ORDINANCE NO
AN ORDINANCE AMENDING CHAPTER 26 OF THE CODE
OF THE CITY OF FORT WORTH, TEXAS, AS AMENDED
WHICH CHAPTER. REGULATES THE OPERATION OF
COMMERCIAL MOTOR VEHICLES ON THE PUBLIC
STREETS AND ESTABLISHED TRUCK ROUTES AND
COMMERCIAL DELIVERY ROUTES WITHIN THE CITY
LIMITS OF THE CITY OF FORT WORTH BY AMENDING
SEC 26-1 TO INCLUDE THE DEFINITIONS OF A
TRUCK ROUTE, A COMMERCIAL DELIVERY ROUTE, AND
A MOTORBUS AMENDING SEC 26-74 TO REDEFINE
THE REQUIRED USE OF TRUCK ROUTES AND COM-

That Section 26-1 of Chapter 26 of the Code of the City of
Fort Worth, Texas, be amended to include the following definitions
of Commercial Delivery Route and Truck Route and that the
present definition of Motorbus be replaced with the following
definition said definitions Y-eading as follows
Commercial Delivery Route means
any street or highway so designated by
the City council for. the use by any
commercial motor vek:~icle, truck-tractor,
trailer, semi-trailer, or any combina-
tion thereof
"Motorbus. means every vehicle which
is used in transporting persons upon
the public streets of the City of Fort
Worth for compensation or hire and has a
passenger carrying capacity of more than
16 persons except those operated by
muscular power or exclusively on station-
ary rails or tracks or owned by a public
or governmental agency and operated for
the transportation of children to and
from school functions or privately owned
and operated for the: transportation of
children to and from school functions or
those operated for the transportation of
persons to and from church functions

"Truck Route means any street or

trailer, or any combination thereof
SECTION 2
That Section 26-74 of thE: Code of the City of Fort Worth,
Texas, as amended, be and the same is hereby amended so that
hereafter same shall be and read as follows
Sec 26-74 Use of truck routes
or commercial de-
livery routes re-
quired -- Generally
Except as otherwise provided here-
in, no person shall operate or cause
to be operated upon any public street
within the city any commercial motor
vehicle, motor bus, truck tractor,
trailer, semi-trailer or any combi-
nation thereof except on such streets
as are designated as either truck
routes or commercial. delivery routes
by this article such vehicles shall
be operated on a truck route wherever
capable of being used they shall be
operated on a commercial delivery route
only when it is not possible to use a
truck route to fulfill the purpose for
which such vehicle is then being oper-
ated "
SECTION 3
That Section 26-75 of Chapter 26 of the Code of the City of
Fort Worth, Texas, as amended be and the same is hereby amended
so that hereafter same shall be and read as follows
Sec 26-75 Same -- Defenses
The following shall be de-
fenses to prosecutions under the.
provisions of 26-74
(a) To operate a vehicle
to or from a truck. terminal,
garage place of repair,
place of performing a service,
or a place of loading or un-
loading over the shortest
route to a point on a truck
route or commercial delivery
route any such vehicle shall
be permitted to proceed from
one such point not on a truck
route or commercial delivery
route to another such point
without returning to a truck
route or commercial delivery
route if to so return would
increase the distance to be

traveled on nori-designated
streets the operators of any
such vehicles hall carry evi-
dence of the location of its
last stop and of its immediate
destination in order for this
defense to app3.y
(b) To operate emergency
vehicles in response to any
emergency call
(c) To operate vehicles of a
public utility while cruising
in an assigned area for the
purpose of inspecting the fa-
cilities of suc:h public utility
or providing maintenance ser-
vice to the facilities
(d) To operate motor buses for
the purpose of transporting
people for hire upon a regular
schedule over a defined route

This ordinance shall be and is hereby declared to be cumulative
of all other ordinances of the City of Fort Worth providing for the
regulation of motor vehicles upon the public streets, and this
ordinance shall not operate i.o repeal or affect any of such other
ordinances except insofar as the provisions thereof might be
inconsistent or in conflict with the provisions of this ordinance
in which event such conflicting provisions, if any, in such other
ordinance or ordinances are hereby repealed
SECTION 7
Any violation hereof shall be punished by a fine of not ex-
ceeding two hundred dollars (.$200 00) as provided for in Section
1-5 of the Fort Worth. City Code

If any section, subsection, sentence, clause or phrase of

this ordinance is for any reason held to be unconstitutional
such. holding shall not affect the validity of the remaining
portions of this ordinance and all of the remainder of this
ordinance not so held to be unconstitutional shall continue to
be in full force and effect
SECTION 9
The City Secretary of the City of Fort 4Jorth_may publish
this ordinance in map and pamphlet form for gener.al~dstrbution
among the public and this ordinance as so published shall be
admissible in evidence in all. Courts without further proof than
the production of said map anal pamphlet as provided in Section
3, Chapter XXVI of the Charter of th.e City of Fort U7orth
SECTION 10
This ordinance shall take effect and shall be in full force
from and after its adoption and publication as provided by law

HISTOR'Y':
The last ordinance concerning Truck: Routes and Commercial Delivery Routes within
the City of Fort Worth was approved in February 19E8 Population increases new
street construction and land use changes during the last 12 years has led to a
comprehensive review of trucking movements and the transporting of goods within
the Fort Worth City limits
Several problems have been identified regarding Truck/Commercial Delivery Routes
and the transporting of goods on these routes The problem delineation process
included City staff input field research efforts citizen comments and
complaints investigations of illegal trucking movements and disco-ssion with
trucking industry representatives Major problems identified with the movement
of goods within the City are
1 The growth in the 1970 s encouraged extensive warehousing residential
office shopping and industrial developments All of these developments
require a good street system. to facilitate transporting of goods and
services as well as people The high growth .rate in the region has placed a
significant increased demand on the existing Truck/Commercial Delivery
Route system within the City
2 Many residential streets are being used illegally .for transporting goods
and services
3 Sufficient police personnel are not available to monitor and enforce
existing truck laws and ordinances
4 Lack of a good up-to-date Truck/Commercial Delivery Route map has contri-
buted to the problem by not adequately informing trucking companies and
their employees of the designated routes
5 Inadequate signing of Truck/Cc>mmercial Delivery Routes throughout the City
does not properly advise truck dz•ivers of designated routes
6 The wording of the existing City ordinance makes it difficult for City
prosecuting attorneys to obtain a conviction even for an obvious violation
TRUCK/COMMERCIAL DELIVERY ROUTE TASKFORCE
The City Transportation Director is responsible for advising the City Manager
and the City Council on matters concerning the movement of persons and goods
within the City Since the matter Hof Truck/Commercial Delivery Routes is quite
sensitive the Director of Transportation sought assistance from a number of
sources In August 1978 a committee known as the Truck/Commercial Delivery
Route Taskforce was formed The Committee was composed of citizens
representatives of the trucking industry City staff and State Department of

Highways and Public Transportation staff A coordinator was provided by the
Department of Transportation to conduct meetings record minutes and to provide
information to the committee as requested The Taskforce Commit?=~e was to
recommend to the Transportation Director a comprehensive identification and
designation of Truck/Commercial Delivery Routes based on the following criteria
1 To primarily restrict Truck/Commercial Delivery Route designations to
streets of higher functional classification (i e collectors
arterials freeways)
2 To provide a system that would allow the efficient transportation of
goods and services with a minimum of disruption to residential streets
and neighborhoods

In addition the Committee was asked to recommend revisions to the existing City
Code in order to allow successful enforcement of Truck/Commercial Delivery Route
violations as well as placing restrictions on truck movements to protect
residential neighborhoods
The Taskforce after 15 months of extensive study discussion and deliberation
approved the attached Revised Tru~~k/Commercial Delivery Route Ordinance at its
meeting on Thursday December 13 1979
DIFFERENCES BETWEEN THE EXISTING A]VD PROPOSED ORDINANCE
The following changes are included in the revised ordinance
1 Section 26-1 is amended to include definitions of Truck Routes
Commercial Delivery Routes and Motorbuses
2 Section 26-74 is amended to redefine the required use of Truck and
Commercial Delivery Route's
3 Section 26-75 is amended to provide defenses in place of excep-
tions to the required use of Truck and Commercial Delivery Routes to
facilitate enforcement
4 Section 26-76 is amended to redesignate specific streets as 'Truck
Routes and
5 Section 26-77 is amended to redesignate specific streets as Commer-
cial Delivery Routes

There are three major differences between the existing and proposed ordinance
1 The proposed ordinance should be easier to prosecute thereby reducing
violations This is done by altering Section 26-75 to specify defenses
from prosecution rather thane exceptions The City prosecutor explains
that under the present ordinance the State (or City) must show that none
of the exceptions listed are valid however under the proposed ordinance
the defendent must show that he/she has a defense as listed to avoid
conviction

2 The proposed ordinance in Section 26-75 requires a truck driver to use
the shortest route available when off of a Truck Route or Commercial
Delivery Route This can be checked more easily by a police officer as
opposed to the present wording which allows the shortest reasonable route
3 The exact routes to be included as Truck Routes (Section 26-76) and/or
Commercial Delivery Routes (Section 26-77) have been updated to reflect the
current transportation system and needs
OTHER RELATED ACTIVITIES
In addition to the updating and revising of the ordinance several related
activities are planned Funds havEa been set aside to print 7 500 copies of a
complete map of the City showing the Truck Routes and Commercial Delivery Routes
with the complete text of the ordinance printed on the back This should be
sufficient to .provide ample copies to all trucking or delivery firms operating
in the Fort Worth area Funds also were included in this year s budget to
properly sign all Truck and Commercial Delivery Routes throughout the City
Work is underway to obtain funding from the State Office of Traffic Safety for
additional police off icer.s to better enforce the ordinance and other truck
related laws and ordinances
During the discussion of the ordinance- the Taskforce found that in some cases
the condition and geometries of certain streets created major problems for truck
movements and asked that those problems be corrected Staff will attempt to
include these as projects in future Capital Improvement Programs
The problem of illegal truck traffic is very complex and requires a coordinated
set of solutions including the d termination of demand defining acceptable
movements notifying trucking companies and their employees of what is
acceptable and a program of strict enforcement It is hoped that the work of
the Taskforce and staff as reflectfad in the attached ordinance will accomplish
the desired results
RECOMMENDATION
It is recommended that the City Council adopt the attached Truck/Commercial
Delivery Route Ordinance
