ORDINANCE NO 8179
AN ORDINANCE AMENDING CHAPTER 34, "TAXIS,
BUSES AND OTHER VEHICLES FOR HIRE," OF THE
CODE OF THE CITY OF FORT WORTH (1964), AS
AMENDED, BY ADDING SECTION 34-27 1 PROHIBITING
THE PLAYING OF RADIOS, TAPE PLAYERS, ETC. ON
BUSES; PROVIDING THAT THIS ORDINANCE WILL BE
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY; PROVIDING FOR PUBLICA-
TION AND PROVIDING FOR AN EFFECTIVE DATE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION I.
That Chapter 34 of the Code of the City of Fort Worth, Texas (1964), as
amended, "Taxis, Buses and Other Vehicles For Hire", be amended by adding
Section 34-27 1, such section to read as follows:
"Sec. 34-27 1 Radios prohibited. No person shall play
any radio, tape player or like device on any motorbus
within the City This section shall not prevent the playing
of radios and like devices when the noise is reasonably
reduced through the use of headphones or earphones."
SECTION II.
That this ordinance shall be cumulative of all provisions of ordinances and
of the Code of the City of Fort Worth, Texas (1964) as amended, except where
the provisions of this ordinance are in direct conflict with the provisions of such
ordinances and such Code, in which event conflicting provisions of such
ordinances and such Code are hereby repealed.
SECTION III
It is hereby declared to be the intention of the City Council that the sec-
tions, paragraphs, sentences, clauses and phrases of this ordinance are severable,
and if any phrase, clause, sentence, paragraph or section of this ordinance shall
be declared unconstitutional by the valid judgment or decree of any Court of
competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this ordinance
since the same would have been enacted by the City Council without the in-
corporation of this ordinace of any such unconstitutional phrase, clause,
sentence, paragraph or section.

SECTION IV
That any person who violates, disobeys, omits, neglects or refuses to com-
ply with or who resists the enforcement of any of the provisions of this ordinance
shall be fined not more than Two Hundred and No/100 Dollars ($200.00) for each
offense
SECTION V
The City Secretary of the City of Fort Worth, Texas, is hereby directed to
publish the caption and penalty clause and effective date of this ordinance for
five (5) days in the official newspaper of the City of Fort Worth, Texas, as
authorized by the TEX. REV CIV STATS. art. 1176b-1
SECTION VI.
This ordinance shall be in full force and effect from and after the date of
passage and publication as above specified.

The Fort Worth Public Transportation Advisory Committee9 on Thursday August 14
1980 reviewed and unanimously approved the attached ordinance for inclusion in
Chapter 34 Code of the City of Fort Worth The ordinance adds the following
section to Chapter 34 of the City s Code
Sec 34-27 1 Radios Prohibited No person shall play any radio tape
player or like device on any motorbus within the City so as to annoy
or disturb the quiet comfort or repose of persons of ordinary
sensibilities This section shall not prevent the playing of radios
and like devices when the noise 'is reasonably reduced through the use
of headphones or earphones
Recommendation
It is recommended that the Fort Worth City Council adopt the attached ordinance
which adds a new section to Chapter 34 of the Code of the City of Fort Worth
prohibiting the playing of radios tape players etc on buses
