, the City Council of the City of Fort Worth Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT

Such estimates be and they are hereby adopted and approved
II
It is hereby found and determined that the cost of improvements on each portion of
streets avenues and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows to -wit
EAST NORTHSIDE DRIVE From Trinity River Bridge to Samuel Avenue Bridge,
known and designated as Project No 021- 36513
The estimated cost of improvements is $:1dq n99 9Q, , the estimated amount
per front foot to be assessed against abutting property and the owners thereof for superimpose,
concrete curb #O#fw##r#is $ 191 the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ -0- ,
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for -0- wide concrete sidewalk is $ -0- , the estimated
amount per square foot to be assessed against abutting property and the owners thereof for
six inch thick concrete driveway is $ J J1 per square foot the total
estimated amount per front foot to be assessed) against abutting property and the owners
thereof is $ 1.91 plus the cost incurred for concrete driveway construction
where specified

A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public plates, as well as to all
owning or claiming any interest in any such property Such hearing shall be
given and held on the 25th day of March 19 80 , at 9.30 A.M.
in the Council Chamber in 'the City Hall in the City of Fort Worth Texas, and
the City Secretary is hereby directed to give or cause to be given notice,of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the--
Fortieth Legislature of the State of Texas, and known,as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective 14ay-12„ 1967 Such 'notice shall be by advertisement-inserted
at least three (3) times in a newspaper published in the--City of Fort Worth-,
Texas, the first publication to be made at least twenty -one (21) days before
the date of said hearing Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting oA said portions, of
highways, streets, avenues and public places, as well as to all owning or claiming
;any interest in.any such property Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United, States Maij at least fourteen (14) days before the
date of the hearing, postage prepaid, in envelopes addressed to,all persons
owning or claiming any interest in the respective properties abutting the high-
ways streets, avenues and public places or portions thereof to be improved, as
-the names it such persons are shown on the current rendered tax rolls of the City-
of Mort Worth and at the addresses so shorn, or if the name of such respective
owners do not appear on such rendered tax rolls then address to such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon In those cases in which an owner of property
abutting a highwap, street, avenue orpublic place or portion or portions there-
of which is to be improved is listed as "unknown " on the then current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax tolls but no. address for such owner is shown, no notice need be mailed In
those cases where the owner is shown to be an estate, the mailed notice may 'be
Addressed to such estate In this connection, the City Secretary `shall prepare
and file or cause to.be prepared and filed with these proceedings a list of .the
properties to be assessed,, the names of those persons ownitig or claiming any
interest in said properties to whom the notice was'mailed, together with the last
known addresses determined as aforesaid of the respective owners and those per ,.
sons ownin& or claiming any interest in said property
The City Secretary shall certify that: each of the parties in said list whose
address is shown on the then current rendered or unrendered tak rolls of the City
of Fort Worth was mailed a copy of .the notice of hearing and shall further certify
the date or dates on which said notice wag mailed A copy of each notice shall be
attached to.such certificate The cer't'ificate of thi City ;Secretary will.be con-
clusive evidence of the facts therein recited

The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City

This ordinance shall take effect and be in full force and effect from and
after the date of its passage

On February 7 1977 (M &C C -3669) the City Council approved a Community Faci-
lities Contract with Four -Way Properties Inc for the development of North Par
Business Center which is located on the south side of East Northside Drive and
west of Samuels Avenue The contract did not stipulate the upgrading of East
Northside Drive however the developer and other property owners requested
the street be improved to provide continuous curb and better access to their
businesses
On November 14 1978 (M &C C -4418) the City Council approved an engineering
contract with Farrington and Associates, Inc to perform the engineering design
service and prepare plans and specifications for the improvement of East
Northside Drive to include the widening to five lanes required left turn lanes
and median openings curb and gutter drainage facilities and required appurten-
ances
Improvements
East Northside Drive will be improved by removal of the asphalt surface, removal
of a portion of the concrete median and replace it with a new concrete base
repair existing concrete base failures and widen the base from 48 to 60 feet to
include construction of a concrete superimposed curb and construct a new hot -mix
asphaltic surface course the length of the project Storm drainage will consist
of 576' of concrete pipe and appurtenances
Receipt of Bids
The project was advertised for bids on January 17 and 24 1980 and the fol
bids were received on February 7 1980 with 90 working days allocated

Assessments
All of the adjacent property is zoned industrial Standard City Policy states
that under street reconstruction or widening property zoned other than residen-
tial shall be assessed for non-existing -curb gutter and driveway approaches
plus widening The assessment paving policy for new street construction also
limits the amounts to be assessed on a 40-64' wide street to 29' of paving
from the face of the curb toward the center of the street East Northside Drive
has previot:r,been constructed to a 48' wide roadway and assessed accordingly
Consequently on this project property owners will only be assessed for non-
existing concrete curb and driveway approaches which amounts to approximately
$4 753 77
Project Cost and Financing
As outlined above approximately $4 753 77 is proposed to be assessed against
adjacent properties and will be provided for by a bond fund transfer from the
Revolving Fund Unspecified Cost to the City for construction is approximately
$134 584 73 Since there are insufficient funds available in the accounts for
streets in new additions this will require a bond fund transfer in the amount
of $134 600..4kom the Arterial Streets Unspecified Account No 013-022-901
(1976-78 funds) This account presently has approximately $241 618 available
due to unused allocations from completed projects In addition a bond fund
transfer is required from the Engineering, Unspecified Account in the amount of
$2 800 to supplement the engineering funds in the project account for inspection
and administrative salaries
