HomeMy WebLinkAboutOrdinance 8069'0' T;. ~ q ~~ ~.:"Fi ORDINANCE NO ~ D ~p~ AN ORDINANCE OF 'PHE CITY OF FORT WORTH :TEXAS GRANTING PURSUANT TO CHAPTER XXVII SECTION 5 OF THE CITY CHARTER, A :PRIVILEGE TO VIEW CABLE TV TO USE A PUBLIC STREE'T' OF THE CITY OF FORT WORTH FORA PERIOD OF FIVE (5) YEARS; PROVIDING FOR CON- SIDERATION PROVIDING A SEVERABILITY CLAUSE AUTHO- RIZING FORMS AND PROVIDING AN~~EFFECTIVE DATE ~ WHEREAS the City of Westworth Village a community geo- graphically surrounded by the City of Fort Worth and other incorporated cities has granted a fifteen (15) year franchise in its Ordinance No 104 approved and effective February 11 1980 to View Cable TV and 1 WHEREAS View Cable TV proposes to locate its cable pro- gramming-receiving equipment in the City of River Oaks and provide local distribution of such programming to its West- worth customers by means of: cable and pole-line facilities therein and WHEREAS Westworth and River Oaks are physically separated by a strip of land located within the corporate limits of the City~of Fort Worth and WHEREAS public necessity and convenience require that a short section of State Highway 183 in Fort Worth be traversed and used as a cable route to provide service to View Cable TV s Westworth customers NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH SECTION 1 r~ That the City Council of the City of Fort Worth hereby grants pursuant to CHAPTER;xXVII Franchises and Public Utilities Section 5 of the Charter of the City of Fort Worth Texas a privilege to View Cable TV its assigns or succes- sors to use State Highway 183 a public street within the { ~ .l SECTION 6 This ordinance shall 1=ake effect and shall be in full force after acceptance in writing by grantee and from and after its adoption and publication as provided by law P ROV D AS T FORM AND LEGALITY r~cc..t...-~-~ ---~ CfITY AT ORNE ACCEPTED on this day of A D 1980 VIEW CABLE TV By O L Darwin General Manager ~~~~~ ~/ a ,~ City of Fort Worth, `texas J~ayor a~ad Co~,cn~al ~o~rs,m~,a,~a,~~at~o~, DATE REFERENCE SUBJECIf Request by a Cable Television PAGE NUMBER Company fox Permission to Cross 1 of~- 3/25/80 *'~0-4487 Through City of Fort Worth Terri Cory to Serve Westworth Village 0 L Darwin d/b/a View Cable TV 'has requested that the City of Fort Worth allow him to install cable across a strip of land on State Highway 183 which is within the City limits of the City of Fort Worth and between River Oaks and Westworth Village (Attachment A) Mr Darwin Maas been awarded a cable television franchise by Westworth Village View Cable TV is constructing its equipment, for receiving satellite-beamed tele- vision programming in a building on River Oaks Boulevard and it will be necessar to ~:ri~tall cable on the south side of State Highway 183 through appro~cimately 600 feet of Fort Worth corporate.
