A RESOLUTION IN SUPPORT OF THE APPLICATION OF HURST
PARTNERS ONE, A COLORADO GENERAL PARTNERSHIP TO THE
TEXAS COMMISSION ON ENVIRONMENTAL QUALITY FOR A
MUNICIPAL SETTING DESIGNATION AT 711 WEST HURST
BOULEVARD,HURST,TEXAS
WHEREAS, Chapter 361, Subchapter W of the Texas Solid Waste Disposal Act authorizes the
Texas Commission on Environmental Quality ("TCEQ")to certify a Municipal Setting Designation ("MSD")
for a property upon receipt and approval of a properly submitted application to the TCEQ; and
WHEREAS, as a part of the application to the TCEQ for a MSD, the applicant is required to provide
documentation that the application is supported by the city council of each municipality with a boundary
located within one-half mile of the proposed MSD location; and
WHEREAS, HUST PARTNERS ONE ("Applicant") filed an application with the City of Hurst,
Texas, for support of a resolution seeking a Municipal Setting Designation for the site known as 711 West
Hurst Boulevard, Hurst, Texas, the metes and bounds description" and a map attached as Exhibit "A",
("Site")to the TCEQ; and
WHEREAS, the City of Hurst approved Resolution 1619 to show support of an MSD on the Site on
March 24, 2015; and
WHEREAS, the Site is located within one-half mile of the boundary of the City of Fort Worth and
must therefore the Applicant must acquire the City of Fort Worth's support of the application of the MSD for
the Site; and
WHEREAS, upon passage of this supporting Resolution by the City Council, the Applicant will
submit to the TCEQ an application for certification of the MSD for the Site pursuant to Texas Health and
Safety Code Chapter 361, Subchapter W.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS, THAT:
The City of Fort Worth does not oppose the establishment of a MSD for the Site and supports the
Applicant's application to the TCEQ for certification of a MS he Site.

Attachment to Resolution
Restrictive Covenant Prohibiting Potable Use of Groundwater
This Restrictive Covenant is filed to provide information concerning certain
environmental and use limitations pursuant to the Texas Solid Waste Disposal Act
(TSWDA), Chapter 361, Subchapter W, and affects the real property whose address
is 711- 721 W. Hurst Blvd., Hurst, TX containing approximately 6.510 acres of land
in the City of Hurst,Tarrant County Texas 76053 and more fully described in Exhibit
A attached hereto and incorporated herein by reference (the NO Property").
Shallow groundwater (less than 50 fee below the ground surface) underlying the
MSD Property (the "Designated Groundwater") contains chemicals of concern at
concentrations above applicable Tier 1 groundwater ingestion protective
concentration levels established under the Texas Risk Reduction Program, 30 Texas
Administrative Code Chapter 350.
This Restrictive Covenant is required as a precondition for certification by TCEQ of a
Municipal Setting Designation covering the Property pursuant to TSWDA Chapter
361, Subchapter W.
As of the date of this Restrictive Covenant, the record owner of fee title to the
Property is Anadite Texas Restoration Trust,a Texas Trust, with an address of 711
W Hurst Blvd, Hurst TX 76053 attention Clay R. Rumbaoa.
For good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, the Owner does hereby place the following restrictions on the MSD
Property in favor of the City of Hurst,the Texas Commission on Environmental
Quality ("TCEQ"), and the State of Texas,to wit:
1. The drilling of wells within the MSD Property and the use of the Designated
Groundwater for any purpose, including but not limited to any potable
purpose is prohibited, excepting only (a) the installation of monitor wells
used for the collection of groundwater samples for chemical or biological
laboratory analysis,and (b) the installation of wells used for the purpose of
remediation of soil or groundwater contamination.
2. These restrictions shall run with the land and be binding on and enforceable
as to any and all subsequent owners of the MSD Property.
This Restrictive Covenant shall be enforceable by the City of Hurst and may be
amended or rendered of no further force and effect only by a release executed by
the City of Hurst, after at least 30 days prior to written notice to TCEQ of any
pending amendment or termination,and filed in the Real Property Records as those
in which this Restrictive Covenant is riled.

Within the City of Hurst That is Also Within One-Half Mile of the Corporate Limits of the City of Fort Worth

RECOMMENDATION:
It is recommended that City Council adopt the attached resolution supporting the application to the Texas
Commission on Environmental Quality (TCEQ) for an MSD for a site located within the City of Hurst that is
within one-half mile of the corporate limits of the City of Fort Worth.
DISCUSSION:
In 2003, a state law came into effect which allows owners of properties with known groundwater
contamination to obtain a Municipal Setting Designation (MSD) from the Texas Commission on
Environmental Quality (TCEQ). An approved MSD application for a property prohibits use of the
groundwater at the site as a potable water source. Potable water means water used for drinking,
showering, bathing, or cooking, or for irrigating crops intended for human consumption. When
applications are approved, TCEQ does not require groundwater at these locations to be cleaned up to
meet drinking water standards. Other cleanup standards such as inhalation and contact must still be
achieved.
The MSD application will not be considered by the TCEQ, if the municipality where the site is located does
not give formal approval. Additionally, the MSD application must be supported by a resolution enacted by
each of the following: (1) the city council of each municipality with a boundary located within a half mile of
the site's boundaries; (2) the city council of each municipality that owns or operates a groundwater supply
well within five miles of the MSD's boundaries; and (3)the governing body of each retail public utility that
owns or operates a groundwater supply well within five miles of the MSD's boundaries.
On March 24, 2015, the City Council of the City of Hurst, Texas, approved ordinance number 1619,
prohibiting the use of shallow groundwater for potable purposes from beneath 711/721 West Hurst
Boulevard, Hurst, Texas. The designated groundwater is less than 36 feet in depth. The site was
formerly occupied by an aerospace components manufacturer which is the likely source of the
tetrachloroethene (PCE), trichloroethene (TCE), cis-1,2-dichloroethene (cis-1,2-DCE), vinyl chloride and
chromium at concentration levels above state drinking water standards.
The Hurst City Council made a finding that it is in the best interest of the public and the City to facilitate the
efforts of Hurst Partners One, LLC, to secure an MSD with TCEQ for this site. Because boundaries of this
site are within one-half mile of the corporate limits of Fort Worth, a resolution in support must also be
considered by the City of Fort Worth City Council.

The City of Fort Worth does not use groundwater as a potable water source and the site poses no concern
to Fort Worth's potable water supply. If the resolution in support of the application is approved by City
Council, then TCEQ will consider the MSD application.
This M&C does not request approval of a contract with a business entity.
