AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE STORMWATER UTILITY FUND IN THE AMOUNT OF $1 000 000 00 AND
DECREASING THE UNRESERVED UNDESIGNATED FUND BALANCE, FOR THE
PURPOSE OF TRANSFERRING SAID FUNDS TO THE STORM WATER CAPITAL
PROJECTS FUND• PROVIDING FORA SEVERABILITY CLAUSE, MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the
Budget of the City Manager there shall also be increased estimated receipts and appropriations in the
Stormwater Utility Fund by $1 000 000 00 and decreasing the unreserved undesignated fund balance by
the same amount for the purpose of transferring said funds to the Storm Water Capital Projects fund
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void
for any reason' by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption

SUBJECT
Authorize the Execution of the Second Renewal of City Secretary Contract No 38360 in an Amount Up to
$1 000 000 00 with Tri Tech Construction Inc. for the Miscellaneous Storm Drain Improvements Contract
and Adopt Appropriation Ordinances (ALL COUNCIL DISTRICTS)
RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached appropriation ordinance increasing the appropriations in the Stormwater Utility Fund
by $1 000 000 00 and decreasing the unreserved undesignated fund balance by the same amount;
2. Authorize the transfer from the Storm Water Utility Fund to the Storm Water Capital Projects Fund in the
amount of $1 000 000 00
3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Storm Water Capital Projects Fund in the amount of $1 000 000 00 from available funds and
4 Authorize the City Manager to execute the second renewal of City Secretary Contract No 38360 with
Tri Tech Construction Inc. in an amount up to $1 000 000 00 for the Miscellaneous Storm Drain
Improvements.
DISCUSSION
The Storm Water Management Program was established to reduce flooding in Fort Worth preserve
streams minimize water pollution and to operate the storm water system in a more effective manner to
fully comply with state and federal regulatory requirements This will be accomplished by infrastructure
reconstruction and system maintenance, master planning enhanced development review and increased
public education and outreach
On March 3 2009 (M&C C-23382) the City Council authorized the award of a contract in the amount of
$1 000 000 00 with the option of two renewals to Tri Tech Construction Inc. for the Miscellaneous Storm
Drain Improvements Contract. On February 9 2010 (M&C C-24092) the City Council authorized the
execution of the first renewal of this contract (CSC No 38360) in an amount up to $1 000 000 00 with Tri
Tech Construction Inc.
The funds for the first renewal of the contract have been fully expended so the Transportation and Public
Works Department recommends executing the second renewal at this time
The $1 000.,000 00 authorized for transfer per this M&C will be used to fully fund the contract plus the
funds necessary for right-of-way and easement acquisition inspection and survey services

The work to be performed under this contract consists of minor extensions, replacements and/or
improvements to existing storm water systems and other pertinent construction required to provide a more
effective drainage system to neighborhoods within the City limits of Fort Worth There is not apre-defined
single project scope for this contract but, rather work orders are issued on this contract as needs arise
The price of each work order is based on the unit prices bid with the cumulative amount of all work orders
issued under this extension of the Miscellaneous Storm Drain Contract capped at $1 000 000 00 This
contracting tool has enhanced the City's responsiveness to minor drainage infrastructure needs that arise
periodically by precluding the need to conduct an independent solicitation and award process for each
small project.
Tri Tech Construction Inc. is in compliance with the City's M/WBE Ordinance by committing to 16 percent
M/WBE ,participation The City's goal on this project is 15 percent.
This contract is located in ALL COUNCIL DISTRICTS
FISCAL INFORMATION /CERTIFICATION
The Financial Management Services Director certifies that, upon approval of the above recommendations
and adoption of the attached appropriation ordinances funds will be available in the current capital
budget, as appropriated of the Storm Water Capital Projects Fund
