HomeMy WebLinkAboutOrdinance 19256-08-2010Ordinance No 19256-08-2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE NEW EQUIPMENT PURCHASES FUND IN THE AMOUNT OF $2,579 504.00 UPON RECEIPT OF ANON-INTEREST BEARING INTER-FUND LOAN FROM THE GENERAL FUND FOR THE PUCHASE OF FOUR NEW ROSENBAUER FIREFIGHTING TECHNOLOGY PUMPER APPARATUS PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the New Equipment Purchases Fund in the amount of $2,579 504 00 upon receipt of anon-interest bearing inter fund loan from the General Fund for the purchase of four new Rosenbauer Firefighting Technology Pumper Apparatus. SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No.18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. No. 19256-08-2010 DATE Tuesday August 03 2010 REFERENCE NO P 11158 LOG NAME 13P10-0382 PUMPER APPARATUS SUBJECT Authorize the Purchase of Four New Pumper Apparatus from Emergency Vehicles of Texas Using a Houston-Galveston Area Council Cooperative Contract for the Fire Department for a Total Amount of $2 579 504 00 and Adopt Appropriation Ordinance RECOMMENDATION It is recommended that the City Council 1 Authorize anon-interest bearing inter-fund loan from the General Fund to the New Equipment Purchases Fund in the amount of $2 579 504 00 for interim financing of the purchase of fire apparatus pending issuance of debt; 2. Adopt attached supplemental appropriation ordinance increasing estimated receipts and appropriations in the New Equipment Purchases Fund by $2,579 504 00 and 3 Authorize the purchase of four new Pumper Apparatus from Emergency Vehicles of Texas using a Houston-Galveston Area Council (HGAC) Cooperative Contract for the Fire Department for a Total Amount of $2 579 504 00 with payments due 30 days after receipt of invoices DISCUSSION The apparatus will be used in daily operations by firefighters to transport personnel and equipment to fires, hazardous incidents and other emergency situations The four units will be 2011 Rosenbauer Firefighting Technology 1500 gallons per minute (GPM) pumper apparatus with options and equipment for an individual cost of $644 876 00 These apparatus will replace units that can no longer be economically maintained and will be sold at auction. This apparatus meets the specifications and should operate satisfactorily during its service life Warranty information Manufacturer's Statement of Origin and original sales invoices will accompany the apparatus upon delivery to the Fire Vehicle Services Center 2920 West Bolt Street. PRICE ANALYSIS The price offered by the recommended vendor is six percent higher than the price in 2009 because of higher priced materials parts components labor and the Environmental Protection Agency's National Clean Diesel Campaign Clean Diesel Initiative (CDI), for diesel engines using ultra low sulfur diesel fuel The CDI was mandated for all diesel powered vehicles in the United States to be manufactured 90 percent cleaner than current models when designing and building the engines The new technologies developed to meet the new EPA CDI by the engine manufacturers has caused a significant increase in the cost of diesel engines Overall prices are considered to be fair and reasonable State law provides that a local government purchasing an item under a cooperative purchasing agreement satisfies state laws requiring that the local government seek competitive bids for purchase of the item Logname• 13P10-0382 PUMPER APPARATUS Page 1 of 2 HGAC contracts have been competitively bid to increase and simplify the purchasing power of local government entities across the State of Texas An inter-fund loan from the General Fund to the New Equipment Purchase Fund will be used as interim financing to purchase the fire apparatus The loan will be repaid to the General Fund from debt proceeds issued in the fall of 2010 U S Treasury regulations and guidelines require that a governmental entity declare its intent to use debt financing in order to subsequently reimburse itself from the proceeds of that borrowing In accordance with this requirement, the City must adopt a resolution declaring its intent to reimburse itself from the proceeds of the issuance of debt for the fire apparatus expenditures incurred prior to the financing On June 15 2010 the City Council approved M&C G-16959 stating the City's intent to reimburse itself for fire apparatus expenditures from the sale of bonds in accordance with Internal Revenue Service requirements for the issuance of debt. M/WBE A waiver of the goal for M/WBE subcontracting requirements was requested by the Purchasing Division and approved by the M/WBE Office because the purchase of goods is from sources where subcontracting or supplier opportunities are negligible FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that upon approval of the above recommendation and adoption of the attached supplemental appropriation ordinance funds will be available in the current capital budget, as appropriated of the New Equipment Purchases Fund Expenditures incurred for the purchase of fire apparatus will be reimbursed from the issuance of debt.
