ORDINANCE .NO ~/ ~~ AN ORDINANCE AMENDING CHAPTER 16 GARBAGE " OF THE CODE OF THE CITY OF FORT WORTH (1964) AS AMENDED, WHICH CHAPTER RE GULATES SOLID WASTE COLLECTION FEES AND DISPOSAL BY AMENDING SEC- TION 16-10 BY INCREASING THE PRESCRIBED UNIFORM FEES FOR RESIDENTIAL REFUSE COLLECTION BY AMENDING SECTION 16-11 BY INCREASING THE PRESCRIBED UNIFORM FEES FOR COMMERCIAL REFUSE COLLECTION AND BY AMENDING SUBSECTION (a) OF SECTION 16-19, BY INCREASING THE FEE PERTAINING TO REFUSE CONTAINER VEHICLES PROVIDI~IVG THAT THIS ORDINANCE SHALL BE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL CONFLICTING ORDINANCES PROVIDING A SAVINGS CLAUSE PROVIDING A SEVERABILITY CLAUSE PROVIDING A PENALTY AND NAMING AN EFFECTIVE DATE BE IT ORDAINED OR ENACTED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH SECTION 1 That Section 16-10 of Chapter 16 of the Code of the City of Fort Worth (1964) as amended be and the same is hereby amended to read as follows Sec 16-10 Charges for refuse removal service - compulsory for single family residences and duplexes optional for group housing Use of city garbage and refuse collection and brush removal service and payment of the fees set out below for such service shall be mandatory for single family residences each unit of duplex apart- ment buildings garage apartments and mobile homes or trailers occupied as dwelling units The monthly fees for household garbage and, refuse collection and brush removal service shall be as follows Type Single-family residences Duplex apartments (per dwelling unit) Garage apartment unit trailer/mobile home dwelling unit Curb/Alley Line Service $3 50 per mo $ 3 5 0 pe r mo (per dwelling Unit) $3 50 per mo $3 50 per mo Collector Carryout J;~. $10 0.0----- per mo $10.,.00 ,,f per mo ( per f~ P~lwelling Unit) i, $10~ 00 _, j per mo $10° 00 per mo ~~ Type Residential building or complexes etc Curb/Alley Line Service $3 50 per mo (per dwelling unit ) Collector -~- Carryout Service / tJ ~? $10-~00~ per mo (per dwelling unit) The use of city garbage and refuse collection and brush removal shall be optional for residential buildings or complexes which include three (3) or more dwelling units SECTION 2 That Section 16-11 of Chapter 16 of the Code of the City of Fort Worth (1964) as amended be and the same is hereby amended to read as follows Sec 16-11 Same-Business and commercial buildings and premises Charges for refuse collection from houses buildings and premises used for commercial business and other non- residential purposes shall be based on a minimum service charge for one standard refuse receptacle or container and an additional charge for the number of addi- tional containers used as set forth in the schedule below -2- SECTION 3 That subsection (a) of Section 16-19 of the Code of the City of Fort Worth (1964) as amended, be and the same is hereby amended so that hereafter same shall be and read as follows (a) Persons disposing of refuse at any City operated disposal site incinerator dump or sani- tary landfill including persons holding a valid permit for private collection and disposal of refuse shall pay a dumping fee for each and every load of refuse dumped or deposited in accordance with the schedule for charges set out below These charges shall not be applied to loads of refuse collected by... the Texas Highway Department from.~rights-of-way of public streets and highways nor to disposal of refuse resulting from the activites of any depart- ment of the City government Type of Vehicle Fee Passenger automobiles and No charge station wagons All other vehicles and refuse $16 00 per ton containers (nearest 1/4 ton) of refuse Earth rocks .and inert material No charge suitable for cover of refuse (The acceptability of such may terial shall be determined by the Sanitation Superintendent or his authorized representative and shall be delivered to sites designated by him) SECTION 4 That this ordinance shall be cumulative of all provisions of the Code of the City of Fort Worth (1964) as amended, and all other ordinances of the City of Fort Worth except in those instances where the provisions of this ordinance are in direct conflict with the provisions of such Code or other ordinances in which instances said conflicting provisions of such Code or other ordinances are hereby repealed SECTION `5 It is hereby declared to be the intention of the City Council that the sections paragraphs sentences clauses and phrases of this ordinance are severable and if any phrase clause sentence paragraph -7- or section of this ordinance shall be declared void ineffective or unconstitutional by the valid judgment or decree of any court of ~com- patent jurisdiction such voidness ineffectiveness or unconstitutiona- lity shall not affect any of the remaining phrases clauses sentences paragraphs and sections of this ordinance since the. same would have been enacted by the City Council without the incorporation in this ordinance of any such void ineffective or unconstitutional phrase clause sentence paragraph or section SECTION 6 That all rights or remedies of the City of Fort Worth Texas are expressly saved as to any and all violations of the provisions of Chapter 16 of the Code of the City of Fort Worth (1964) as amended and of any other ordinance affecting garbage which have accrued at the time of the effective date of this ordinance and as to such accrued violations and all pending litigation both civil and criminal whether pending in court or not under such chapter and/or other ordinances same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts SECTION 7 That any person firm or corporation violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction shall. be subject to a fine not to exceed Two Hundred Dollars ($200 00) and each violation hereof and each day on which there is a failure to comply with the terms of this ordinance shall be and is hereby declared to be a distinct and separate offense and punishable as such SECTION 8 That this ordinance shall become effective and be in full force and effect from and after its passage and publication as re- quired by law provided however that the increased rates specified herein shall become effective with the customer utility statements sent by the City of Fort Worth after October 1 1980 and it is so ordained _g- APPROVED AS TO FORM AND LEGALITY City Attorne ADOPTED ~~ EFFECTIVE -9- r f.+. ~ N rt ~ ~, ~ ~ • n~ ~~ O m ~ rn ~ o ~ ~ ~ ~ ° ~c , o ~ ~ ~ ~ ~ ~ ~ n m ~ v ~ m m n ~ ~ cn o ~n o~ o v N ,p N ~ U1 O O O lD In .p V N ~ O O O N v ,p w oo u, © O O .P O .P lD .P cn O O O F-' N V W .P cn o to 0 0 0 N F-' O Cn ,p r rn cn 0 0 0 N ~-+ N O .A V N ~ O O O N N tin O .P w ao cn 0 0 0 N N ~1 W .P ~ ~ ~ 0 0 0 ~~ C cD n n ~w rt m a m ~ ~ ~ n O ~+, 3" ~ y .-.
