WHEREASp the City of Fort Worthe Texaae has heretofore entered into a contract
with texas Bi~,B~ ith; c Cenro,~~ 8 for the malting aired construction of
certain street improvrementa on the hereinafter described portions of atreetsa avenues and
public places in said Cityn to~~rit
MEACHAM BOULEVARD UNIT II From North Beach Street to IFT-35W, known and designated
as Project No 13-036'444-00, Unit II, a seven-inch thick
concrete pavement on a six-inch thick lime stabilized
subgrade with seven-inch high superimposed concrete curb,
so that the finished roadway will consist of two twenty-
six foot traffic lanes with a twenty-eight foot median
Seven-inch thick concrete approaches and turn-lanes will
be constructed where specified
SYLVANIA AVENUE, UNIT IIIA From Meacham Boulevard to Leamside, known and designated
as Project No 13-0364'44-00, Unit IIIA, a seven-inch thick
concrete pavement on a six-inch thick lime stabilized sub-
grade with seven-inch high superimposed concrete curb so
that the finished roadway will consist of twotwenty-six
foot traffic lanes with a twenty-eight foot median Seven-
inch thick concrete approaches and turn-lanes will be ~on-
structed where specified

tivHEN.~;AS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Ydorth, Texas, including Ordinance No 7672 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
wHE~~,AS, the City Council of the pity of Fort V+orth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits a~.;ainst
some one or more of the assessments levied by Ordinance No _7672 , and
WHEti~;Aa, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;

TEXAS, THAT

The improvement-s on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed
II
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance Urith
the proceedings relating to such improvements and assessments The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if arty, are hereby enumerated and itemized as follows

When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price
IV
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City

This ordinance shall take effect and be in full force and effect from and after
the date of its passage

for the contract documents and quantities actually used to complete the work

Thee work order for this prroject was issued on December 2 1977, with computation
of time to commence. on that date The con Tact stipulates. that time of
completion is an essential element of: the contract and that the street be in
full use no Pater than iJuly 22 1978 The contractor completed the concrete
roadway sufficiently to meet the needs of Dillard s Warehouse and the public
Technically the street was in full use aS specified even though there was other
work to be accomplished outside the limit's of the Meacham Blvd paving The
cohtracto.r achieved the desired results although he lost in exeess of two months
working time due to bad weather in the months of December 1977 and in January
February and March, 197$ Between December 2 1977, and l~arcli 31 1978, (119
calendar days), other projects reviewed show that City contractors were able td
work only an average of 26 working days As provided under Section 3 of the
contract the contractor is entitled to an extension for time he may necessarily
lose or be. delayed by unforseen matters over which he has no control such. as
inclement weather acts of providence labor strikes and delivery of materials
in cases that contractor negligence or carelessness did not contribute to the
delay
In addition to the delay caused by the extreme winter of 1978 the contractor
further was delayed because Lone Star Gas Company did not receive the necessary
material to relocate their facilities until after January 1 1978 and Lone Star
also was delayed by the weather Their anticipated completion date was changed
from December 23 1977 to March 22 1978 Consequently the contractor could
not. proceed with the street work where it was in conflict with the gas line
Further eight change orders were issued on the project in the total amount of
:146 189 30 and of this amount $110 995 45 was paid by the developer The Tast
change order on this project in the amount of w2 508 00 was issued on
December 31 1979
In summation since the contractor through exerted effort did sufficiently
complete the paving on ileacham Blvd by the stipulated time to meet the needs oL
Di ].lard s arehouse rand cite publ.i.c s aff recommends that no liquidated damages
be charged
Financing
Funds are available for the final payment to be made from Project Number
104-36444 Account and in water Account No 015-017769
Compliance with Specifications
The project has been completed in accordance with the requirements of the
