HomeMy WebLinkAboutOrdinance 19224-07-2010Ordinance No 19224-07 2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL PROTECTION PROJECT FUND IN THE AMOUNT OF $472,600 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE TRANSPORTATION AND DISPOSAL OF CONTAMINATED SOILS AT 2500 BRENNAN AVENUE, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Environmental Protection Project Fund in the amount of $472,600 00 from available funds, for the purpose of funding the transportation and disposal of contaminated soils at 2500 Brennan Avenue. SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption. No. 1.9224-07-2010 m DATE Tuesday July 13 2010 REFERENCE NO C-24340 LOG NAME 52RATIFY EMERGENCY PROCUREMENT WITH SUNBELT SUBJECT Adopt Appropriation Ordinance and Ratify Emergency Purchase Order with Sunbelt Industrial Services in the Amount of $472 600 00 for Transportation and Disposal of Contaminated Soils at 2500 Brennan Avenue (COUNCIL DISTRICT 2) RECOMMENDATION It is recommended that the City Council 1 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Protection Project Fund in the amount of $472,600 00 from available funds and 2 Ratify Emergency Purchase Order with Sunbelt Industrial Services in the amount of $472 600 00 for transportation and disposal of contaminated soils at 2500 Brennan Avenue DISCUSSION While performing additional investigation to delineate the amount of impacted soils additional petroleum impacted soils were found on site that posed a threat to the Trinity River Hydrocarbons had begun to migrate out of the soil into the drainage channel Approximately 17 800 cubic yards of soil requires excavation and approximately 9 500 cubic yards of Total Petroleum Hydrocarbons (TPH) contaminated soil requires transportation and disposal from 2500 Brennan Avenue Proper removal and disposal of the contaminated soils is required under Texas Commission on Environmental Quality rules and regulations Sunbelt Industrial Services (Sunbelt} was contacted regarding the emergency cleanup Sunbelt's costs were similar to the prior costs and they could begin work immediately The Environmental Management Department conferred with both the Law and Financial Management Services (Purchasing) Departments to proceed under emergency procurement procedures in order to prevent additional environmental impacts and potential human exposure Both Legal and Purchasing have agreed that this issue can be treated as a procurement that is necessary to preserve or protect the public health or safety of the municipality's residents in accordance with the Texas Local Government Code Section 252 022(a)(2). Sunbelt is in compliance with the City's M/WBE Ordinance by committing to 12 percent M/WBE participation The City's goal on this project is 10 percent.
