AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS
IN THE UNSPECIFIED SECTION OF THE PARK DEDICATION FEES FUND IN THE
AMOUNT OF $55 548 53, FROM AVAILABLE FUNDS FOR THE PURCHASE OF 21 TAX
FORECLOSED PROPERTIES TO BE DEDICATED AS PARK LAND WITHIN THE CITY
OF FORT WORTH' PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the
Budget of the City Manager there shall also be increased estimated receipts and appropriations in the
`Unspecified" Section of the Park Dedication Fees Fund in the amount of $55,548.53, from available funds
for the purchase of 21 tax foreclosed properties to be dedicated as park land within the City of Fort Worth.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void
for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect upon adoption

SUBJECT
Authorize the Direct Sale of Twenty-One Tax Foreclosed Properties Located within the Central City to the
City of Fort Worth for an Amount of $128 633 10 Which Includes Survey Expenses and Closing Costs
Approve the Purchase and Dedicate the Property as Parkland and Adopt Appropriation Ordinance
(COUNCIL DISTRICTS 2, 8 and 9)
RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
amount of $55 548 53 from the Park Dedication Fees Fund 'Unspecified"
2 Authorize the purchase and direct sale of twenty-one tax foreclosed properties located within the Fort
Worth Central City specifically in COUNCIL DISTRICTS 2 8 and 9 in accordance with Section 34 05 of
the Texas Code to the City of Fort Worth for park purposes for an amount of $128 633 10 which includes
survey expenses and closing costs for each property
3 Authorize the City Manager or his designee to execute and record the appropriate instruments
conveying the property to complete the purchase and sale and
4 Accept the property and dedicate the property as parkland upon conveyance
DISCUSSION
The City of Fort Worth (City) holds in trust the below referenced properties through either a Constable or
Sherriffs Sale as result of a tax foreclosure The City holds tax foreclosed property as trustee for all taxing
units that were a party to the tax foreclosure lawsuit. The City is authorized to conduct a direct sale of tax
foreclosed property to a buyer for the lesser of the market value specified in the judgment or the judgment
amount plus any accrued court costs and administrative fees The Parks and Community Services
Department proposes the acquisition of these properties to expand existing park land boundaries at
Arnold Cobb Far Northside Marine Creek Linear and Paz Hernandez Parks to provide a better quality of
life for residents by improving the existing park system in low to moderate income areas
As part of the property sale City staff will request the release of all existing City liens filed and collect
authorized property management and administrative fees City staff will also request that the Financial
Management Services Revenue Office pro-rate labor charges attributable to the property described
below so that the property may be conveyed free of encumbrances The City is responsible for all closing
costs related to this transaction
The Planning and Development Department has reviewed the current zoning of this property and
determined that the zoning is compatible with respect to existing land use the existing land uses of the

surrounding neighborhood and future land use designations indicated by the Comprehensive Plan
Community Development Block Grant (CDBG) funds will pay $73 084 57 and said funds have been
previously appropriated by City Council on March 9 2010 in M&C G-16867 Park Dedication Fees Fund
will pay for the remaining balance of $55 548 53 for the properties outlined below In some instances,
multiple properties are grouped on a single deed and multiple properties will be purchased for one price
(Groups 1 7 8 and 9)

The annual cost to maintain this land is estimated to be $10 114 00 The maintenance estimates for the
new parcels are as follows 2505 MLK Freeway $3 396 00 2509 MLK Freeway $1 883 00 3213 Pearl
Avenue $674 00 1100 Mayfield Street $1 394 00 735 Woods Avenue $1 122 00 and 701 Woods Avenue
$1 645 00 The cost to maintain this land for the remainder of the fiscal year is estimated to be
approximately $4 214 00
The remaining parcels are currently being maintained by the PACS Dept. and are accounted for in the
current operating budget: 3213 Pearl Avenue is currently being maintained as a part of Marine Creek
Linear Park, 3515 3513 and 3511 Ellis Avenue parcels are currently being maintained as Paz Hernandez
Park, and 2958 2960 2962 2964 2966 and 2968 Roosevelt Avenue and 2953 2955 2959 2961 2963
and 2967 Prairie Avenue parcels are currently being maintained as Far Northside Park.
In accordance with the Citizen Participation Plan a comment period was held beginning December 12
2009 and ending January 11 2010 Any comments will be maintained by the Housing and Economic
Development Department in accordance with federal regulations The Citywide Acquisition of Properties
for Parkland Project is located in COUNCIL DISTRICTS 2 8 and 9 (See attached map)

The Financial Management Services Director certifies that upon approval of the above recommendations,
and adoption of the attached appropriation ordinance funds will be available in the current capital budget,
as appropriated of the Park Dedication Fees Fund and in the current operating budget, as appropriated
of the Grants Fund
