HomeMy WebLinkAboutOrdinance 19264-08-2010ORDINANCE NO 19264-08-2010 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF KENT STREET AND A PORTION OF MIDCOURT, LOCATED ADJACENT TO LOT D-1 BLOCK 22 BELLAIRE ADDITION AND LOTS 1,2 AND 3 OF BLOCK 12 ADDITION AND LOTS 19-21, OF BLOCK 22 OF BELLAIRE ADDITION, ADDITIONS IN THE CITY OF FORT WORTH AS RECORDED IN THE DEED AND PLAT RECORDS OF TARRANT COUNTY, TEXAS, AND CONTAINING APPROXIMATELY 49,720 SQUARE FEET OF LAND MORE OR LESS, PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That a portion of Kent Street, a 50 foot nght-of way and a portion of Midcourt a 50 foot right-of way as shown on the plat of Bellaire Addition, an addition to the City of Fort Worth recorded m Volume 902, Page 557 of the Deed Records of Tarrant County Texas and on the plat of Bellaire Addition, an addition to the City of Fort Worth, as recorded in Volume 1037 Page 557 of the Deed Records of Tarrant County Texas, and containing approximately 49 720 square feet of land more or less, and as more specifically described in Exhibits A and `B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street nght of way is hereby released and shall revert to the adjacent owner as provided bylaw 1 SECTION 3. All existing utility easement be shall be retained by the City until such time all uhhties located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. No, 19264-08-2Q10'' DATE Tuesday August 10 2010 REFERENCE NO.. *PZ 2904 LOG NAME 060065030 VA-09-021 SUBJECT Adopt an Ordinance Vacating a Portion of MidCourt and Kent Street Located South of Bellaire Drive within the Texas Christian University Campus (COUNCIL DISTRICT 9) RECOMMENDATION It is recommended that the City Council• 1 Adopt an ordinance vacating a portion of MidCourt and Kent Street located south of Bellaire Drive North within Block 12, Texas Christian University Addition and 2 Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G- 15624). DISCUSSION J B Davies, Inc. on behalf of Texas Christian University has requested the vacation of the above referenced streets to replat the right-ot-way with the adjoining property to develop new parking areas for the campus. The City Plan Commission recommended approval of these requests at its meeting on July 22, 2009 An acceptable replat (FS-009-092) has been received Any existing utilities will be relocated at the applicant's expense or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own land under or adjacent to the above referenced public rights-of-way Since no City funds have been expended to purchase property or easement rights, collection of the fair market value or any portion thereof is recommended by staff to be waived. This land is located in COUNCIL DISTRICT 9 FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that this action will have no material effect on City funds.
