WHLREAS the extending of the City Limits and the growth of the City of Fort Worth will require extensive development in gas, water and sewage systems of the City and WHEREAS the health and safety of the citizens of Fort Worth demands protection both to the City as such and to all persons requiring the services of plumbers, BE IT ORDAINED ED BY THE BOARD OF C O 1'TISSI ONER SOF THE CITY OF FORT WORTH - SECTION I`s DEFINITIONS When used in this ordinance - The term "person" or "master Pumlber" includes partnerships, associations and corporations as well as individuals . The term "Master, or Employing, Plumber" is de- fiped in Ordinance No . 7 -" of the City of Fort Worth, Texas ana such definition is hereby adop4ed for the purposes of this ordinan e . SECTION II. APPLICATION FOR LICENSE . All master or employing plumbers holding certi- ficates of qualification issued by the examining and supervising board of plumbers or the City of Fort Worth, Texas, as provided by ordinance, desiring to contract plumbing work in the City of Fort Worth, Texas, shall present their reppective certificates of qualification to the Inspector of plumbing, or his authorized repre- sentative, and shall fill out an application for license to contract plumbing in the City of Fort Worth, Texas, on forms to be prescribed by the Inspector of plumbing and pay the license fee refired, viz- N 100.00 per annum, provided all licenses herein provided for shall be for the calendar year, and any license issued for the unexpired part or any year s'r al l be paid pro rata for the unexpired portion of said year, all license, or other fees, herein provided 1 `. for, shall be paid to the City Water Works and Sewerage general fund, for the use gf the plumbing Department thereof. 'When said application has been properly filled out and approved and the applicant has duly complied with the other requirements of this ordinance, a license shall issue to said applicant licensing him as a i:aster plumber to do contract plumbing in the City of Fort Worth, Texas, which said license shall continue in effect as herein pro- vided, said licenses to be issued as other licenses are issued by the City of Fort Worth. SECTION III . BOND AND INDEMNITY. till ' aster plumbers licensed to carry on plumbing business within the City of Fort Worth, under the terms or this ordinance shall, before the license herein provided for shall be issued and before they do any work upon any sanitary sever, or make any connections therewith, or up- on any water mains or pipes, or make any connections there- with, execute and deliver to the City of Fort Worth, Texas, a bond in the sum of $ 5, Uuu.00 ror the use and benefit of the ,,ity of bort forth, conditioned for the faithful rer- formance of the duties of Master Plumber and ror the faith- ful performance of all duties required by law relating there- to, and especially conditioned as provided in Section IV hereof. SECTION IV. DUT IESOF ,-.ASTER Ai D EVFLOYL G PLUMBER. (a) All work upon any sanitary sewer, or any connec- tion therewith, or work done upon any of the mains, pipes, or connections to the City Later Works of the City of Fort Worth, shall be done in good and workman like manner and in accordince with the rules, regulations and ordinances now or hereafter in existance . (b) The City of Fort V orth shall be fully indemni- fied and held whole and harmless from any cost, expense , injury or damage on account of any injury or damage done to any person or property in the prosecution or said work of as the consequence or the doing of said work, or that may arise out of, or be occassioned by the performance of said work. (c ) the said licensee carrying on any such plumbing business shall replace, in a good and workman like manner, and restore any portion of arra- street or alley, which may be opened for the purpose of making any connection with any gas, water or sewer, pipe or main, and all such openings and ex- cavations shall be refilled and restored and the street or al- lay placed in as good condition as it existed before any such opening or excavation was made. provided that if said opening or excavation is not refilled and restored as herein provided, and approved by the City Engineer, it shall be the duty or any such lic- ensee to do promptly refill and restore same upon a written notice from the City Engineer and provided also that in the case of the failure of said licensee, on receiving said notice, to so refill and restore, as directed by the City Engineer, within three days after the receipt of such notice, the City 2 Engineer shall report such fact to the Board of Commissioners which Board may thereupon order the City Engineer to restore said street at the cost of said licensee and the certificate of said City Engineer, certifying the cost of such restoration shall be conclusive evidence against said licensee as to the cost thereof. (d) 44 such licensee shall, in any way, injure any sanitary sewer, meter, meter box, or any other water works or pipe, or any other of the equipment belonging to the City of Fort Worth, in making any connections, or discon- nections, therewith, or doing any work upon sane, or shallfail to do any such work or make any such connections, or disconnections, in accordance with the rules, regula- tions and ordinances of the City of Fort Worth, the in- jury or damage sustained thereby shall be paid by said licensee upon the measure of such damage being established by agreement, by arbitration award,or by judicial determin- ation. (c ) Said licensee shall do all plumbing in houses or public buildings where same is to be connected with either the city sewers or the city water works pipes or connections, so that the same shall conform to the rules, regulations and ordinances of the city of Fort Worth. provided that if such licensee shall fail, neglect or refuse so to install or construct such plumb- ing work or connections, the owner of such house or building who may be injured thereby shall have a right of action against such licensee for such injury or damage sustained provided however that such work must first be inspected and disapproved by the Inspector of plumb- ' ing of the City of r'ort ydorth. And if said Inspector of plumbing shall refuse to issue his certificate of approv- al of said work, then he shall notify said licensee, in writing, to change or rectify said work so that the same will comply with the rules, regulations and ordinances of the City of Fort Worth, and if said licensee shall fail, neglect or refuse to so do within three days after the receipt of said notice then the owner of such building or residences may proceed to change or rectify said work to comply with the rules, regulations and ordinances of L,he City, at the expense of said licensee and shall have a right of action against him for the cost thereof. (f) It shall be unlawful for any Piaster plumber to do any plumbing work within the City of Fort Worth unless and until said laster plumber licensed, or to be licensed, as hErein providedm shall have procured and deposited with the City Secretary of the City of Fort Worth, the bond hereinbefore provided for, executed by himself arrt secured by some solvent surety company incorpor- ated under the laws of the State of Texas, or with permit to do business in this State, as surety or security on said bond. (g) Iii the event said surety company, executing said bond as surety,: should, for any reason, withdraw, from said bond as surety thereon, it shall be unlawful 3 for said :1;:aster plumber to continue in any plumbing work, then being done by him or thereafter to be done by him, until said bond shall be properly executed and secured by another surety company incorporated under the laws of the State of 'iexas, or with permit to do business in the State of Texas , or until another like bond shall have been procured and deposited with the City Secretary, as aforesaid. SECTION V. APi-ROVAL OF Ben . The bond herein provided for shall be submitted to and approved by the Board of Commissioners at any regular or special meeting of said Board of Commissioners, and said bond shall be in form prescribed by said Board of Commis- sioners . SECTION VI . REGISTRATION OF LICENSEE . Any TFastcr plumber licensed unuer uhe provisions of this ordinance shall furnish to .he officer issuing said license the full name and address of each person constituting such licensee and same shall be duly regis- tered by said officer . SECTION VII. REVOCATION. Any license issued to any , aster plumber here uneer may be revoked by the Board of Commissioners of the City of Fort Worth at any time upon charges filed against said licensee by the Board of Commissioners, ' on its own motion, or by f\ny member thereof, or by any person showing himself to be interested, provided how- ever, that charges under oath shall be p- e pared and filed against the licensee, with the City Secretary, who shall present the same to the Board of Commissioners of the City of Fort Worth, whereupon said Board shall fix the time ana place for the hearing of said charges, andl:?the licensee shall be furihished with a copy thereof and given an opportunity for a full hearing thereon. If, on hearing, the Board of Commissioners of the City of Fort Worth shall be of the opinion that said license shall be revoked, they shall so order and thereupon a proper adjustment shall be made with the said licensee as to the bond and the license fee paid to the City of Fort Worth, as hereinbefore provided. SECTION VIII. LICENSE NOT '1RANSI LRABLE . Each license issued under the terns of this ordinance, and each permit as hereinbefore provided for, shall be personal to the licensee and shall not be assigned or transferred, nor shall the licensee rermit his name to be used, either directly or indirectly, by any other person for the purpose of obtaining a license or permit, or doing any work as raster Plumber in the City of Fort Worth. 4 SECTION IX INSPECTOR OF PLUMBING - POLICE POWER . The Inspector of plumbing of the City of Fort Worth shall, hereafter, be under the supervision of the Water Works and Sewerage Commissioner, and he shall have and posses, for the purposes of this ordinance and all ordinances relative to plumbing work in the City of Fort Worth, full police power . SECTION X. PERMITS. (a) Application blanks for permits for sewer connections , installing or constructing plumbing shall be furnished by the Imspector of Plumbing, or his authorized representative who shall approve or counter- sign all applications for water or sewer connections before permits therefor shall be issued. (b) Amy plumber, or firm of plumbers, or corpor- ation engaged in plumbing work, desiring to open any street or alley ro make any connections with the City sr wer shall, upon application to the City Engineer, or his authorized representative, receive a €Ermit to open a street or alley or connect kith the sewer as the terms of the permit shall specify. (c ) Any plumber or firm of plumbers, or corpora- tion engaged in plumbing work, desiring to construct or install any fixture, or fixtures, in any building or house in the corporate limits of the City, or to connect any fixture, or fixtures, in any building or house that may have been disconnected for any reason whatsoever, shall obtain a permit from the Inspector of plumbing, or his authorized representative, before said work can be installed, constructed or reconstructed, as the case may be . (d) The suit of One Dollar (w;l .00) for one fixture, or rouhing. I ,and seventy-five cents (75 ) each for all additional fixtures, or roughing in, shall be paid as a permit and inspection fee for fixtures proposed to be placed in the work described in the application for such permit under this ordinance . That said sum shall be paid by :the Master Plumber to whom the permit is issued under the terms of this ordinance . By the term "fixtures" used herein, is meant each water closet, sink, bath tub, basin or section of basin in battery, drinking fountain, soda fountain, urinal, laundry tray, or section of laundry tray, sand trap, catch basin, and all other receptacles that ray be classed as plumbing fixtures . The permit and inspection gee shall apply to floor and cel- lar drains (connected directly with the sanitary sewer) , septic tanks and sewers . Fees to be paid for on the same basis as plumbing fixtures . A fee of One Dollar (0. .00) shall be paid for a permit and inspection of outside closets and connections . All permit fees provided for herein shall be paid to the Inspector of Plumbing as herein provided for . (e ) A special permit in writing may be issued by the Inspector of Plumbing where additional fixtures are to be made, which cannot be practically constructed in accordance with all the provisions of these revelations, if, in his judgment, the conditions require it, but such additions or alterations shall be of a character that will make the plumb- ing system in the building as a whole conform to the spirit of the sanitary requirements of these rules . 5 e. ele ewe SECTION XL. INSPECTION AND TEST. (a) Application in writing for inspection must be made to the Inspector of Plumbing when work is ready for inspection at least four hours before such interaction is desired, All plumbing wort- shall be inspected by the City Inspector of plumbing, or under his directions, as follows: (b) No soil, drain or vent pipe shall be covered from view or concealed until after work hen been tested, inspected end aprreved by plumbing inerector. The Inspector must also inspect said sewer. Openings or trenches must not be refilled until said sewers of cornections have been approved, If anypart is covered befbre beim, inspected and approved, it shal he uncovered at the direction of the Inspector, at the expense of the plumber. (o) There shall be two inspections on all work in any building - One inspection made when roughing, in is complete, vizi The entire system shall be prepared for inepeot ion, waste and vent openings shall be sealed or plugged and system filled with water to top of steak on roof. If leaks are indicated, they shall he corrected at once by removing all defective materiel and rep laced by sound material, then water tests shall be repeated until the work is found to be tight and to conform with the requirements of this ordinance. Final inspection shall be made when the work is fully oomFloted and building is ready tar occupancy, Upon making final inspection, findingmaterial end construction ooeplying with the plumtir ordnance, the inspector shall issue to the contracting plumber a f.iertl inspection certificate showing the work has been completel and accepted. (d) Fefore the city water, shell be turners on to a premises the owner or agent of the property must show to the Secretary of the water Department, final inepectirn certificate which shall state that the plumbing hee been completed in strict accordance with the ordinance relating thereto. Any person turning on the water, or procuring another person to turn it on without this certificate from the plumbing inspector shall be guilty of n misderpesr►or, end on conviction thereof, shall be fined as herein rrovided for a. violation of this oreinanoe. SECTION XII. FIRTURFS. (a) Material -- All receptacles used for water olosets, urinals or otherwise, for the disposal of human excreta, shall to constructed of materials impervious to moisture and t at will not corrode sech as vitrified earthenware hard natural stone or onet iron white porcelain enameled on inside. This ordinance shall not repeal the provision of any other existing ordinance of the City of Fort Worth (except such as ate in direct conflict herewith) but shall be con- strued as cummulative of and in addition to the provisions of such ordinances . SECTION XXXI. RESERVAT I0N . The terms of this ordinance shall not be construed to operate against or upon any plumbing contract, or contracts, which may have been entered into under the existing orainances, if the performance of the work under such contracts has been undertaken and in unfinished at the time of the taking effect of this ordinance . SECTION XXXII PENALTY That any person , as herein definedm violating any of the terms or provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction shall be fined in any sum, not less than wy 20.00 nor exceeding v 200 .00; that in addition to s aid fine the Board of Commissioners may declare the license held by any such person forfeited. That in case of a violation of any of the terms or provisions of this or- dinance by any corporation, the officers and agents actively in charge of the business of such corroration, or the person actually performing the work for such corporation shall be . subject to the penalty herein prescribed. SECTION XXXIII EJE RGENCY The fact that the present rules and regulations of the City of Fort Worth, governing plumbers in the installation of plumbing work, are inadequate, and there exists conditions endangering the life and safety or the inhabitants of the City of Fort Worth, creates an: urgency and an emergency for t1 irr rediate preservation of public health and safety, therefore, this ordinance shall take effect at once, and it is accordingly ordained that this ordinance take effect from and after its passage, approval and publication, in book or pamphlet form, as in the Charter in such cases made and provided.
