HomeMy WebLinkAboutResolution 3868-03-2010A Resolution NO 3868-03-2010 APPROVING THE GRANTING OF RECLAIMED WATERLINE EASEMENTS BY THE DALLASJFORT WORTH INTERNATIONAL AIRPORT BOARD WHEREAS, the Cities of Dallas and Fort Worth Jointly own approximately 18 000 acres of property known as the Dallas/Fort Worth International Airport (Airport) and WHEREAS the Cities of Dallas and Fort Worth have created a `Joint board pursuant to Section 22 074 of the Texas Transportation Code, as amended, known as the Dallas/Fort Worth International Airport Board (Board) to operate and set and establish policies for the Airport; and WHEREAS the City of Fort Worth seeks to obtain a permanent easement on airport property for a reclaimed water pipeline from the Village Creek Wastewater Treatment Plant to the Airport; and WHEREAS the City of Fort Worth seeks to obtain a temporary construction easement on airport property for the construction of a reclaimed water pipeline from the Village Creek Wastewater Treatment Plant to the Airport; and WHEREAS the Airport's Chief Executive Officer will execute an agreement with American Airlines for compensation of $16 000 00 for the permanent easement and $8,352 00 for the temporary construction easement m exchange for American Airlines consent to the easement encroachments across its leasehold property on the Airport; and }WHEREAS on September 3 2009 by Resolution No 2009-09-201 the Board approved conveyance of a reclaimed waterline easement containing approximately 2,962 9 square feet and a temporary construction easement containing approximately 9,286 square feet to the City of Fort Worth, Texas across Airport land for a reclaimed water pipeline (Easements) and authorized the execution of an agreement with American Airlines to permit the easement to encroach upon the leasehold estate for total compensation of $24,352 00 to be paid by the City of Fort Worth per its appraisal. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT Section 1 The City Manager is authorized to convey a reclaimed waterline easement containing approximately 2,962.9 square feet and a temporary construction easement containing approximately 9,286 square feet to the City of Fort Worth, Texas across Airport land for a reclaimed water pipeline (Easements) URT WORT„ T RESOLUTION NO 3868-03-2010 Section 2. That the Airport's Chief Executive Officer be authorized to approve and execute an agreement with American Airlines to permit the Easements to encroach upon the leasehold estate; and Section 3 That this Resolution shall take effect immediately upon its passage. B y ,,`` r Y' Marty Hendrix Ci(y Secr~3a~y ~. ~~ ~ ~: ~~~:~ ,~rp~ si#~~. rr~frftr.~~ t~ tti~~w ORT WOff~ \ii l T li®'~~~ MAR 2 3 2010 C Cih'~oi then City of Fort Worth, Tix~ae "T City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION: Approved `on 3/2312010 - Resolution No. 3868-03-2010 DATE Tuesday March 23 2010 REFERENCE NO *G-16871 LOG NAME 12RECLAIMED H2O PIPELINE SUBJECT Authorize a Resolution Conveying to the City of Fort Worth Texas a Reclaimed Waterline Pipeline Easement on Property Located on the Dallas/Fort Worth International Airport for the Construction and Maintenance of Reclaimed Water and Salt Water Main Facilities and Also Authorize the Dallas/Fort Worth International Airport Chief Executive Officer to Execute an Agreement with American Airlines to Permit the Easement Encroachments Upon the American Airlines Leasehold Estate RECOMMENDATION It is recommended that the City Council authorize 1 The conveyance to the City of Fort Worth Texas of a reclaimed waterline easement containing approximately 2 963 square feet of land and a temporary construction easement containing approximately 9,285 square feet of land on property located on the Dallas/Fort Worth International Airport property for the construction and maintenance of reclaimed water and salt water main facilities and 2 The Dallas/Fort Worth International Airport Chief Executive Officer to execute an Agreement with American Airlines to permit the easement encroachments upon the leasehold estate DISCUSSION The City of Fort Worth is receiving stimulus funds to build a reclaimed water pipeline from the Village Creek Wastewater Treatment Plant to Dallas/Fort Worth lnternational Airport (DFW) property The Airport will purchase the reclaimed water for resale to its customers and for its own use for irrigation cooling mineral exploration and construction The reclaimed water supply wiN be in addition to the potable water supplies currently available The City of Fort Worth needs approximately 2 963 square feet of land for the reclaimed waterline easement and approximately 9 286 square feet of land for the temporary construction easement. The easements will be located at the intersection of FAA Boulevard and State Highway 360 across the southeast corner of Airport property currently leased to American Airlines for the AA Training Facility The encroachment of the easements on American Airlines leasehold will also require its consent and this action authorizes the Chief Executive Officer of the Airport, or his designee to execute such consent agreement. Based on an appraisal report commissioned by the City of Fort Worth the appraised value is $16 000 00 for the reclaimed water easement and $8 352 00 for the temporary construction easement. This action authorizes payment of the total amount to American Airlines as consideration for its consent to the easement. This will have no affect on the water rates to be charged by the City of Fort Worth Logname: 12RECLAIMED H2O PIPELINE Page 1 of 2 Permanent easements across Airport property can be granted only by the Cities of Dallas and Fort Worth even when the City of Fort Worth is the recipient of the easement.
