HomeMy WebLinkAboutOrdinance 19267-08-2010Ordinance No 19267-08-2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $261 604 00 SUBJECT TO RECEIPT OF A GRANT THE SAFE CITY COMMISSION FOR THE PURPOSE OF PROVIDING VICTIMS' ASSISTANCE SERVICES TO CHILDREN WHO WITNESS VIOLENT CRIMES PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $261 604 00, subject to receipt of a grant from the Safe City Commission for the purpose of providing victims assistance services to children who witness violent crimes. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVED AS TO FORM AND LEGALITY ,~ ssistant City t orney ADOPTED AND EFFECTIVE. No. 19267-08-2010 , DATE Tuesday August 10 2010 REFERENCE NO C-24390 LOG NAME 35JUVWIT2010AM SUBJECT Authorize an Amendment to City Secretary Contract No 38231 to Provide Continued Funding on an Annual Basis of $65 401 00 from the Safe City Commission for the City to Provide and Coordinate Victims' Assistance Services to Children Who Witness Violent Crimes and Adopt Appropriation Ordinance RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to amend City Secretary Contract No 38231 with the Safe City Commission for the City to provide a Victim Assistance Coordinator to coordinate and provide victim assistance services to children who witness violent crimes 2. Authorize the City Manager to accept $65 401 00 annually from the Safe City Commission to reimburse the City for victim assistance services provided 3. Authorize the term of the amendment to remain October 1 2009 through September 30 2010 4 Authorize the agreement to be renewed for up to three successive one-year periods at the same funding level with written notification agreeable to both parties This action will not require specific City Council approval provided that the City Council has appropriated sufficient funds to satisfy the City's obligation during any renewal terms and 5 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $261 604 00 contingent upon receipt of funds DISCUSSION The City Council approved the original agreement on January 6 2009 under M&C C-23264 at a funding level of $65 401 00 for the initial year and for four-one year renewals. The approved M&C authorized the agreement to be renewed for up to four successive one-year periods however the M&C only appropriated funds in the Grant Fund for FY 2009 The Safe City Commission (SCC) provides crime prevention education and community advocacy for crime prevention programs to the public under a separate City Secretary contract and is committed to efforts to reduce and prevent gang and youth violence in Fort Worth SCC also realizes that exposure to violence early in life is a significant risk factor for later involvement in violent behavior The Juvenile Witness Intervention Project is a joint program between the City and SCC to provide intervention services to juveniles who witness violent crimes This M&C is to clarify the wording of M&C C-23264 to allow the agreement to be funded annually at the $65 401 00 level each year that the agreement option is exercised by the City and SCC This joint program is very successful and has been in operation at the SCC location since February 2009 The City will continue to provide a Fort Worth Police Department civilian employee to provide and Logname• 35JUVWIT2010AM Page 1 of 2 coordinate victims assistance services to children that witness violent crimes.
