HomeMy WebLinkAboutContract 29481CITY EC AGREEMENT CONTRACT THE STATE OF TEXAS § § KNOW ALL MEN BY THESE PRESENTS COUNTY OF TARRANT § THIS AGREEMENT, is made and entered into this `` day of 2004, by and between the CITY OF FORT WORTH, TEXAS a tax- exempt public municipal corporation, acting herein by and through its duly authorized agent and officer, hereinafter referred to as CITY, and the COUNTY OF TARRANT, STATE OF TEXAS, acting by and through its County Judge, duly authorized so to act, hereinafter referred to as COUNTY, WITNESSETH: WHEREAS, a need exists to encourage and promote the worth and dignity of individuals and families within Tarrant County; and, WHEREAS, adults and children often require assistance with food, shelter, clothing, utilities and medical needs by means of direct and referral services; and, WHEREAS, individuals may obtain assistance with transportation needs in order to enable job searches, doctor's appointments, referrals to other social services agencies; and, WHEREAS, the CITY, through its Neighborhood Resource Development Program ("NRDP") and neighborhood centers, provides this guidance and assistance to all eligible individuals; NOW, THEREFORE, COUNTY and the CITY hereby agree as follows: US r�E , AGREEMENT BETWEEN CITY OF FORT WORTH TEXAS and TARRANT COUNTY, TEXAS( 24 The CITY, through its Neighborhood Resource Development Program, agrees to continue to provide neighborhood sites in various locations throughout Tarrant County for use by Tarrant County residents for the provision of assistance in the areas mentioned. COUNTY, for and in consideration of the services provided hereby agrees to pay to the CITY a lump sum payment of TWENTY-TWO THOUSAND AND EIGHT HUNDRED AND NO/100 ($22,800.00) for rent and utilities at the Kennedale and River Oaks NRDP centers upon receipt of documentation that the CITY has incurred such expenses during the period October 1, 2003 through September 30, 2004. To the extent provided by law, the CITY agrees to INDEMNIFY AND HOLD HARMLESS COUNTY, its officers, agents, servants or employees from any loss, damage, injury or claim arising from the negligent operation of its programs or applications of its funds. To the extent provided by law, the CITY agrees to provide COUNTY all records relating to the programs performed through the NRDP upon written request of COUNTY and to provide an annual report detailing the manner in which such funds are expended and the program details of its services. Authorize the City Manager to accept funds in the amount of $22,800:00 from Tarrant County for FY2003-2004 for two Neighborhood Resources Development Program (NRDP) Centers beginning October 1, 2003, and expiring September 30, 2004; and 2. Authorize the City Manager to execute a lease agreement with the Bethlehem Baptist Church of 1188 West Broad, Mansfield, Texas, for the Far Southeast NRDP beginning October 1, 2003, and expiring September 30, 2004, for an amount not to exceed $550.00 per month; and 3. Authorize the City Manager to execute a lease agreement with Richard Hartman of 920 Roberts Cut - Off, River Oaks, Texas, for the Far Northwest NRDP beginning October 1, 2003, and expiring September 30, 2004, for an amount not to exceed $852.02 per month; and 4. Authorize a non-interest bearing, interfund loan from the General Fund to the Grants Fund in the amount of $5,700.00 for interim financing of this grant project, pending contract execution; and 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $22,800.00 from available funds. DISCUSSION: Tarrant County provides funding for the operation of two NRDP Centers outside the city limits of Fort Worth, and will reimburse the City for any operating expenses incurred with this project. The Tarrant County Commissioner's Court contributes annually for the operation of two NRDP Centers to finance the lease agreement and operating expenses as follows: The lease for the Far Southeast NRDP is $6,600.00 per year (including water/waste costs); and The lease for the Far Northwest NRDP is $10,224.24 (not including utilities); and The remaining funds ($5,975.76) will be used to supplement the costs of utilities and telephone. The Far Southeast and Far Northwest Centers will continue to provide case management, information and referral services, client intake and assessment, emergency assistance, including the Comprehensive Logname: 8080TARRANT Page 1 of 2 Energy Assistance Program, and other social services to low-income households in southeast and northwest Tarrant County. The costs to operate the referenced NRDP Centers are wholly underwritten by federal, state and county funds. The interim financing is requested to provide a transition from one grant funding cycle to the next. Interim financing is only a temporary loan pending contract execution. Interim funds have been allocated in the Tarrant County budget. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund. Upon execution of the grant contract, the interim interfund loan will be returned to the General Fund.
