HomeMy WebLinkAboutOrdinance 19349-09-2010Ordinance No 19349-09-2010 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORMWATER UTILITY FUND IN THE AMOUNT OF $133 116 00 AND DECREASING THE UNAUDITED UNRESERVED UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT FOR THE PURPOSE OF FUNDING THE SEYBOLD CREEK MASTER PLAN, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Stormwater Utility Fund in the amount of $133,116 00 and decreasing the unaudited, unreserved undesignated fund balance by the same amount, for the purpose of funding the Seybold Creek Master Plan SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption. DATE Tuesday September 21 2010 REFERENCE NO ''C-24463 LOG NAME 20SWMSEYBOLDCREEKPLAN SUBJECT Authorize an Engineering Agreement with Halff Associates Inc. in the Amount of $133 116 00 for the Seybold Creek Master Plan Decreasing the Unaudited Unreserved Undesignated Stormwater Utility Fund Balance by the Same Amount, and Adopt Supplemental Appropriation Ordinance (COUNCIL DISTRICT 2) RECOMMENDATION It is recommended that the City Council 1 Adopt the attached supplemental appropriation ordinance increasing appropriations in the Stormwater Utility Fund in the Amount of $133 116 00 and decreasing the unreserved undesignated fund balance by the same amount; and 2 Authorize the City Manager to execute an engineering agreement with Halff Associates, Inc. in the Amount of $133 116 00 for the Seybold Creek Master Plan DISCUSSION In order to address stream flooding detailed open channel studies are required to determine runoff'rates and flow depth to verify and correct Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps and to develop a master plan for each stream consisting of channel improvements detention and other measures which can remove buildings from the floodplain and make roadway crossings safer In November 2007 a request for qualifications was advertised for open channel studies Twenty-three statements of qualifications were received and Halff Associates Inc. was selected to prepare the Seybold Creek Master Plan Storm Water Study SWS-031 in order to address roadway home and business flooding along this creek. The scope of work will include a detailed study of the stream to reflect current conditions developing a watershed master plan for future improvements to reduce flooding and identification of erosion repair and other minor projects which may be needed Halff Associates Inc. proposes to perform this study for a lump-sum fee of $133 116 00 City staff considers this fee to be fair and reasonable for the scope of services proposed based on the size of the watershed and length of the stream The Stormwater Utility Fund will be used to fund this study Halff Associates Inc. is in compliance with the City's MlWBE Ordinance by committing to 16 percent M/V1/BE participation The City's goal for this project is 16 percent.
