AUTHORIZING THE CITY ATTORNEY TO RETAIN
THE LAW FIRM OF KELLY HART & HALLMAN LLP
WHEREAS Ric Clark, David Elhs, and Weldon Norman have sued the Crty of Fort Worth
alleging that they are due additional wages, and
WHEREAS because of the extraordinary importance of the issues raised, it is necessary to
retain outside legal counsel to represent the City in this action, and
WHEREAS, Russell Cawyer and Marc Patton of the law firm of Kelly Hart & Hallman LLP
possess -the required knowledge and expertise m wage issues and have agreed to
represent the City
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS
I.
That the Crty Attorney is hereby authorized to retain the law firm of Kelly Hart & Hallman LLP
as outside counsel pursuant to Chapter VI, Section 3 of the Crty Charter to represent the City m the
action filed by Ric Clark, David Ellis, and Weldon Norman.
II.
As far as practicable, the compensation to be paid to Kelly Hart & Hallman LLP for services is
hereby fixed in an amount not to exceed $100 000 00
AND IT IS SO RESOLVED

RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to retain Russell Cawyer and Marc Patton of the law firm of Kelly Hart &
Hallman LLP as outside counsel pursuant to Chapter VI Section 3 of the City Charter to represent the
City in the lawsuit styled Ric Clark, David Ellis and Weldon Norman v City of Fort Worth Texas Civil
Action No 4 10-CV 519-A, pending in the United States District Court, Northern District of Texas, Fort
Worth Division
2. Adopt the attached resolution fixing in advance as far as practicable the amount to be paid to Kelly
Hart & Hallman LLP in an amount not to exceed $100 000 00
DISCUSSION
Because of the extraordinary importance of the issues raised it is the opinion of the City Attorney that
outside legal counsel with knowledge and expertise in matters involving the matters that are the subject of
this case be retained to represent the City
