AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
ERIE STREET AND ASSOCIATED PUBLIC OPEN SPACE EASEMENTS
FROM HART STREET TO ITS TERMINUS AT THE UNION PACIFIC
RAILROAD RIGHT OF WAY, A PUBLIC RIGHT-OF WAY, SITUATED
BETWEEN LOT 1 R, BLOCK 18, HANDLEY ORIGINAL TOWN AND
LOT 1, BLOCK 4-R, HANDLEY ORIGINAL TOWN AS RECORDED IN
VOLUME 40, PAGE 51, OF THE DEED RECORDS OF TARRANT
COUNTY, TEXAS, AND CONTAINING APPROXIMATELY 8,500
SQUARE FEET OF LAND MORE OR LESS, PROVIDING FOR
REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY
SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS, REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That a portion of Ene Street and associated public open space easements, situated
between Lot 1 R, Block 18 Handley Onginal Town, and Lot 1 Block 4-R, Handley Onginal
Town, an addition to the City of Fort Worth as recorded m Volume 44, Page 51 of the Deed
Records of Tarrant County Texas, and containing approximately 8,500 square feet of land more
or less, and as more specifically described in Exhibits A and `B" attached hereto and
incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated public nght-of way is
hereby released and shall revert to the adjacent owner as provided by law

SECTION 3.
All existing utility emergency and drainage easements be shall be retained by the City
until such rime all utilities, including drainage, located m that easement are relocated at the
owner's expense or the emergency access easement is no longer required.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

DESCRIPTION OF PROPOSED STREET VACATION PARCEL
SITUATED in the City of Forf Worth, Tarrant County Texas, and being a portion of South Erie Street
(originally 72 feet wide right-of-wqy called West Street) as shown on plat of Handley (original town) as
shown on plat thereof recorded in Volume 40, Page 51 of the Tarrant County Deed Records, and said
portion being more fully described as follows:
BEGINNING at the most southerly southwest comer of Lot 1 Block 4-R, Handley (original town) as shown
on plat thereof recorded under County Clerk's File No. D210114279 said point being the point of
intersection of the east line of said South Erie Street with the present north line of Hart Street (presently 60
feet wide at this point (originally 100 feet wide right-of-way called Main Street) from which point an
RPLS 1640" capped 5/8" iron rod found in place bears North 75 degrees, 04 minutes, 15 seconds West,

said Easement also being a portion of former South Erie Street (originally 72 feet wide right-of-way called
West Street) as shown on plat of Handley (original town) as shown on plat thereof recorded in Volume
40. Page 51 of the Tarrant County Deed Records, and said Easement being more fully described as
follows:
BEGINNING at the most southerly southwest corner of said Lot 1 Block 4-R, Original Town of Handley
sofa point being the point of intersection of the present northeast line of said South Erie Street with the

RECOMMENDATION
It is recommended that the City Council
1 Adopt an ordinance vacating a portion of Erie Street from Hart Street to its terminus at the Union Pacific
Railroad right-of-way and the associated public open space easements, and
2 Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G-
15624)
DISCUSSION
Gerry Curtis and Associates, Inc. on behalf of Youghal Corporation has requested the vacation of the
above referenced portion of a street to replat it with the adjacent property for future building and drive
expansion Erie Street has been physically closed at the railroad crossing and does not continue to the
north towards Lancaster Avenue The City Plan Commission recommended approval of these requests at
its meeting June 23 2010 An acceptable replat (FS-010-065) has been received Any existing utilities will
be relocated at the applicant's expense or retained within a designated easement, along with an
appropriate plat note that no permanent structures may be constructed or placed thereon
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. The City does not own land under or adjacent to the above referenced public right-of-way Since
no City funds have been expended to purchase property or easement rights collection of the fair market
value or any portion thereof is recommended by staff to be waived
This land is located in COUNCIL DISTRICT 5
