HomeMy WebLinkAboutOrdinance 19346-09-2010Ordinance No 19346-09-2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE 2007 CRITICAL CAPITAL PROJECTS FUND IN THE AMOUNT OF $150 000 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE INSTALLATION OF BARRICADES AND OTHER SAFETY IMPROVEMENTS PER CROSSING CLOSURE AGREEMENT WITH TXDOT AND UNION PACIFIC RAILROAD• PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PR10R ORDINANCES REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the 2007 Critical Capital Projects Fund in the amount of $150 000 00 from available funds for the purpose of funding the installation of barricades and other safety improvements per a Crossing Closure Agreement with the Texas Department of Transportation and Union Pacific Railroad to Close the Railroad Crossing to Vehicular and Pedestrian Traffic. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DATE Tuesday September 21 2010 LOG NAME 20RAMSEYCLOSURE REFERENCE NO *`C-24459 SUBJECT Authorize a Crossing Closure Agreement with the Texas Department of Transportation and the Union Pacific Railroad to Close the Ramsey Avenue Railroad Crossing under which TxDOT Will Reimburse the City Up-to $150 000 00 for the Installation of Safety Improvements and Adopt Appropriation Ordinance (COUNCIL DISTRICT 9) RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to enter into a Crossing Closure Agreement with the Texas Department of Transportation (TxDOT) and the Union Pacific Railroad (UP) to close the Ramsey Avenue railroad crossing to vehicular and pedestrian traffic under which TxDOT will reimburse the City up to $150 000 00 for the installation of barricades and other safety improvements in the area and 2. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the .2007 Critical Capital Projects Fund in the amount of $150 000 00 from available funds DISCUSSION XTO Energy requested and received approval to vacate portions of Ramsey Avenue for a proposed gas well site on February 23 2010 Ordinance No 19046-02 2010 As a result of this vacation the Union Pacific Railroad crossing located in the 400 Block of Ramsey Avenue will be permanently closed to vehicular and pedestrian traffic. The Texas Department of Transportation (TxDOT) Railroad Division designated this crossing to receive lights and gates under its Federal Signal Program Section 130 Funds. Since the City has approved the street vacation which closes the crossing to traffic, TxDOT will instead make $150 000 available to the city for safety improvements to other railroad crossings in the area The scope of work will include the installation of barricades at Ramsey Avenue concrete medians at the Morningside Drive railroad crossing channelization devices at various crossings, and signs and pavement markings to improve safety at various crossings.
