TO CITY SECRETARY CONTRACT No. 46419
WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and
Associates, Inc. , (ENGINEER) made and entered into City Secretary
Contract No. 46419, (the CONTRACT) which was administratively authorized
on the 13th day of February, 2015 in the amount of $ 38, 546. 00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
White Settlement at University Traffic Signal Improvements; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated January 6, 2017, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $10,050. 00. (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $48,596. 00.
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

02530—White Settlement at University Traffic Signal Improvements
Dear Lissette:
Kimley-Horn and Associates, Inc. ("Kimley-Horn"or"Consultant')is pleased to submit this Amendment
#1 to the City of Fort Worth (City) to provide additional services to design landscaping and irrigation
improvements and construction phase services.
The following Scope of Services has been developed based on our discussions with the City.
Scope of Services
Kimley-Horn will provide the services specifically set forth below,
Task 6—Landscaping and Irrigation Design
Kimley-Horn will design landscaping and irrigation improvements on the northeast corner of White
Settlement and University. These improvements were added to the project because of the closure of
two (2) Fort Worth ISD driveways. The design will comply with applicable City specifications and
details.
Task 7—Construction Phase Services
ENGINEER will support the construction phase of the project as follows.
7.1, Notice to Proceed Package
• The ENGINEER will prepare a NTP package consisting of the following:
o Cover letter
o Project map
o Cost estimate for project
o Task order summary spreadsheet
o Plans
7.2. Construction Support
• The ENGINEER shall attend the preconstruction conference.
• After the pre-construction conference, the ENGINEER shall provide project exhibits and
attend public meeting to help explain the proposed project to residents. The CITY shall
select a suitable location and mail the invitation letters to the affected customers.

• The ENGINEER shall visit the project site at requested intervals as construction proceeds
to observe and report on progress. Such visits and observations by ENGINEER are not
intended to be exhaustive or to extend to every aspect of Contractor's work.
Observations are to be limited to spot checking, selective measurement, and similar
methods of general observation. Based on information obtained during such visits,
ENGINEER will evaluate whether Contractor's work is generally proceeding in
accordance with the Contract Documents, and ENGINEER will keep Client informed of
the general progress of the Work.
ENGINEER shall not, during such visits or as a result of such observations, supervise,
direct, or have control over Contractor's work, nor shall ENGINEER have authority over
or responsibility for the means, methods, techniques, equipment choice and usage,
sequences, schedules, or procedures of construction selected by Contractor, for safety
precautions and programs incident to Contractor's work, nor for any failure of Contractor
to comply with applicable laws and regulations. ENGINEER neither guarantees the
performance of any Contractor nor assumes responsibility for any Contractor's failure to
furnish and perform its work in accordance with the Contract Documents.
• The ENGINEER will schedule and conduct construction progress meetings to be held
every week, on-site.
• The ENGINEER will coordinate with CITY departments as necessary.
• Pay Applications. Based on its observations and on review of applications for payment
and accompanying supporting documentation, ENGINEER will determine the amounts
that ENGINEER recommends Contractor be paid. Such recommendations will be based
on ENGINEER's knowledge, information and belief, and will state whether in
ENGINEER's opinion Contractor's work has progressed to the point indicated, subject to
any qualifications stated in the recommendation. In the case of unit price work,
ENGINEER's recommendations of payment will include determinations of quantities and
classifications of Contractor's work, based on observations and measurements of
quantities provided with pay requests. ENGINEER's recommendations will not be a
representation that its observations to check Contractor's work have been exhaustive,
extended to every aspect of Contractor's work, or involved detailed inspections.
• The ENGINEER will update the BuzzSaw and One Note folders on a regular basis.
• The ENGINEER shall review shop drawings, samples and other submittals submitted by
the contractor for general conformance with the design concepts and general compliance
with the requirements of the contract for construction. Such review shall not relieve the
Contractor from its responsibility for performance in accordance with the contract for
construction, nor is such review a guarantee that the work covered by the shop drawings,
samples and submittals is free of errors, inconsistencies or omissions. The ENGINEER
shall log and track all shop drawings, samples and other submittals in Buzzsaw.
• As requested by the CITY, the ENGINEER shall provide necessary interpretations and
clarifications of contract documents, review change orders, and make recommendations
as to the acceptability of the work.
• The ENGINEER shall attend the"Final" project walk through and assist with preparation of
final punch list.

ASSUMPTIONS
• Up to eight(8) site visits are assumed.
• Up to two(2) submittal reviews are assumed.
• Up to five (5) RFPs are assumed.
• One(1) Change Order is assumed.
DELIVERABLES
• Response to Contractor's Request for Information
• Review of Change Orders
• Review of shop drawings
• Final Punch List items
Additional Services
Any services not specifically provided for in the above scope will be billed as additional services and
performed at our then current hourly rates
Schedule
We will provide our services in a mutually agreed upon schedule following Notice to Proceed from the
City. Additional services, if desired, will be performed in a timely manner upon authorization by the
City.
Fee and Expenses
Kimley-Horn will perform the services in Tasks 6 and 7 for an hourly, not-to-exceed fee of$10,050. All
permitting, application, and similar project fees will be paid directly by the Client.
Kimley-Horn will not exceed the total maximum labor fee shown without authorization from the Client.
