ORDINANCE ACCEPTING IMPROVl,MENTS ON A PORTION OF WEST TFRRFII AVENUE
AND PORTIONS OF SiINDRY OTHE~t STREETS , AVENUES AND PUBLIC PLACES
IN THE CITY OF PORT' WORTH, TEXASb~' DECLARING THE CONTRACT WITH
TEXAS BITULITHIC COMPANY. FoR THE cONSTRCrcTION of

WHEREASa the City of Fort Worths Teacas, has heretofore entered into a contract
with Texas Bit~~lithir Onm~r3~ , for the maleing ~xtd construction of
certaf~ street improvements on the hereinafter descritsed portions of streets, avenues and

From Lipscomb Street to Bryan Avenue, known and de-
signated as Project No 104=22000=153, Unit 1B
~^iHEREAS, by sundry proceedings heretofore assed by the City Council of the
City of Fort Worth, Texas, including Ordinance No 697 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
wHEKEAS, the City Council of the oity of Fort ~~orth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial ,justice
and equality, it is desirable and nece:;sary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No 7697 , and
WHEfirAa, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be: in complete accordance with the contract therefor;

The improvements on each of t ho portions of streets, avenues and publi4
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and perfornned

The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the differenoe between the
principal amount of the assessment and i;he amounts of any credit issued thereon The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after diving
effect to such credit, if arty, are hereby enumerated and itemized as follows

When each of t:he certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price

The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texasa
and by filing the complete ordinance in the appropriate Ordinance Records of said City

This ordinance shall take effect and be in fu11 force and effect from and after
the date of its passage
