ALFORD & VEAL'S ADDITION AS RECORDED IN VOLUME F, PAGE 307 AND BLOCK 5 OF THE ALFORD & VEAL'S ADDITION AS RECORDED IN VOLUME 41, PAGE 462 AND VOLUME F, PAGE 307 OF THE DEED RECORDS OF TARRANT COUNTY, TEXAS AND VOLUME 388-103, PAGE 216 OF THE PLAT RECORDS OF TA,I2RANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE RETAINIVIENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following alleys described below: 1. A portion of a 20 foot wide alley located in Block 6, Geo. F. Alford & Veal's Addition, an addition to the City of Fort Worth, as recorded in Volume F, Page 307 of the Deeds Records of Tarrant County, Texas, containing 0.180 acres of land more or less and lying between Lueda Street and Terrell Street; 2. A portion of a 20 foot wide alley located in Block 5 of Alford & Veal's Addition, an addition to the City of Fort Worth as recorded in Volume 41, Page 462 and Volume F, Page 307 of the Deed Records of Tarrant County, Texas and as recorded in Volume 388-103, Page 216, of the Plat Records of Tarrant County Texas, containing 7,538 square feet of land more or less and lying between Lueda Street and Terrell Street; and as more specifically described in Exhibits "A", "B", "C" and "D" attached hereto and incorporated herein, by reference be and the same are vacated and extinguished: SECTION 2. That the fee to the land in the above-described vacated alleys is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. No. 18141-06-2008 DATE: Tuesday, June 17, 2008 LOG NAME: 06VA-07-027 REFERENCE NO.: ~*PZ-2786 SUBJECT: Adopt an Ordinance Vacating an Alley, 392 Feet Long by 20 Feet Wide, Containing Approximately 7,840 Square Feet, within Block 6 of the Alford and Veals Addition, and an Alley, 380 Feet Long by 20 Feet Wide Containing 7,600 Square Feet within Block 5 of the Alford and Veals Addition, in the City of Fort Worth, Tarrant County, Texas, and Waive Purchase Fees RECOMMENDATION: It is recommended that the City Council: 1. Adopt an ordinance vacating an alley, 392 feet long by 20 feet wide and containing approximately 7,840 square feet, along Lots 1 through 16, Block 6, Alford and Veals Addition, and an alley, 380 feet long by 20 feet wide and containing approximately 7,600 square feet, along Lots 1 through 8 and Lots 10R through 16, Block 5, Alford and Veals Addition, City of Fort Worth, Tarrant County, Texas; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624). DISCUSSION: Baird Hampton Brown, on behalf of the City of Fort Worth, has requested to vacate the above referenced alleys and to replat and incorporate it within the adjoining property. The applicant plans to use the area to construct a new Public Health building and the associated parking. The City Plan Commission recommended approval of these requests at its meetings on December 21, 2007, and on February 27, 2008. An acceptable replat (FS-07-287) has been received. Any existing utilities will be relocated at the applicant's expense,. or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon. The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process. The City does not own land under, or adjacent to, the above referenced right-of-way. Since no City funds have been expended to purchase property or easement rights, collection of the fee value or any portion thereof is recommended by staff to be waived.
