HomeMy WebLinkAboutOrdinance 8088•. `~. ~; ORDINANCE NO ~ ~ lJ O AN ORDINANCE Al~iENDING SECTION 3 07 AND SECTION 4 Ol(f) OF APPENDIX G SIGN CODE OF THE CODE OF THE CITY OF FORT WORZ°H (1964) AS AMENDED PROVIDING AN EXCEPTION FOR A NONELECTRICAL SIGN AND PROVIDIi~G 'r'OR ALLOWABLE STRESSES RESPECTIVELY PROVIDING A SEVERABILITY CLAUSE PROVIDING THAT T~'rIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES AND CODE PRO- VISIONS NOT INCONSISTENT tivYITH THIS ORDINANCE PRO- VIDING A PENAL CLAUSE AND NAMING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT rnTORTH TEXAS SECTION 1 That Section 3 07 of Appendix G Sign Code of the Code of the City of Fort Worth (1964) as amended is hereby amended and being so amended the same shall hereafter be and read as follows Section 3 07 No person shall be issued such sign permit for work concerning a non-electrical sign unless such person is a licensed and bonded sign erector pursuant. to the provisions of Chapter 8 of this code Exception An owner may install a non- electric sign on his own property without meeting the requirements of Chapter 8 pro- vided that 1 The non-electric sign is no more than seven (7) feet to the highest point above grade when mounted upon or in the ground or 2 The nonelectric sign containing no more than a 3/4 thi:~k display panel may be mounted flat against a build- ing provided any trim or portion of the sign does not project more than 4 from the building and provided further that the sign shall be no larger than 32 square feet and 3 Such signs shall meet the require- ments for zoning and structural design No person shall be issued a sign permit for work concerning an electrical sign unless such person is licensed and bonded, pursuant to the provisions of Chapter 10 of the Electrical Code of the City of Fort Worth ., R. BF,CT36~N 2 What Section ~ O1(f) of Appendix G sign Code of the Code of the City of Fort Worth (1964) as amended, is hereby amended and being so amended the same shall hereafter be and read as follows f) ALLOWABLE ST~2E~SES The design of wood, concrete or steel and iron members shall conform respec- tively to the requirements of Chapters 23 25 26 and 27 of the Building Code Loads both vertical and horizontal exerted on the soil shall not pro- duce stresses exceeding those specified in the Building Code The working stresses of wire ropes and fastenings shall not exceed 25 per cent of the ultimate strength of such ropes or fastenings The figures given are recommended as minimum These requirements do not provide for tornadic type winds Working stresses for windloads combined with dead- loads may be increased as specified in the Building Code 3E°CT~ON 3 That it is hereby declared to be the intention of the City Council that the sections paragraphs sentences, clauses and the phrases of this ordinance are severable and if any phrase clause sentence paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any Court of competent jurisdiction such unconstitutionality shall not affect any of the remaining phrases clauses sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase clause sentence paragraph or section BECTION 4 That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth (1964) as amended except where the provisions of this ordinance are in - 2 - ~' ~~; ,. i direct conflict with the provisions of such ordinances and such Code in which event conflicting provisions of such ordinances and such Code are hereby repealed SECTI®N 5 That any person violating any of the provisions of this ordi- nance shall be deemed guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each day or portion thereof during which any violation of any of the provisions of this ordinance is committed continued or permitted a nd each violation shall be punishable by a fine not exceeding Two Hundred Dollars ($2flfl flG) SECTION 6 That the City Secretary of the City of Fort Worth is hereby directed to publish the caption~~nd penalty clause and effective date of this ordinance for five (5) days in the official newspaper of the City of Fort Worth, as authorized by Article 1176b-1 TEXAS REVISED CIVIL STATUTES SEC^lIQN 7 That the City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the cap° tion and penalty clause of same in the minutes of the City Council of Fort Worth and by filing the ordinance in the ordinance records of said City SEC~1'I®N 8 That this ordinance shall be in full force and effect from and after the date of passage and publication as above specified APPROVED AS TO F®R~ AND LEGALITY r C'ty Atto e v ADOPTED ~~ ~ I y 8 EF~vcTIVE ~, y~: / ~'-~` V '~~~ • r~ r~ City of Fort worth, `I~exces mayor and ~o~,cn~~,l ~~m.na.~,s,na~a~~,on DATE REFERENCE SUBJECT Ordinance Amending SeCtlOT1S PAGE NUMBER 3 07 and 4 0(f) of Appendix G "Sign 1 5/1/80 G-4517 Code" iot At the request of a citizen Mr Cliff Lindsay the Building Code Board of Appeals has reviewed proposed amendments (see attachment) to the sign ordinance that would permit property owners to install business signs upon their property witho ut those owners having to be licensed sign erectors The amendments will apply only to non-electrical signs and would limit the height and size of s uch signs in order that they not become structural problems The Buildi ng Code.
