HomeMy WebLinkAboutOrdinance 8098~r ~.. .. .~., ORDINANCE NO D ~ AN ORDINANCE AMENDING CHAPTER 16 OF THE FORT WORTH CITY CODE (1964) AS AMENDED WHICH CHAPTER REGULATES SOLID WASTE COLLECTION FEES AND DISPOSAL BY AMEND- ING SUBSECTION (a) OF SECTION 16-19 DUMPING FEES BY INCREASING THE FEE PERTAINING TO REFUSE CONTAINER VEHICLES MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL CONFLICTING ORDINANCES PROVIDING A SEVERABILITY CLAUSE PROVIDING A PENALTY AND NAMING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That subsection (a) of Section 16-19 of the Code of the City of Fort Worth (1964) as amended be and the same is hereby amended so that hereafter same shall be and read as follows "(a) Persons disposing of refuse at any City operated disposal site incinerator dump or sani- tary landfill, including persons holding a valid permit for private collection and disposal of refuse shall pay a dumping fee for each-and every load of refuse dumped or deposited in accordance with the schedule of charges set out below These charges shall not be applied to loads of refuse collected by the Texas Highway Department from rights-of~way of public streets and highways nor to disposal of refuse resulting from the activities of any depart- ment of the City government T~rpe of Vehicle Fee Passenger automobiles and No charge station wagons All other vehicles and refuse $10 00 per ton containers (nearest 1/4 ton) of refuse Earth rocks and inert material No charge suitable for cover of refuse (The acceptability of such ma- terial shall be determined by the Sanitation Superintendent or his authorized representative and shall be delivered to sits~s-~ designated by him ) ~,~ ~,, :~ ry T 4~A A SECTION 2 That this ordinance shall be cumulative of all provisions of the Code of the City of Fort Worth (19b4) as amended and all other ordinances of the City of Fort Worth. except in those instances where the provisions of this ordinance are in direct conflict with the provisions of such Code or other ordinances in which instances said conflicting provisions of such Code or other ordinances are hereby repealed SECTIOIQ 3 It is hereby declared to be the intention of the City Council that the sections paragraphs sentences clauses and phrases of this ordinance are severable, and if any phrase clause sentence paragraph or section of this ordinance shall be declared unconsti- tutional by the valid judgment or decree of any court of competent jurisdiction such unconstitutionality shall not affect any of the remaining phrases clauses sentences paragraphs and sections of this ordinance since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase clause sentence paragraph or section SECTION 4 That any person firm or corporation violating any provision of this Ordinance shall be guilty of a misdemeanor and upon con- viction shall be subject to a fine not to exceed Two Hundred Dollars ($200 00) SECTION 5 That the new rates established by this ordinance shall become effective and be in full force and effect from and after July 1 1980 following passage and publication as required by law and it is so ordained A L VEDA TO FORM D LEGALITY -~ % ity Attorney ADOPTED ~ ~ ~ ~ / ~ b'~ EFFECTIVE July 1, 1980 Mayer and ~ou~a,~~l ~~~s,~,~,s,n~~ataon DATE REFERENCE SUBJECT Proposed Increase in the Tipping PAGE NUMBER F°ee at Sanitary Landfills 5/27/80 G-4556 1 af--1- The 1979-80 Budget increased the charges to private haulers for the disposal of mixed municipal refuse and commercial and industrial wastes at the City's sani- tary landfills from $4 to $8 per ton effective October 1 1979 The purpose of the fee increase was to limit the amount of intake in an effort to extnnd the life of the landfills The amount of waste deposited at City landfills by private haulers had declined ~by approximately 34% since October 1 but is now gradually increasing These i~.creases might be attributed to increased rates at privately-owned landfills and increased fuel costs that encourage the use of the nearest disposal facility It is anticipated that by October- 1 1980 the tonnage deposited by private haulers may equal that experienced before the rate increase Therefore it is proposed that tine tipping fee be increased from $8 per t®n to $10 per ton effective July 1 1980 Charges are levied by the quarter ton the minimum charge will be $2 50 Recommendation It is recommended that 1 An ordinance be adopted establishing the fee for the disposal of mixed muni- cipal refuse and industrial and commercial wastes at the City's sanitary landfills by commercial and private vehicles except private automobiles at $10 per ton and 2 The new rate become effective July 1 1980 VS pig APPROVED BY ' CITY COUNCIL MAY 27 190 ~~ ~eawctarr a t C ~!
