AMENDING THE CITY OF FORT WORTH'S ANNEXATION PLAN TO ADD AN
APPROXIMATELY 80-ACRE TRACT OF LAND LOCATED EAST OF ALTA
VISTA ROAD AND NORTH OF WALL PRICE KELLER ROAD
WHEREAS on December 14 1999 the City Council approved Resolution No 2598 adopting
an annexation plan for the City of Fort Worth in accordance with Section 43 052 of the Local
Government Code;
WHEREAS on November 27 2007 the City Council approved Resolution No 3557 11 2007
adopting the nineteenth amendment to the City's annexation plan identifying approximately 304 acres
referred to as Area 15 to be considered for annexation m 2010•
WHEREAS Hillsborough, Lee Ray's Place, and Wilshire Valley are three new residential
subdivisions within Area 15 east of Alta Vista Road and north of Wall Pnce Keller Road, where
builders, rather than homeowners, received the mrtial notice of the intent to begin annexation
proceedings,
WHEREAS these subdivisions had purchasers of property who bought homes unaware that
these properties were subject to annexation by the City of Fort Worth,
WHEREAS Section 43 052(e) of the Texas Local Government Code provides that a
mumcipalrty may amend rts annexation plan at any time to remove an area proposed for annexation,
WHEREAS the property owners and the City of Fort Worth agreed that the Crty will remove the
approximately 80-acre tract of land from the City's annexation plan so that annexation may be
considered at a later date;
WHEREAS on March 10 2009 the City Council approved Resolution No 3717-03 2009
adopting the twenty-third amendment to the City's annexation plan removing approximately 80 acres
referred to as Area 15-2 from the City's annexation plan for consideration for annexation in 2010•
WHEREAS Resolution No 3717-03 2009 stated the annexation plan shall be amended 12
months after approval of the Resolution, defined m Section 43 052(e) so that annexation may be
considered m 2013
WHEREAS 12 months have passed since the approval of Resolution 3717-03 2009•

WHEREAS the area specifically described on the map attached as Exhibit A and by the legal
description attached as Exhibit B was identified m Resolution No 3717-03 2009 for potential full
purpose annexation m 2013
WHEREAS the area described m Exhibit A and Exhibit B contains 100 or more dwelling units
and thus fs not subject to the annexation plan exemptions set out m Section 43 052(h) of the Texas Local
Government Code;
WHEREAS the preliminary fiscal impact analysis of this proposed annexation is positive;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS
That the City's annexation plan, approved on December 14 1999 by the adoption of Resolution
No 2598 fs hereby amended to include approximately 80 acres m the Hillsborough Addition, Lee Ray's
Place Addition, and Wilshire Valley Addition, Tarrant County Texas, as shown on Exhibit A and
described m Exhibit B,
Further that the area so described may be annexed for full purposes beginning on the third anniversary
of the date of this plan amendment.

Approximately 80 acres situated in The J R. Knight Survey A 902 and the J Edmonds Survey A-457
Tarrant County Texas. Said area is more particularly described by metes and bounds as follows.
BEGINNING at the northwest corner of Block `E" according to the final plat of Hillsborough, an
addition to Tarrant County according to plat thereof recorded at County Clerk's Instrument Number
D204202107 Official Public Records, Tarrant County Texas, being situated S00°27' 13 'W 54 78 feet,
and N888°40'00"W 455.31 feet, from the most westerly southwest corner of that certain terntory
annexed by the City of Fort Worth, as described by Ordinance Number 9818 and being the most west
southwest corner of the right-of way dedicated by said plat for Ray White Road,
THENCE S00°45 48"E, with the most north west line of said addition, 830 02 feet, to its most westerly

RECOMMENDATION
It is recommended that the City Council approve the attached resolution amending the City's annexation
plan to add an approximately 80-acre tract of land or 0 125 square miles covering the Hillsborough Lee
Ray's Place and Wilshire Valley subdivisions, in Tarrant County to the plan
DISCUSSION
On December 14 1999 the City Council approved Resolution No 2598 adopting an annexation plan for
the City of Fort Worth in accordance with Section 43 052 of the Texas Local Government Code State law
requires a municipality to place an area with 100 or more dwelling units in a three-year annexation plan in
order to consider them for full-purpose annexation
On November 27 2007 (M&C PZ 2760) the City Council adopted the nineteenth amendment to the City's
annexation plan to add approximately 304 acres in far north Fort Worth referred to as Area 15 for fuli-
purpose annexation in 2010 When the initial annexation notices were mailed to the property owners in
2007 several builders owned a large number of lots instead of individual homeowners Property owners
who bought homes in these newer subdivisions, were unaware that their properties were subject to
annexation proceedings. Council Member Espino and property owners from the Hillsborough Lee Ray's
Place and Wilshire Valley subdivisions which contain 406 residential lots agreed that these areas should
be removed from the City's annexation plan to allow homeowners time to receive adequate notice of
annexation proceedings The remaining 224 acres of extraterritorial jurisdiction in Area 15 between Keller
Hicks Road and Wall Price Keller Road are proposed for full-purpose annexation in the fall of 2010
On March 10 2009 (M&C PZ 2817) the City Council adopted the twenty-third amendment to the City's
annexation plan to remove approximately 80 acres encompassed by these subdivisions for annexation
consideration at a later date rather than in 2010 Section 43 052(e) notes areas removed from a city's
annexation plan requires a 12-month waiting period before re-introducing the same area to the City of Fort
Worth's annexation plan Since the 12-month waiting period has passed the City Council may now amend
the plan which would allow annexation in 2013
On May 22 2010 the City Council received the~preliminary fiscal impact analysis which was positive The
final fiscal impact analysis will be completed prior to the actual full-purpose annexation in 2013 if the City
Council decides to move forward with the annexation
In order to make new property owners aware of the annexation resolution approved by the City Council on
March 10 2009 a notice of intent to annex was filed with the Tarrant County Deed Records office for each

lot in these three subdivisions. The property owners have received notice of intent to amend the
annexation plan in order to add this 80-acre area Several other notices will be mailed to the property
owners over the course of the three-year annexation plan process
The property is contiguous to COUNCIL DISTRICT 2.
