HomeMy WebLinkAboutOrdinance 18170-07-2008Ordinance No. 18170-07-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $533,263 SUBJECT TO RECEIPT OF THE GRANTS FROM THE OFFICE OF THE GOVERNOR, CRIMINAL JUSTICE DIVISION, FOR THE PURPOSE OF FUNDING THE SEX CRIMES AND REGISTRATION MONITORING (SCRAM) COLD CASE DETECTIVE GRANT, THE HOMICIDE COLD CASE INVESTIGATIONS GRANT, THE DOMESTIC ASSAULT RESPONSE TEAM (DART) GRANT, AND THE ENHANCED DOMESTIC ASSAULT RESPONSE TEAM GRANTS (ENHANCED DART) GRANT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $533,263 subject to receipt of the grants from the Office of the Governor, Criminal Justice Division, for the purpose of funding the Sex Crimes and Registration Monitoring (SCRAM) Cold Case Detective Grant, the Homicide Cold Case Investigations Grant, the Domestic Assault Response Team (DART) Grant, and the Enhanced Domestic Assault Response Team (Enhanced DART) Grant. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2008, and ending September 30, 2009, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. No. 18170-07-2008 DATE: Tuesday, July 08, 2008 LOG NAME: 35CJDGRANTSFY09 REFERENCE NO.: C-22858(Revised) SUBJECT: Adopt a Resolution Authorizing the Application for and Acceptance of $343,575 in Grant Funds from the Fiscal Year 2009 Criminal Justice Division Grant Funds, the Provision of $189,688 in Matching Funds and the Making of Assurances Required by the Criminal Justice Division of the Governor's Office and Adopt Appropriation Ordinance RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached resolution: a. Authorizing the City Manager to apply for, accept, reject, alter, or terminate, if awarded, four 2009 grants from the Office of the Governor, Criminal Justice Division. These Fiscal Year 2009 Grants include Sex Crimes and Registration Monitoring Cold Case Detective, Homicide Cold Case Investigation, Domestic Assault Response Team and Enhanced Domestic Assault Response Team; b. Authorizing the City Manager to agree to provide all matching funds and execute associated contract (s); c. Authorizing the City Manager to designate the Assistant City Manager who oversees the Police Department as the authorized official to accept, reject or alter the Criminal Justice Division Grants after they are awarded; and d. Providing assurance that funds will be returned to the Criminal Justice Division, in full, in the event of loss or misuse of Criminal Justice Division Grant funds. 2. Authorize the City Manager to transfer $178,228 from the State Awarded Assets Fund to the Grants Fund for the City's match of the Homicide Cold Case Investigation, Domestic Assault Response Team, and Enhanced Domestic Assault Response Team grants; 3. Authorize the City Manager to transfer $11,460 from the Federal Awarded Assets Fund to the Grants Fund for the City's match of the Sex Crimes and Registration Monitoring Cold Case Detective grant; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $533,263 upon receipt of the grants. DISCUSSION: Each year, the Criminal Justice Division (CJD) of the Governor's Office funds grant projects throughout the state. The Police Department has written four grant applications for the Fiscal Year 2009 Grant Cycle. Each project is described below: Logname: 35CJDGRANTSFY09 Page 1 of 3 Sex Crimes Registration and Monitoring (SCRAM) Cold Case Detective -Total $100,170 (CJD $88,710, City Match $11,460) This project will focus on the investigation of sexual assault cold cases. Grant funds will provide for one Detective whose sole purpose is to clear approximately 50 cold case reports that are over one year old. If the grant is awarded, funds will be used for salary and fringe benefits for one Detective, training, vehicle rental and insurance. This application is in its first year of funding. Homicide Cold Case Investigation -Total $ 114,181 (CJD $78,633, City Match $35,548) This project will allow one Detective to work full time on investigation of unsolved homicides. If the grant is awarded, funds will pay for the detective's salary, fringe benefits, travel, vehicle rental and insurance. This is a continuation application for an eighth year of funding. Domestic Assault Response Team (DART) -Total $122,348 (CJD $76,232, City Match $46,116) The DART grant budget includes two Victim Assistance Specialists. These personnel will be focused on two activities, (1) providing follow-up services to victims of domestic violence and (2) providing prevention education. and outreach. The grant budget includes salary, fringe benefits, training, supplies and outreach materials. This is a continuation application for an eleventh year of funding. Enhanced Domestic Assault Response Team (Enhanced DART) -Total $196,564 (CJD $100,000, City Match $96,564) The Enhanced DART project provides funding for two Detectives who are dedicated to investigation of family violence offenses. The Detectives work in conjunction with staff and volunteers under the DART project. This grant budget includes salary and fringe benefits for two detectives. This is a continuation application for an eleventh year of funding. Matching Funds in the amount of $178,228 will be included in the Fiscal Year 2008-2009 City Manager's Proposed Budget for State Awarded Assets Fund and $11,460 in the Fiscal Year 2008-2009 City Manager's proposed Budget for Federal Awarded Assets Fund. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available contingent upon approval of the 2008-2009 operating budget, as appropriated of the Grants Fund.
