AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SPECIAL TRUST FUND, MUNICIPAL COURT
BUILDING SECURITY FUND IN THE AMOUNT OF $51,348 FOR THE
PURPOSE OF TRANSFERRING FUNDS TO THE GENERAL FUND FOR
SECURITY ENHANCEMENTS TO THE A.D. MARSHAL PUBLIC SAFETY &
COURTS BUILDING; PROVIDING FOR A SEVERABILITY CLAUSE, MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 20D7-
2008 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Special Trust Fund, Municipal Court Building Security Fund by $51,348 for the
purpose of transferring funds to the General Fund for security enhancements to the A. D. Marshal
Public Safety & Courts Building.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to transfer $51,348.00 from the Municipal Court Building Security Fund to the
General Fund for the reimbursement cost of two parcel x-ray machines at $40,996.00, and $10,352.00 for
security enhancements to doors accessing the A. D. Marshal Public Safety and Courts Building;
2. Increase estimated receipts and appropriations in the General Fund by $51,348.00 for the purchase of
two parcel x-ray machines and security enhancements for the A.D. Marshal Public Safety and Courts
Building; and
3. Adopt the attached ordinance increasing the estimated receipts and appropriations in the Special Trust
Fund, Municipal Court Building Security Fund by $51,348.00;
DISCUSSION:
The appropriation reimburses the General Fund for the cost of two replacement parcel x-ray machines
approved for purchase (M&C P-10785) on May 13, 2008. The new units are slated to replace two older
models currently in operation at the main and employee entrances to the A. D. Marshal Public Safety and
Courts Building. Additionally, the transfer will enable installation of card readers to the three building access
doors. The security enhancement includes a color camera support system feature.
The Texas t_egislature, during the 1995 regular legislative session, adopted an amendment to Article
102.017 of the Code of Criminal Procedure to allow the governing body of a municipality to create, by
ordinance, a Municipal Court Building Security Fund. Defendants convicted in a trial for a misdemeanor
offense in Municipal Court are required to pay a $3.00 security fee as a cost of the court. On October 10,
1995, Ordinance No. 12204 was approved by City Council to create the Municipal Court Building Security
Fund.
Security fees collected may only be used for purposes of providing or enhancing security services for
buildings housing a municipal court. This may include the purchase of parcel x-ray machines, hand-held
and walk-through metal detectors, security personnel providing security services, and continuing education
on security issues for court and security personnel.
The appropriation from the Municipal Court Building Security Fund will offset the expense to Municipal
Court FY2007-2008 General Fund operating budget for the cost of the x-ray machines, as well as
installation costs for security card readers.

FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of
the Special Trust Fund.
