HomeMy WebLinkAboutOrdinance 19241-07-2010Ordinance No 19241-07 2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED SECTION OF THE PARK DEDICATION FEES FUND IN THE AMOUNT OF $55 548 53, FROM AVAILABLE FUNDS FOR THE PURCHASE OF 21 TAX FORECLOSED PROPERTIES TO BE DEDICATED AS PARK LAND WITHIN THE CITY OF FORT WORTH' PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the `Unspecified" Section of the Park Dedication Fees Fund in the amount of $55,548.53, from available funds for the purchase of 21 tax foreclosed properties to be dedicated as park land within the City of Fort Worth. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVED AS TO FORM AND LEGALITY s istant City Attorn~y ADOPTED AND EFFECTIVE. DATE Tuesday July 27 2010 REFERENCE NO *L 15019 LOG NAME 1717ClTYWIDE PARKLAND ACQUISITION PROJECT SUBJECT Authorize the Direct Sale of Twenty-One Tax Foreclosed Properties Located within the Central City to the City of Fort Worth for an Amount of $128 633 10 Which Includes Survey Expenses and Closing Costs Approve the Purchase and Dedicate the Property as Parkland and Adopt Appropriation Ordinance (COUNCIL DISTRICTS 2, 8 and 9) RECOMMENDATION It is recommended that the City Council 1 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the amount of $55 548 53 from the Park Dedication Fees Fund 'Unspecified" 2 Authorize the purchase and direct sale of twenty-one tax foreclosed properties located within the Fort Worth Central City specifically in COUNCIL DISTRICTS 2 8 and 9 in accordance with Section 34 05 of the Texas Code to the City of Fort Worth for park purposes for an amount of $128 633 10 which includes survey expenses and closing costs for each property 3 Authorize the City Manager or his designee to execute and record the appropriate instruments conveying the property to complete the purchase and sale and 4 Accept the property and dedicate the property as parkland upon conveyance DISCUSSION The City of Fort Worth (City) holds in trust the below referenced properties through either a Constable or Sherriffs Sale as result of a tax foreclosure The City holds tax foreclosed property as trustee for all taxing units that were a party to the tax foreclosure lawsuit.
