AN ORDINANCE AMENDING SECTION 1704 OF CHAPTER 17
ROOFS OF THE UNIFORM BUILDING CODE OF 1973 ALSO
KNOWN AS THE BUILDING CODE OF THE CITY OF FORT
WORTH AS HERETOFORE AMENDED PROVIDING FOR A
SEVERABILITY CLAUSE PROVIDING THAT THiS ORDINANCE
SHALL BE CUMULATIVE OF ALL ORDINANCES AND CODE
PROVISIONS NOT INCONSISTENT WITH TINS ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH TEXAS
SECTION 1
That Section 1704 of Chapter 17 ROOFS of the Uniform
Building Code of 1973 also known as the Building Code of
the City of Fort Worth as heretofore amended is hereby
amended to read as follows
Sec. 1704
Fire retardant Class C roof coverings are required
on all multi-family and townhouse units regardless
of the size and height of tYie units Fire retardant
Class C roofing materials are defined as any roofing
material which meets ASTM E-10$ Fire 'Pest Specifica-
tions for roofing and has been tested and approved
by a nationally recognized testing laboratory
In those cases where it proves necessary to replace
all or part .of an ordinary wood shingle roof Class C
composition shingles may be overlaid on the wood '
shingles
Skylights shall be constructed as required in
Chapter 34
Penthouses shall be constructed `required in
Chapter 36
For use of plastics in roofs see `Chapter 52
For attics access and area see Section 3205
For Roof Drainage see Chapter 3207
SECTION 2
That it is hereby declared to be the intention of the
City Council that the sections paragraphs sentences clauses
and the phrases of this ordinance are severable and if any

phrase clause sentence paragraph or section of this ordi-
nance shall be declared unconstitutional by the valid judgment
or decree of any Court of competent jurisdiction such uncon-
stitutionality shall not affect any of the remaining phrases
clauses sentences paragraphs and sections of this ordinance
since the same would have been enacted by the City Council
without the incorporation in this ordinance of any such un-
constitutional phrase clause sentence paragraph or section
SECTION 3
That this ordinance shall be cumulative of all provisions
of ordinances and of the Code of the City of Fort Worth (1564)
as amended except where the provisions of this ordinance are
in direct conflict with the provisions of such ordinances and
such Code in which event conflicting provisions of such ordi-
nances and such Cade are hereby repealed
SECTION 4
That any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and each
such person shall be deemed guilty of a separate offense for
each day or portion thereof during which any violation of any
of the provisions of this ordinance is committed continued
or permitted and each violation shall be punishable by a
fine not exceeding Two Hundred Dollars ($200 00)
SECTION 5
That the City Secretary of the City of Fort Worth is
hereby directed to publish the caption and penalty clause and
effective date of this ordinance for five (5) daysin the of-
ficial newspaper of the City of Fart Worth as authorized, by
Article 1176b-1 TEXAS REVISED CIVIL STATUTES

SECTION 6
That the City Secretary of the City of Fort Worth is
hereby directed to engross and enroll this ordinance by copy-
ing the caption and penalty clause of ame in the minutes of
the City Council of Fort Worth and by filing the ordinance
in the ordinance records of said City
SECTION 7
That this ordinance shall be in fu].1 force and effect
from and after the date of passage and publication as above
specified

The attached proposed amendment to the Uniform Building Code Ordinance No 7337
will require Class C roof covering on apartments and townhouses to be constructed
in the City of Fort Worth in the future This amendment has been recommenti-ez3~`
by -the Building Code Committee and the Fire_Code Subcommittee of the North
Central Texas Council of Governments The two committees, comprised of Building
Off°c'.~ls and Fire Marshals in the Metroplex, met jointly to formulate the recom-

The c®mmittees studied statistics on fires across the United States and unani-
mously agreed that the wood shingle fire problem caused by "flame' brands of
shingles was not a life hazard problem but a pr-oblem involving property loss
Property loss during the recent hail storm to roofs of "flaming' brand shingles
was estimated at $40 million considerably more than the damage to roofs with
"fire brand shingles
The committees determined that the major losses were in apartment and townhouse
construction and therefore, recommend the proposed amendment. to the Fort Worth
Uniform Building Code
This proposal was reviewed by the Regional Codes Coordination Committee and
recommended to the North Central Texas Council of Governments Board of Directors
The Board approved the recommendation and forwarded it to Metroplex cities
The Building Official and the Fire Marshal from Fort Worth served on both the
joint committee and Regional Codes Coordination Committee and both officials
support the proposed -amendment
Recommendation
It is recommended that the City Council approve the adoption of the proposed
amendment to the Uniform Building Code Ordinance No 7337 which will require
Class C roof covering on apartments and townhouses
