ORDINANCE NO. ~~ ~D
AN ORDINANCE DISCONTINUING TERRITORY FROM
WITHIN THE CORPORATE LIMITS OF THE CITY OF
FORT WORTH, TEXAS; RELEASING TERRITORY FROM
THE EXTRATERRITORIAL JURISDICTION OF THE CITY
OF FORT WORTH; CONSENTING TO THE ANNEXATION
OF SAID TERRITORY BY THE CITY OF BENBROOK,
TEXAS; PROVIDING THAT THIS ORDINANCE SHALL
AMEND EVERY PRIOR ORDINANCE IN DIRECT CON-
FLICT; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE; PROVIDING FOR SEVERABILITY AND
NAMING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1
That the hereinafter described territory within the corporate limits of the
City of Fort Worth be and the same is hereby discontinued as a part of the City
of Fort Worth; said territory being:
Parcel ~~ 1
ALL that certain tract or parcel of land out of the E.H. Burke Survey
Abstract 160, Fort Worth, Tarrant County, Texas, and being further
described by metes and bounds as follows:
BEGINNING at a point in the centerline of a 140.0 foot wide drainage
channel, said point being the most Easterly Northeast corner of Lot 1,
Block 5, Country Day Meadows Second Filing, Benbrook, Tarrant
County, Texas, as recorded in Volume 388-134, Page 30, Deed
Records, Tarrant County, Texas, said point also being on the present
Benbrook -Fort Worth City Limit line;
THENCE North 38 degrees 00 minutes 00 seconds West, 29.31 feet
with said City Limits line to a point in the centerline of the Clear
Fork of the Trinity River;
THENCE South 74 degrees 25 minutes 43 seconds East, 23.01 feet to
a point in the centerline of said drainage channel;
THENCE South 13 degrees 42 minutes 05 seconds West, 17 41 feet
with the centerline of said drainage channel to the place of beginning
and containing 200 square feet of land or 0.005 acres of land, more or
less.

ALL that certain tract or parcel of land out of the E.H. Burke Survey,
Abstract 160, Fort Worth, Tarrant County, Texas, and being further
described by metes and bounds as follows:
BEGINNING at the intersection of the present Benbrook -Fort Worth
City Limits line and the Southerly right-of-way line of Bellaire Drive
South as shown on Country Day Meadows 2nd Filing, plat recorded in
Volume 388-134, Page 30, Deed Records, Tarrant County, Texas, said
point being on an Easterly curve to the left whose center point bears
North 11 degrees 19 minutes 48 seconds West, 895 74 feet;
THENCE with said Bellaire Drive South right-of-way line the follow-
ing calls
Easterly with said curve through a central angle of 3 degrees 40
minutes 12 seconds an arc length of 57 38 feet to end of curve;

North 75 degrees 00 minutes 00 seconds East, 50.00 feet to the
beginning of a curve to the right having a radius of 966.20 feet;
Easterly with said curve an arc length of 266.23 feet to end of
curve;
and South 89 degrees 12 minutes 46 seconds East, 115.57 feet to a
point in the old Westerly right-of-way line of Bryant-Irvin Road;
THENCE South 0 degrees 12 minutes 35 seconds West, 62.94 feet with
said Bryant-Irvin Road right-of-way line to a point on said City
Limits line;
THENCE North 89 degrees 19 minutes 30 seconds West, 482.86 feet
with said City Limits line to the place of beginning and containing
22.158 square feet of land or 0.509 acres of land, more or less.

ALL that certain tract or parcel of land out of the E.H. Burke Survey,
Abstract 160, Benbrook, Tarrant County, Texas, and being further
described by metes and bounds as follows:
COMMENCING at a point in the centerline of a 140.0 foot wide
drainage channel, said point being the most Easterly Northeast corner
of Lot 1, Block 5, Country Day Meadows Second Filing, Benbrook,
Tarrant County, Texas, as recorded in Volume 388-134, Page 30, Deed
Records, Tarrant County, Texas, said point also being on the present
Benbrook -Fort Worth City Limit line;
THENCE South 13 degrees 42 minutes OS seconds East, 31 43 feet
with said channel centerline to the beginning of a curve in the left
having a radius of 508.04 feet;
THENCE Southwesterly with said curve and channel centerline an arc
length of 206.59 feet;
THENCE South 37 degrees 00 minutes 00 seconds West, 133.91 feet
with said channel centerline to a point in said City Limits line and the
place of beginning of the herein described tract;
THENCE South 37 degrees 00 minutes 00 seconds West 4.94 feet with
said channel centerline to a curve to the left having a radius of
305.44 feet;
THENCE Southwesterly with said curve and channel centerline an arc
length of 145 90 feet to a point in said City Limits line;
THENCE with said City limits line the following calls:
North 59 degrees 53 minutes 00 seconds West, 43.80 feet;
North 36 degrees 53 minutes 00 seconds East, 135 70 feet;
and North 69 degrees 42 minutes 00 seconds East 17 71 feet to the
place of beginning and containing 2,979 square feet of land or
0 068 acres of land, more or less.
SECTION 2.

THAT the above described territory is shown on Exhibit A which is at-
tached hereto and expressly incorporated herein by reference for the purpose of
illustrating and depicting the locations of the hereinabove described territory
SECTION 3.
THAT the City of Fort Worth hereby relinquishes to the City of Benbrook
all extraterritorial jurisdictional rights over the hereinabove described territory,

under the provisions of the Texas Municipal Annexation Act (Article 970a,
Revised Civil Statutes of Texas, as amended).
SECTION 4.
THAT the City of Fort Worth hereby consents to the annexation of the
hereinabove described territory by the City of Benbrook.
SECTION 5
THAT thereafter the common boundary line between the Cities of Fort
Worth and Benbrook shall be:
A part of the E.H. Burke Survey, Abstract 160, Fort Worth, Tarrant
County, Texas, and being further described by metes and bounds as
follows:
BEGINNING at a point in the centerline of a 140 0 foot wide drainage
channel and the centerline of the Clear Fork of the Trinity River,
said point being the most Easterly Northeast corner of Lot 1, Block 5,
Country Day Meadows Second Filing, Benbrook, Tarrant County,
Texas, as recorded in Volume 388-134, Page 30, Deed Records, Tar-
rant County, Texas, said point also being on the present Benbrook -
Fort Worth City Limit line;
THENCE Southerly with the centerline of said drainage channel to
the south right-of-way of Bellaire Drive South;
THENCE Easterly with the south right-of-way line of Bellaire Drive
South to a point for corner in the old Westerly right-of-way line of
Bryant-Irvin Road and the Fort Worth City Limit line, more or less.
SECTION 6.
THAT this ordinance shall and does amend every prior ordinance in conflict
herewith, but as to all other ordinances or sections of ordinances not in direct
conflict, this ordinance shall be, and the same is hereby made cumulative.
SECTION 7
THAT it is hereby declared to be the intent of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance are sever-
able, and if any phrase, clause, sentence, paragraph or section of this ordinance
shall be declared unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this ordinance,
since the same would have been enacted by the City Council without the incor-
poration in this ordinance of any such unconstitutional phrase, clause, sentence,
paragraph or section.
SECTION 8
THAT this ordinance shall take effect and be in full force and effect from
and after its passage, and it is so ordained.

On June 24 19$0 (M&C Z-973) the City Council adopted a joint resolution
providing for realignment of boundaries between Fort Worth and Benbrook facili-
tating the development of Country Day Meadows The City Council in its approval
of the joint resolution authorized and directed the City staff to submit
boundary adjustment ordinances as necessary to fulfill the terms of the
resolution
An ordinance has been prepared providing for the deannexation of three parcels
totaling 0 58 acres by Fort Worth for annexation by Benbrook in accordance with
the joint resolution A map (.Exhibit A ) illustrating the territory to be
deanriexed is attached
Recommendation
It is recommended that the City Council adopt the ordinance deannexing territory
to be subsequently annexed by Benbrook
