Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter 26, Protection of Public Parks and Recreational Lands; 2. Find that no feasible or prudent alternatives exist to the use of a portion of Overton Park as proposed; 3. Find that the proposed use includes all reasonable planning to minimize harm to the parkland and including that the proposed use will have no impact on use of the surface of parkland as specified on the attached maps and as noted in the discussion below; and 4. Close the public hearing and authorize the City Manager to approve use of the subsurface of parkland for the drilling and the extraction of natural gas: Overton Park- located at 3500 Overton Park Drive East, Mapsco 89G, Lot 18, block 44A, Westcliff Addition to the City of Fort Worth, Tarrant County, Texas, according to plat records in Volume 338- 106, Pages 54 and 55, Plat records of Tarrant County, Texas, in COUNCIL DISTRICT 3 DISCUSSION: In accordance with the Texas Parks and Wildlife Code, Chapter 26, the City of Fort Worth seeks to use a portion of the subsurface area of Overton Park for the purpose of drilling and the extraction of natural gas from an off site location. This process only proposes the use of a portion of the subsurface and no surface of the park will be disturbed. At this time only a portion of Overton Park is being considered for use as the remaining portions of the Park are deed restricted. Attached is a map of the Park. In accordance with State law, the public notice was advertised in the Fort Worth Star-Telegram on August 31, 2010, September 7, 2010 and September 14, 2010. An exhibit map was available for public review for 30 days at the Parks and Community Services Department administrative offices located at 4200 South Freeway, Suite 2200. A letter announcing the proposed use was sent to the president of the Overton Park Neighborhood Association on September 9, 2010. Signage was posted at the site noting the proposal and providing instructions for directing comments to the Parks and Community Services Department. Staff will note any public comment received during the Public Hearing, Report of City Staff.
