An ordinance amending sections ' )s. i of ordinance No. 28, passe,' �� 2 entitled "An ordnance pen•-' • ing of streets and thor- of Fort Worth, and shall be done ^d • ORDINANCE NO. 5a_ An ordinance amending Sections Nos.2 and 3 of Ordinance No.28, passed July 9,1907,entitled "An Ordinance providing for the paving of streets and thoroughfares n the City of Fort Worth, and prescribing how same shalt be done and the manner of pro- ce-ure with reference thereto, and providing for the assessor nt of the expense of such suchl‘!misomme against abutting property owners and against the owners of street car lines and declaring such expense to be a lien on abutting property and on such car lines" , • so as to reduce the time from ninety days to thirty days within which property owners in the City of Fort WOrth shall comply with the order of the Board of Commissioners requiring pavement to be made in front of abutting property and reducing the time from ninety days to thirty days aLt er the date of said final order of the Board of Commissioners requiring such pavement to be made ,within which,upon disobedience to said order by such abut- -- ting property .owner, the Heard of Commiesi a*i s- may °i rec t such improvements to be made and taxi-4s the cost of such improvement against the property and person of such owner. , BE IT ORDAINED BY THF; BOARD OF COMMISSIONERS OF THE 'CITY OF FORT WORTH: - Section 1 , That Section 2 of Ordinance No.28,pa.ssed by the Board of Commissioners of t)ie City of Fort Worth on July 9,1207, entitled"An ordinance providing for the paving of streets and thoroughfares in the City of Fort Worth, and prescribing how same :shall be done and the manner of procedure with reference thereto, and providing for the assessment of the expense of such work against abutting propeety owners and. against the owners of street car lines acid declaring such expense . to be a lien On abutting property and on such car lines, " be and the same is hereby amended so as to read as follows: "Sec . 2. Then the _ Board of Commissioners shall nave considered the matter as afore- said and shall have heard and ae 'aermined all the p rotests,i f any, _l- and shall have fully determined as aforesaid the necessity for said _improvement and whether the property will be enhanced in value and whether in a sum equal to the costs and if not the extent to which same will be enhanced in value, if at all, then the said Board�Qshall have power and be authorized if it sees fit SA 3t� to pass an order directing said property owners A respectively to construct said improvement in front of their respective properties within thirty days from said date,specify- ins the kind of pavement required to be made,and shall give no- tice to the owner or .his agent either by serving him or his agent with written notice or by making publication of the order in the official newspaper of the city once a week for four con- secutive weeks." Section 2. Be it further ordained by the Board of Commis- sioners of the City of Fort Worth that Section 3 of the afore- said ordinance No.28 be and the same is hereby amended so as to read as follows: "Sec.3. In the event any property owner at the expiration of said thirty days from the date of said order mentioned in Sec .2,shall not have constructed said improvement in accordance with said order then it shall be in the power of and shall be the duty of the Board of Commissioners to direct the City Engineer to construct said improvements or engage some private contractor to construct the same under the supervision of the City Engineer and shall have the same constructed in man- ner and form required by the order and upon so giving said di- rections shall levj ,asSeSS and tax the cost of constructing said improvement in front of such property against the said property and shall declare the sane to be e. lien,Qrd the same shall be and become a lien upon the said property until such time as the said owner may pay or cause to be paid the said costs together with interest thereon, at 10 par cent per annum,payable annually from date thereof, until payments shall have been made and nast due interest shall bear interest at 10 per cent per annum and .-3- the said indebtedness shall then and thereafter be and consti- tute a valid indebtedness against the owner of said property and shall be subject to suit in any court having jurisdiction thereof,and said lien shall be and remain in force and be sub- ject to Foreclosure in any court having jurisdiction thereof." section 3. That this rrdinance take effect and be in force from and after its passage and publication as required by law.
