AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF A
FOREST AVENUE, LOCATED BETWEEN EAST LANCASTER AVENUE
AND HART STREET, ADJACENT TO BLOCKS 4 AND 5 OF ORIGINAL
TOWN OF HANDLEY A IN THE CITY OF FORT WORTH AS
RECORDED IN VOLUME 40, PAGE 51 OF THE DEED RECORDS OF
TARRANT COUNTY, TEXAS, AND CONTAINING APPROXIMATELY
10,500 SQUARE FEET OF LAND MORE OR LESS, PROVIDING FOR
REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS, REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That a portion of Forest Avenue, between Hart Street and East Lancaster Avenue,
adjacent to Blocks 4 and 5 of Original Town of Handley m the City of Fort Worth as recorded in
Volume 40 Page 51 of the Deed Records of Tarrant County Texas, and containing
approximately 10,500 square feet of land more or less, and as more specifically described in
Exhibits A and `B attached hereto and incorporated herein by reference be and the same is
vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located m that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

DESCRIPTION OF PROPOSED STREET VACATION PARCEL
SITUATED in the City of Fort Worth, Tarrant County Texas, and being a portion of Forest Avenue (originally
80 feet wide right-of-wpy called Daggett Street) as shown on plat of Handley (original town), as shown
on plat thereof recorded in Volume 40, Page 51 of the Tarrant County Deed Records, and said portion
being more fully described as follows:
BEGINNING at the southwest corner of Lot 8-R, 81ock 5, Original Town of Handley as shown on plat
thereof recorded in Volume 388-103, Page 410, of the Tarrant County Plat Records, said point being the
point of intersection. of the east Ilne of said Forest Avenue with the present north Ilne of Hart Street
(presently b0 feet wide at this point originally 100 feet wide right-of-way called Main Street), from which
point an "RPLS 1640" capped 5/8 iron rod set for the southeast corner of Lot 5-1~, in said Block 5 bears
South 75 degrees, 04 minutes, 15 seconds East 200.0 feet
THENCE North 75 degrees, 04 minutes, 15 seconds West with said present north line of Hart Street
crossing said Forest Avenue, 60.0 feet to the southeast corner of lot 1-R-A, Block 4, said Original Town of
Handley as shown on said plat recorded in Volume 388-103, Page 410, at the point of intersection of
said north line of Hart Street with the present west line of Bald Forest Avenue, and from which point an
RPLS 1640" capped 5/8 iron rod set for the southwest corner of Lot 11-R, in said Block 4, as shown on
said plat In Volume 388-103, Page 410 bears North 75 degrees, 04 minutes, 15 seconds West 332.0 feet;
THENCE North 14 degrees, 53 minutes, 25 seconds East with the east line of said Lot 1-R-A, and said
present west line of Forest Avenue, 135.0 feet to the northeast corner of said Lot 1-R-A, at the point of
intersection of said present west line with the south line of Block A, of said Handley (original town);
THENCE North 75 degrees, 04 minutes, 15 seconds West with the north line of said Lot 1-R-A and said
south line of Block A, in the original sight-of-way of Forest Avenue, 20.0 feet to the original common east
corners of said Blocks 4 and A, and the southeast corner of that certain portion of said 81ock A
conveyed to Youghal Corporation as Parcel V in deed recorded under Tarrant County Clerk's File No
D202005310;
THENCE North 14 degrees, 53 minutes, 25 seconds East (base bearing from said Youghal deed) with the
east line of said Youghal Corporation Parcel V and the original east Ilne of said Block A and west line of
Forest Avenue, 30.1 1 feet to the northeast corner of said Parcel V from which point an Area Surveying
capped'h iron rod bears North 5 degrees West 0.37 foot
THENCE South 74 degrees, 56 minutes, 05 seconds East, crossing said Forest Avenue and generally 50
feet southerly from and parallel with the main track of the Union Pacific Railroad (formerly Texas and
Pacific Railway), 80 0 feet to the northwest corner of Parcel IV of said Youghal Corporation deed In the
east line of said Forest Avenue and west line of Block B, of said Handley (original town),
THENCE South 14 degrees, 53 minutes, 25 seconds West with the west line of said Youghal Corporation
Parcel iV and said east line of Forest Avenue and west line of Block B, at 29 92 feet passing the
northwest corner of said Lot 8-R Block 5, and continuing with Bald east line of Forest Avenue and the
west Ilne of said Lot 8-R, in all 164 92 feet to the PLACE OF BEGINNING, and containing 10,500 square
feet (0.241 acre)

RECOMMENDATION
It is recommended that the City Council
1 Adopt an ordinance vacating a portion of Forest Avenue between East Lancaster Avenue and Hart
Street located adjacent to Blocks 4 and 5 Original Town of Handley and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G-
15624)
DISCUSSION
Gerry Curtis and Associates on behalf of Youghal Corporation has requested the vacation of the above
referenced street to replat the right-of-vvay with the adjoining property to expand the existing building
footprint. The City Plan Commission recommended approval of this request at its meeting on September
23 2009 An acceptable replat (FS-009-120) has been received Any existing utilities will be relocated at
the applicant's expense or retained within a designated easement, along with an appropriate plat note
that no permanent structures may be constructed or placed thereon
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process The City does not own land under or adjacent to the above referenced street. Since no City funds
have been expended to purchase property or easement rights, collection of the fair market value or any
portion thereof is recommended by staff to be waived
This land is located in COUNCIL DISTRICT 5
