(Engineer) made and entered into City Secretary Contract No. 276501 (the Contract) which was authorized by the City Council by MSC C-19049 on the 16th day of April, 2002, and subsequently re- vised by two previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Sanitary Sewer Rehabilitation Contract LV (55) . WHEREAS, it has become necessary to execute Amendment No. 3 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the addition- al engineering services specified in MSC C-19871, adopted by the City Council on the 2d day of December 2003, and further amplified in a proposal letter dated June 26, 2003, a copy of which is at- tached hereto and incorporated herein. The cost to City for the ad- ditional services to be performed by Engineer total $123, 659.30. 2. Article II, of the Contract is amended to provide for an in- crease in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the to- tal fee paid by the City for all work and services shall not exemsel the sum of $548,026,92. � ��,,f�, RKMb 3. Authorize the transfer of$123,659.30 from the Water and Sewer Fund to the Sewer Capital Project Fund; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of$123,659.30 from available funds; and 3. Authorize the City Manager to execute Amendment No. 3 to City Secretary Contract No. 27650 with Dunaway Associates, Inc. in the amount of$123,659.30 to provide additional design and survey services, thereby increasing the contract amount to $548,026.92. DISCUSSION: On April 16, 2002 (M&C C-19049), the City Council authorized the City Manager to execute a contract with Dunaway Associates, Inc. in the amount of$315,790.12 for Sanitary Sewer Rehabilitation Contract LV(55). The contract was subsequently revised by two previous amendments totaling $108,577.50. In order to alleviate numerous complaints of sewer backup by residents who are connected to several laterals and mains located in close proximity to this project, it is necessary to replace approximately 6,150 linear,feet of severely deteriorated segments of existing sewer pipe. The locations of the sewer laterals and mains to be replaced are shown on the attached drawings. The amendment will allow for the necessary design to be expedited in order to quickly address the sewer backup problems. The amendment will also allow the consultant to prepare permanent easements for some of the sewer laterals and mains to be rerouted and replaced. In addition, the consultant will provide a storm water pollution plan as now required by the Texas Commission on Environmental Quality. Dunaway Associates, Inc. proposes to provide the necessary additional design and survey services for a fee of$123,659.30. Staff considers this amount to be fair and reasonable. Dunaway Associates, Inc. is in compliance with the City's MMIBE Ordinance by committing to an additional 31% M/WBE participation on this Amendment No. 3. The City's goal on this amendment is 15%.
