ORDINANCE NO. 22537-12-2016 AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF TWO ALLEYS AND ALL OF REFINERY STREET, N.W. 8TH STREET,A PORTION OF HOUSTON STREET, NORTH THROCKMORTON STREET AND N.W. 7TH STREET, ALL SITUATED IN THE F.G. MULLIKEN SURVEY, ABSTRACT NO. 1045, TARRANT COUNTY, TEXAS AS SHOWN ON THE PLATS RECORDED IN VOLUME 63, PAGE 149 AND VOLUME 204A AND PAGE 117 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following alleys and streets described below: 1. Being that portion of a ten foot wide alley situated in the F.G. Milliken Survey, Abstract No. 1045, located in Block 37, between N.W. 8t' Street and Refinery Street in the North Fort Worth Addition, an addition to the City of Fort Worth, Tarrant County Texas; being as shown on the plat as recorded in Volume 63, Page 149 of the Plat Records of Tarrant County, Texas, containing 2,796 square feet(0.064 acre)of land more or less; 2. Being that portion of a ten foot wide alley situated in the F.G. Milliken Survey, Abstract No. 1045, located in Block 37, between N.W. 7t' Street and N.W. 8th Street in the North Fort Worth Addition, an addition to the City of Fort Worth, Tarrant County Texas; as shown on the plat as recorded in Volume 204A, Page 117 of the Plat Records of Tarrant County, Texas, containing 4,013 square feet(0.092 acre)of land more or less; 3. Being all of Refinery Street, N.W. 8t' Street, a portion of Houston Street, North Throckmorton Street and N.W. 7t' Street situated in the F.G. Milliken Survey, Abstract No. 1045, located in the North Fort Worth Addition, an addition to the City of Fort Worth, Tarrant County Texas; as shown on the plats as recorded in Volume 63, Page 149 and Volume 204A and Page 117 of the Plat Records of Tarrant County, Texas, containing 180,747 square feet (4.149 acre) of land more or less; and as more specifically described in Exhibits "A-C" attached hereto and incorporated Refinery,NW 76'&8t`,Throckmorton,alley Ordinance No.22537-12-2016 (VA-16-037) Pagel of 2 herein, by reference be and the same are vacated and extinguished. SECTION 2. That the easements to the lands in the above-described vacated alley and street rights-of- way are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in the easements are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. Adopt the attached ordinance vacating portions of NW 7th Street, NW 8th Street, North Throckmorton Street, North Houston Street, all of Refinery Street and two alleys in North Fort Worth Addition for the Trinity River Vision Master Plan; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. DISCUSSION: The Tarrant Regional Water District has requested the vacation of these rights-of-way to be included within the Federal Floodway Project for the bypass channel as a part of the Trinity River Vision Master Plan. The City Plan Commission recommended approval of this request at its meeting on November 18, 2016 and a waiver to the requirement to include the vacated rights-of-way in a final plat. Tarrant Regional Water District has stated that the areas outside of the Federal Floodway area will be final platted before any development may occur, and has provided a timeline for platting prior to construction. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easement for the street and alley. This M&C does not request approval of a contract with a business entity.
