AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $515,928.00 FROM
AVAILABLE FUNDS FOR THE PURPOSE OF PROVIDING FUNDING TO UPDATE THE
WASTEWATER SYSTEM MASTER PLAN CITYWIDE, PROVIDING FOR A
SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the
Budget of the City Manager there shall also be increased estimated receipts and appropriations in the
Special Trust Fund in the amount of $52,041 19 from available funds, for the purpose providing funding to
update the Wastewater System Master Plan citywide.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No.18809 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect upon adoption

Authorize Amendment No 2 in the Amount $515 928 00 to City Secretary Contract No 37548 with Freese
and Nichols Inc. to Update the Wastewater System Master Plan Citywide and Adopt Appropriation
Ordinance (ALL COUNCIL DISTRICTS)
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to transfer $515 928 00 from Water and Sewer Fund to the Sewer Capital
Project Fund
2. Adopt the appropriation ordinance increasing estimated receipts and appropriations in the Sewer
Capital Project Fund in the amount of $515 928 00 from available funds, and
3 Authorize the City Manager to execute Amendment No 2 in the amount of $515 928 00 to City
Secretary Contract No 37548 an Agreement with Freese and Nichols, Inc. to update the Wastewater
System Master Plan Citywide increasing the total fee to $3 849 548 00
DISCUSSION
On August 26 2008 (M&C C-22997) the City Council authorized the execution of an engineering
agreement with Freese & Nichols, Inc. to update Wastewater Master Plan for a total fee not to exceed
$2 987 193 00 Wastewater Master Plan will address system deficiencies as well as future growth areas
On February 9 2010 (M&C C-24085) the City Council approved Amendment No 1 in the amount of
$346 427 00 The Amendment No 1 scope of services included linking core GIS unique Asset IDs to
wastewater pipe condition data and work orders and additional flow monitoring
The Amendment No 2 scope of services will include
1) development of a permit renewal for the Village Creek Wastewater Treatment Plant (VCWWTP) Texas
Pollutant Discharge Elimination System (TPDES). The City of Fort Worth owns and operates the
VCWWTP and the existing permit will expire on September 1 2011 As a requirement of the Texas
Administrative Code (30 TAC Section 305 63) The City is required to file an application for renewal of the
permit with the Texas Commission on Environmental Quality (TCEQ) prior to the expiration date The City
must submit an application by March 1 2011 to meet the renewal application requirements Failure to
submit the application in a timely manner may result in initiation of enforcement actions or expiration of the
permit.
2) provide coordination with other consultants on Village Creek collector capacity issues and recalibration

of the Village Creek Basin model after interceptor cleaning
3) additional modeling of the VCWWTP hydraulics to determine capacity and
4) evaluation of the impact of the proposed Mary's Creek Wastewater Treatment Plant on future system
capacity
Freese and Nichols Inc. is in compliance with the City's M/WBE Ordinance by committing to 21 percent
M/WBE participation on this Amendment No 2 The City's goal on this amendment is 21 percent.
This project is located in ALL COUNCIL DISTRICTS
FISCAL INFORMATION /CERTIFICATION
The Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached appropriation ordinance funds will be available in the current capital budget,
as appropriated of the Sewer Capital Projects Fund
