AN ORDINANCE PURSUANT TO ARTICLE 46d-14
REVISED CIVIL STATUTES OF TEXAS, APPROVING
RESOLUTION NO 78-145 OF THE DALLAS-FORT
WORTH REGIONAL AIRPORT BOARD WHICH AMENDS
THE AIRPORT BUILDING CODE 1971 EDITION BY
ADOPTING CERTAIN PROVISIONS OF THE UNIFORM
BUILDING CODE, 1976 EDITION VOLUME I AS
PUBLISHED BY THE INTERNATIONAL CONFERENCE
OF BUILDING OFFICIALS DESIGNATING THE AIR-
PORT DIRECTOR OF PLANNING AND ENGINEERING
AS THE AIRPORT BUILDING OFFICIAL SETTING
SPECIFIC STANDARDS FOR THE CONSTRUCTION OF
AIRCRAFT LOADING WALKWAYS AIRCRAFT RAMP
AREAS AND AIRCRAFT FIXED FUELING SYSTEMS
REGULATING THE CEILING HEIGHTS OF CERTAIN
STRUCTURES REQUIRING FIRE-EXTINGUISHING
AND FIRE-DETECTION SYSTEMS AND APPARATUS
REQUIRING CERTAIN SPACE MEASUREMENTS AND
FACILITIES FOR THE PHYSICALLY HANDICAPPED
REQUIRING GUARDRAILS IN CERTAIN AREAS REGULA-
TING THE DESIGN LOADS FOR THE USE OF REINFORCED
CONCRETE REQUIRING THE USE OF FIRE-RETARDANT
ROOFING MATERIALS REVISING THE REQUIREMENTS
FOR AVAILABLE SQUARE FOOTAGE FOR CERTAIN 000U-
PANCIES AND THE EXIT DISTANCES FROM OCCUPIED
ROOMS REQUIRING THE USE OF DRY AND WET STAND-
PIPES FOR TALLER STRUCTURES PROVIDING THAT
SAID RESOLUTION NO 78-145 OF THE DALLAS-
FORT WORTH REGIONAL AIRPORT BOARD SHALL HAVE
THE SAME FORCE AND EFFECT WITHINiTHE BOUNDRIES
OF THE DALLAS-FORT WORTH REGIONAL AIRPORT AS
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH PROVIDING A PENALTY PROVIDING
A SEVERABILITY AND SAVINGS CLAUSE AND PROVIDING
AN EFFECTIVE DATE

WHEREAS Section 8 F of the Contract and Agreement between the
City of Dallas Texas and the City of Fort Worth Texas provides
that the Dallas-Fort Worth Regional Airport Board •shall have the
power by a duly adopted order to adopt and enforce rules and re-
gulations for the orderly safe efficent and sanitary operation of
the Airport and to prescribe reasonable penalties for the breach of
any rule or regulation not exceeding more than Two Hundred Dollars
($200 00) fine and
WHEREAS Article 46d-14 Revised Civil Statutes of Texas, and
Section 8 F of the Contract and Agreement provide that such orders
by said Airport Board shall become effective only upon approval of
the governing bodies of the Cities of Dallas and Fort Worth and.

WHEREAS pursuant to the foregoing the Dallas-Fort Worth
Regional Airport Board has passed approved and ordered Resolution
No 78-145 which amends the Airport Building Code,, 1971 Edition by
adopting certain provisions of the Uniform Building Code 1976 Edition
Volume I as published by the International Conference of Building
Officials designating the Airport Director of Planning and Engineering
as the Airport Building Official setting specific standards for the
construction of aircraft loading walkways aircraft ramp areas and
aircraft fixed fueling systems regulating the ceiling heights of
certain structures requiring fire-extinguishing and fire-detection
systems and apparatus requiring certain space measurements and facil-
ities for the physically handicapped requiring guardrails in certain
areas regulating the design loads for the use of reinforced concrete
requEiring the use of fire-retardant roofing materials revising the
requirements for available square footage for certain occupancies
and the exit distances from occupied rooms requiring the use of
dry and wet standpipes for taller structures providing that said
Resolution No 78-145 of the Dallas-Fort Worth Regional Airport Board
shall have the same force and effect within the boundaries of the
Dallas-Fort Worth Regional Airport as an Ordinance by the City Council
of the City of Fort Worth providing a Savings and Severability Clause
providing for a fine of not to exceed Two Hundred Dollars ($200 00)
for any violation thereof and providing an effective date and
WHEREAS the Airport Board has requested that the City Councils
of the Cities of Dallas and Fort Worth approve its said Resolution
No 78-145 in order that it may become effective as aforesaid and
WHEREAS the subject matter of this Ordinance and of said Resolu-
tion No 78-145 is of imperative public need and necessity in the
protection of the health safety and morals of the inhabitants users
and visitors of the Dallas-Fort Worth Regional Airport and is deemed
necessary by the Fort Worth City Council for the operation regulation

protection and policing and the management government and use
thereof and this Ordinance is an emergency measure and shall be
effective upon its adoption
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH TEXA5
SECTION 1
That all of the declarations and findings contained in the
preambles of this Ordinance are made a part hereof and shall be
fully effective as a part of the ordained subject matter of this
Ordinance
SECTION 2
That Resolution No 78-145 of the Dallas-Fort Worth Regional
Airport Board a duly certified copy of which is attached hereto
and made a part of this Ordinance by reference is hereby approved
SECTION 3
That after publication of a substantive statement relative
to the amendments to the said Airport Building Code 1971 Edition
and the penalty for the violation thereof in a newspaper of general
circulation in each of the Counties of Dallas and Tarrant stating
that a breach of any of such amendments to the said Airport Building
Code, 1971 Edition will subject the violator to the infliction of
a penalty and stating that the full text of the amendments to said
Airport Building Code 1971 Edition is on file in the principal
office of the Board where the same m'ay be read by any interested
party the said Resolution No 78-145 shall thereafter have the
same force and effect within the boundaries of the Dallas-Fort Worth
Regional Airport as an ordinance by the City Council of the City of
Fort Worth and said penalty shall be enforced in the same manner
in which penalties prescribed by other ordinances of the City of
Fort Worth are enforced
SECTION 4
That the sections paragraphs sentences, clauses and phrases

of this Ordinance and of Resolution No 78-145 are severable and
if any phrase clause sentence paragraph or section of this Ordinance
or of Resolution No 78-145 shall be declared unconstitutional by
the valid judgment or decree of any court of competent jurisdiction
such unconstitutionality shall not affect any remaining phrases,
clauses sentences paragraphs and sections of this Ordinance or
of Resolution No 78-145 since the same would have been enacted
without the incorporation in this Ordinance or in Resolution No
78-145 of any such unconstitutional phrase, clause sentence para-
graph or section
SECTION 5
That this Ordinance shall be in full force and effect from and
after the date of its passage and publication as required by law,
and it is accordingly so ordained

Consideration by the City Council is requested for the approval of Resolution
No 78-145
Recommendation
It is recommended that the City Council approve Resolution No 78-145 as adopted
by the Dallas-Fort Worth Regional Airport Board
