ORDINANCE NO. ~ I ~~
AN ORDINANCE DISCONTINUING TERRITORY FROM
WITHIN ;. THE CORPORATE LIMITS OF THE CITY OF
FORT WORTH, TEXAS; RELEASING TERRITORY FROM
THE EXTRATERRITORIAL 3URISDICTION OF THE CITY
OF FORT WORTH; CONSENTING TO THE .ANNEXATION
OF SAID TERRITORY BY THE CITY OF WESTOVER
HILLS, TEXAS; PROVIDING THAT THIS ORDINANCE
SHALL AMEND EVERY PRIOR ORDINANCE IN DIRECT
CONFLICT; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE; PROVIDING FOR SEVERABIL-
ITY AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1
That the hereinafter described territory within the corporate limits of the
City of Fort Worth be and the same is hereby discontinued as a part of the City
of Fort Worth; said territory being
All that portion of Westover Road which adjoins Lot 3 and portion of
Lot 4 along their west line, all situated in the City of Fort Worth in
Tarrant County, Texas;
BEGINNING at the southeast corner of said Lot 3 in the north line of
Byers Avenue and the west line of Block 1 of Highland Park Town-
homes, asubdivision in the said City of Fort Worth as said Block
appears upon the map recorded in volume 388-118, page 84 of the
Tarrant County Deed Records and from said beginning corner the
southwest corner of said Block 1 of Highland Park Townhomes bears
south no degrees -34 minutes -52 seconds west 10 feet;
THENCE west, along the said north line of Byers Avenue, 116 feet to
the south terminus of a curve in the west line of said Westover Road;
THENCE northerly, along the said west line of Westover Road along a
curve to the left with a radius of 22-76/100 feet a distance of 45-
25/100 feet to its end; the chord of said 45-25/100 feet arc is north
33 degrees -02 minutes east 38-16/100 feet;
THENCE north 23 degrees -56 minutes west, continuing along the
west line of said Westover Road, 103-50/100 feet to the beginning of
a curve to the left with a radius of 304-8/10 feet;
THENCE along said curve to the left continuing along said west line
of Westover Road, 121-45/100 feet to the line of City Limits between
the City of Fort Worth and The Village of Westover Hills;
THENCE east, along said line of City Limits crossing said Westover
Road into said Lot 4 of Fort Worth Country Club Addition, 121-
07/100 feet to the easterly right-of-way line of Westover Road;
THENCE southerly, along and with the easterly right-of-way line of
Westover Road to the place of beginning and containing 0 302 acres
more or less.
SECTION 2.
THAT the above described territory is .shown on Exhibit A which is at-
tached hereto and expressly incorporated herein by reference for the purpose of
illustrating and depicting the locations of the hereinabove described territory

SECTION 3.
THAT the City of Fort Worth hereby relinquishes to the Town of Westover
Hills all extraterritorial jurisdictional rights over the hereinabove described
territory, under the provisions of the Texas Municipal Annexation Act (Article
970a, Revised Civil Statutes of Texas, as amended).
SECTION 4.
THAT the City of Fort Worth hereby consents to the annexation of the
hereinabove described territory by the Town of Westover Hills.
SECTION 5
THAT thereafter the common boundary line between the Cities of Fort
Worth and Westover Hills shall be:
BEGINNING at a point for corner in the old common boundary line
between the Cities of Fort Worth and Westover Hills and the easterly
right-of-way line of Westover Road;
THENCE southerly, along and with the easterly right-of-way line of
Westover Road to a point for corner in the north right-of-way line of
Byers Avenue and the southeast corner of Lot 3;
THENCE west, along the said north right-of-way line of Byers
Avenue, 116 feet to the south terminus of a curve in the west right-
of-way line of said Westover Road;
THENCE northerly, along the said west right-of-way line of Westover
Road, along a curve to the left with a radius of 22-76/100 feet, a
distance of 45-25/100 feet to its end; the chord of said 45-25/100 feet
are is north 33 degrees -02 minutes east 38-16/100 feet;
THENCE north 23 degrees -56 minutes west, continuing along the
west line of said Westover Road, 103-50/100 feet to the beginning of
a curve to the left with a radius of 304-8/10 feet;
THENCE along said curve to the left continuing along said west line
of Westover Road, 121-45/100 feet to the line of City Limits between
the City of Fort Worth and The Village of Westover Hills.
SECTION 6.
THAT this ordinance shall and does amend every prior ordinance in conflict
herewith, but as to all other ordinances or sections of ordinances not in direct
conflict, this ordinance shall be, and the same is hereby made cumulative.
SECTION 7
THAT it is hereby declared to be the intent of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance are sever-
able, and if any phrase, clause, sentence, paragraph or section of this ordinance
shall be declared unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this ordinance,

since the same would have been enacted by the City Council without the in-
corporation in this ordinance of any such unconstitutional phrase, clause, sen-
tence, paragraph or section.
SECTION 8.
THAT this ordinance shall take effect and be in full force and effect from
and after its passage, and it is so ordained.

The Town of Westover Hills has requested that Fort Worth deannex 0 302 acres or
13 171 square feet in Westover Drive immediately north of Byers Avenue This
public street is now subject to maintenance by the City of Fort Worth
Westover Hills requests annexation of this portion of We toner Drive so that all
of Westover Drive will be within the corporate limits of Westover Hills and to
bring its city limits line to a point adjacent and parallel to Byers Avenue
City departments have reviewed this request and ra ised no objection to deannex-
ing this property Also no City facilities will be impacted by approval of this
request (See attached map and report%

On August 27 1980 the Plan Commission recommended approval of the deannexation
of Westover Drive
Recommendation
It is recommended that the City Council adopt th e ordinance deannexing 0 302
acres .from the City of Fort Worth to be annexed by the Town of Westover Hills
