ORDINANCE NO
AN ORDINANCE VACATING ABANDONING AND CLOSING
THE ALLEY A 5 FOOT WIDE DRAINAGE EASEMENT
EXTENDING A DISTANCE OF APPROXIMATELY 400 FEET
FROM TRAVIS AVENUE ACROSS LOTS 10 11 12 15
16 and 26R TO HEMPHILL STREET AND A 5 FOOT
WIDE UTILITY EASEMENT EXTENDING A DISTANCE OF
APPROXIMATELY 220 FEET FROM THE ALLEY ACROSS
LOTS 13 14 AND 15 TO HEMPHILL STREET ALL IN
BLOCK 37 SOUTH HEMPHILL HEIGHTS ADDITION
PROVIDING FOR THE REVERSION OF FEE IN SAID LAND
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH
AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS
SECTION 1
That the alley in Block 37 South Hemphill Heights Addition
a width of 20 feet from the south right-of-way line of West Berry
Street to the north right-of-way line of West Devitt Street the
five foot wide drainage (storm sewer) easement from the east right-
of-way line of Travis Avenue to the west right-of-way of Hemphill
Street more particularly described with reference to the Center
Line thereof as follows
Being a 5 foot strip of land in Block 37
crossing Lots 12 11 10 15 16 and 26R

37 SOUTH HEMPHILL HEIGHTS ADDITION re-
corded in Book 106 Page 132 Deed Records
and REVISED SOUTH HEMPHILL HEIGHTS ADDITION
recorded in Book 388-47 Page 520 Deed
Records out of the LYDIA J WARWICH SURVEY
Abstract No 1663 in the City of Fort Worth
Tarrant County Texas and being more par-
ticularly described as follows
BEGINNING at the intersection of the East
ROW line of Travis Avenue (an 80 Foot ROW)
and the North ROW line of Devitt Street
(a 60 Foot ROW)
THENCE in a Northeasterly direction along
the Center Line of an existing 48' storm
drain to a point for angle
THENCE in a Northeasterly direction along
the Center Line of an existing 48 storm
drain to a point for corner in the West ROW
line of Hemphill Street (an 80 Foot ROW)
and the five foot wide utility easement extending a distance of
approximately 220 feet from the alley hereinabove described and
vacated in Block 37 across Lots 13 14 and 15 to the west right-of-
way line of Hemphill Street being more particularly described as
follows
BEING the Center Line description of a
5 foot strip of land in Block 37 crossing
Lots 14 and 15 of the REVISION OF LOTS 9
THRU 16 BLOCK 37 SOUTH HEMPHILL HEIGHTS
ADDITION recorded in Book 106 Page 132

SURVEY Abstract No 1663 in the City of
Fort Worth Tarrant County Texas and being
more particularly described as follows
BEGINNING at a point in the North ROW line
of Devitt Street (a 60 Foot ROW) said point
being in the Center Line of a 20 foot alley
THENCE North 45 00 feet along the Center
Line of said 20 foot alley to a point for
angle
THENCE in a Northeasterly direction along
the Center Line of an existing sanitary
sewer line to a point in the West ROW line
of Hemphill Street (an 80 Foot ROW) to the
end of said easement
be and the same are hereby vacated abandoned and closed as an
alley and rights-of-way
SECTION 2
That the fee to the land in the above described alley
and rights-of-way are hereby released and shall revert to the
adjacent owners as provided by law
SECTION 3
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed
SECT ION 4
That this ordinance shall take effect and be in full
force and effect from and after the date of its passage and it is
so ordained

requested that the City vacate the 20' wide alley from West Berry Street south
to West Devitt Street as shown on the attached map (V-79-27) a 5' wide drainag
(storm sewer) easement extending a distance of approximately. 4,00' from Travis
Avenue across Lots 10, 11 12 15 16 and 26R to Heinphil.l Street and a 5' wide
utility (sanitary sewer) easement extending a distance of approximately 220'
from the alley in Block 37 across Lots 13 14 and 15 to Hemphill Street as sho
on the attached map (V-79-52) and as described in the attached metes and bounds
description

The subject alley acquired by dedication, is open paved and in use Both
easements have been in use with. utilities in plaee .However all utility faci-
lities in the alley and both easements have been abandoned or relocated
Reviewing City departments and private ut~li.ty companies have raised no objec-
tions to this request,provided the vacated right-of-way is repoaated with
abutting property A satisfactory replat has been submitted
The. City Plan Commission has reviewed this request an,d recommends that the
subject right-of-way and easements be vacated
Recommendation
It is recommended that an ordinance be adopted vacating. the subject right-of-way
and easements
