THE STATE OF TEXAS KNOW ALL BY THESE PRESENTS COUNTY OF TARRANT AGREEMENT This Agreement is made and entered into this day of 2005, by and between the County of Tarrant, acting herein by and through i governing body, the Commissioners Court, hereinafter referred to as COUNTY, an the City of Fort Worth, hereinafter referred to as CITY, both of Tarrant County, State of Texas, witnesseth: WHEREAS, each governing body, finds that the performance of this Agreement is in the common interest of both parties and that the undertaking will benefit the public; WHEREAS, the COUNTY is the recipient of a United States Department of Justice, Congressionally Mandated Grant, Number 2004-DD-BX-1243 for the purpose of providing automated fingerprint systems to identified cities within the COUNTY; and WHEREAS, the CITY requires said equipment. NOW THEREFORE, the COUNTY and CITY agree as follows: COUNTY agrees to provide the CITY title to two live scan inkless fingerprint systems and network security firewalls; CITY agrees to use, manage and, if necessary, dispose of said equipment in accordance with the obligations and conditions imposed on recipients of this type of property as set forth in 28 CFR Part 66. By entering into this Agreement, the parties do not intend to create any obligations express or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto. COUNTY and CITY agree that COUNTY has no right under this contract to supervise or to direct the actual performance of CITY'S employees as CITY is an independent contractor. 1 of 2 �l9 GI�Giy U 4K, Neither COUNTY nor any employee thereof is an agent of CITY and neither CITY nor any employee thereof is an agent of COUNTY. This agreement does not and shall not be construed to entitle either party or any of their respective employees, if applicable, to any benefit, privilege or other amenities of employment by the other party. No person not a party to this contract may bring a cause of action pursuant to this contract as a third party beneficiary. This contract may not be interpreted to waive the sovereign immunity of any party to this contract to the extent such party may have immunity under Texas law. This contract may not be interpreted to create a joint venture between the parties to this Agreement. This agreement becomes effective when signed by the last party whose signing makes the agreement fully executed and remains in force and effect until disposal of said equipment unless otherwise terminated. County Clerk(Designe City Secretary 0, 2 of 2 Coatract Authorization DD CITc' ' i- 1�1r1�r' Date �� City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 4/19/2005 DATE: Tuesday, April 19, 2005 LOG NAME: 35AFIS REFERENCE NO.: **C-20664 SUBJECT: Authorize Agreement between the City of Fort Worth and Tarrant County to Provide Title to a Live Scan Inkless Fingerprint System and Network Security Firewall RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute an agreement to acquire two live scan inkless fingerprint systems and network security firewalls from Tarrant County at no cost to the City of Fort Worth. DISCUSSION: Tarrant County is the recipient of a United States Department of Justice, Congressionally Mandated Grant, Number 2004-DD-BX-1243 expressly for the purpose of providing automated fingerprint systems to identified cities within the County. This Automated Fingerprint Identification System is to be titled to the City of Fort Worth at no cost. The City of Fort Worth requires this type of equipment for conducting automated fingerprint queries and agrees to use the equipment in the furtherance of criminal justice activities. Due to the workload, two systems have been targeted for the City of Fort Worth. One unit each will be placed at the Jail Unit and in Records Management. A portion of the Automated Fingerprint Identification System requirements will at a minimum include: Live Scan digital print capturing unit; Connectivity to the DPS for purpose of sending and receiving electronic records; Printing device capable of producing FBI Certified output; Protective cabinet to house the Live Scan system; Electronic interface between the Live Scan system and the current jail management system; Electronic interface between the Live Scan system and the Tarrant County District Attorney Electronic Case Filing System; All software necessary to operate the Live Scan and related equipment; and Any other items (hardware, software, services, etc.) needed to provide a complete turnkey solution. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action has no material effect on City funds.
