AN ORDINANCE AMENDING CHAPTER 19 "HEALTH AND
SANITATION" OF THE CODE OF THE CITY OF FORT
WORTH TEXAS (1964) AS AMENDED BY AMENDING
SECTION 19 -46 TO REDEFINE THE STANDARD OF
CLEANLINESS FOR FOOD HANDLERS BY AMENDING
SECTION 19 -47 TO PROVIDE FOR FOOD +HANDLERS
CERTIFICATES BY AMENDING SECTION 19 -48 TO
PROVIDE A FEE FOR THE FOOD HANDLERS COURSE
AND CERTIFICATE BY AMENDING SECTION 19 -49
TO PROVIDE FOR THE DURATION OF THE CERTI-
FICATE AND THE FEE REQUIRED ON RENEWAL
PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF ALL OTHER ORDINANCES OR
PROVISIONS OF SECTION 19 OF THE CODE OF
THE CITY OF FORT WORTH REPEALING ALL ORDI-
NANCES OR PROVISIONS OF SECTION 19 OF THE
CODE OF THE CITY OF FORT WORTH IN CONFLICT
HEREWITH PROVIDING A SEVERABILITY CLAUSE
PROVIDING A PENALTY PROVIDING FOR PUBLI-
CATION AND PROVIDING FOR AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
TEXAS
SECTION 1
That Section 19 -46 of Chapter 19 of the Code of the
City of Fort Worth Texas (1964), as amended be and the same
is hereby amended to read as follows
"Sec 19 -46 Food handlers - Cleanliness generally
"If a person who works in a food products
establishment prepares food serves food or
comes in contact with food or a foo& contact
surface while on duty the person shall
(1) Wash hands and forearms with
soap and warm water
a ) before starting work
b ) immediately after smoking
eating or drinking
c ) immediately before leaving
the toilet room and
d) as often as necessary to
maintain clean hands and
forearms
(2) not use a sink that is used for
preparing food or cleaning or
sanitizing utensils for handwashing
required by this section
(3) not touch food or a food - contact
surface with hands that are not
clean

(4) maintain a high standard of bodily
cleanliness and good hygienic
practice (including but not limited
to clean and closely trimmed finger-
nails and facial hair)
(5) wear clean outer clothing
(6) remove all insecure jewelry and
during periods when food is manipulated
by hand remove from hands any jewelry
that cannot be adequately sanitized
(7) riot use tobacco while engaging in food
preparation or service activity
(8) not use tabacco while occupying an area
that is used for food preparation or
equipment cleaning
(9) restrain his /her hair in such a manner
to minimize the risk of food contami-
nation from falling hair provided however
that every person who engages in the pre-
paration of food shall wear a hair net
A food products establishment shall enforce compliance
with this section within its operation '
SECTION 2
That Section 19 -47 of Chapter 19 of the Code of the
City of Fort Worth Texas (1964) as amended be and the same
is hereby amended to read as follows
'Sec 19 -47 Foodhandlers - Food handlers certificate
-required
"Every person who handles food in anyway
shall have in his possession at all times a
food handlers certificate issued by the director
of public health stating that such person has
satisfactorily completed a food preparation and food
handlers course prescribed by the director of
public health Food handlers certificates shall be
renewed annually No person who operates any
food establishment shall employ any person
to work in such food establishment who does
not have in his poss_ession a food handlers
certificate issued by the director of the
department of public health which certificate
has been issued within the twelve (12) months
next preceding The director of the department
of public health may cancel a food handlers cer-
tificate of any person when such person is found
to have some communicable disease or is a carrier
of such disease The director of the department
of public health may at his discretion require
the examination of any food handler at any time

SECTION 3
That Section 19 -48 of Chapter 19 of the Code of the
City of Fort Worth Texas (1964) as amended be and the same
is hereby amended to read as follows
"Sec 19 -48 Same - Fee for course and issuance of
certificate
"Every person who handles food in any way and is
required to have a food handlers certificate issued
by the director of the department of public health
shall pay to such department the sum of four
dollars ($4 00) for such course and the issuance
of such food handlers certificate '
SECTION 4
That Section 19 -49 of Chapter 19 of the Code of the
City of Fort Worth Texas (1964) as amended be and the same
is hereby amended to read as follows
"Sec 19 -49 Same - Duration of certificates fee
required on renewal
'All food handlers certificates shall be valid
for a period of twelve •(12) months from the date of
their issuance unless sooner revoked The fee of
four dollars ($4 00) as herein provided for shall
be paid upon the issuance of each new certificate
or any renewal thereof '
SECTION 5
That this ordinance shall be cumulative of all
provisions of ordinances and of
Worth Texas (1964) as amended
of this ordinance are in direct
of such ordinance and such code
provisions of such ordinances ai
repealed
the Code of the City of Fort
except where the provisions
conflict with the provisions
in which event conflicting
id such code are hereby
SECTION 6
That it is hereby declared to be the intention
of the City Council of the City of Fort Worth Texas that
the sections paragraphs sentences clauses and phrases
of this ordinance are severable and if any section paragraph
sentence clause or phrase of this ordinance shall be declared
void ineffective or unconstitutional by the valid judgment

or final decree of a court of competent jurisdiction such
voidness ineffectiveness or unconstitutionality shall not
affect any of the remaining sections paragraphs sentences
clauses or phrases of this ordinance since the same would
have been enacted by the City Council without the incorporation
herein of any such void ineffective or unconstitutional section
paragraph sentence clause or phrase
SECTION 7
That any person firm or corporation who violates
disobeys neglects or refuses to comply with or who resists
the enforcement of any of the provisions of this ordinance shall
be fined not more than Two Hundred and No /100 Dollars ($200 00)
for each offense Each day that a violation is permitted to
exist shall constitute a separate offense
SECTION 8
The City Secretary of the City of Fort Worth Texas
is hereby directed to publish the caption and penalty clause
and effective date of this ordinance for five (5) days in the
official newspaper of the City of Fort Worth Texas as
authorized by the TEX REV CIV STATS Art 1176b -1
SECTION 9
This ordinance shall be in full force and effect
from and after the date of passage and publication as above
specif ied

Under Chapter 19 Sections 19 -46 through 19 -49 of the Code of the City of
Fort Worth, the Department of Public Health conducts a Health Card Program for
all employees of wholesale and retail food establishments The current program
requires a chest x -ray and a blood test for ea.h applicant The objective of
this program is prevention of the transmission of food borne diseases to the
consuming public, but such testing does not accomplish this objective In
addition, it is now considered good medical practice to limit the use of x -ray
exposure as much as possible and generally to discourage mass "routine" screening
type exams in the general population.
In an effort to aid in the prevention cf food borne diseases, it is proposed
that a comprehensive Food Handler's Certification Program be implemented beginnin
October 1, 1980 The major emphasis of this program. would be education to
provide instructions for all applicants in the proper techniques of the prepara-
tion, service, and storage of wholesome food and the necessity for strict
personal hygiene
Public Health Department officials attended two meetings of the local restaurant
association to advise them of the proposed program changes
The proposed Food Handler's Certification Program woL.1d necessitate revision of
the present Health Card ordinance and the following is a summary of the major
code revisions
Section 19 -46, Code of the City of Fort Worth
"Food Handlers - Cleanliness generally ", is amended by requiring that
employees shall wear a hair restrainer (as illustrated by, but not
limited to a hat hair net or hair spray) or wear hair in a style
that prevents falling hair
Section 19 -47 Code of the City of Fort Wor.h
"Food handlers certificate required" is amended by requiring all food
handlers to be certified by Lomplet.ion cf a foYd handlers course

shall be renewed annually
