Resolution No. 3717-03-2009 AMENDING THE CITY OF FORT WORTH'S ANNEXATION PLAN TO REMOVE AN APPROXIMATELY 82-ACRE TRACT OF LAND LOCATED SOUTH OF RAY WHITE ROAD AND NORTH OF WALL PRICE KELLER ROAD WHEREAS on December 14 1999 the City Council approved Resolution No 2598 adopting an annexation plan for the City of Fort Worth m accordance with Section 43 052 of the Local Government Code; WHEREAS on November 27 2007 the City Council approved Resolution No 3557 11 2007 adopting the nineteenth amendment to the City's annexation plan identifying approximately 304 acres referred to as Area 15 to be considered for annexation m 2010• WHEREAS Hillsborough, Lee Ray's Place, and Wilshire Valley are three new residential subdivisions within Area 15 south of Ray White Road and north of Wall Pnce Keller Road, where builders, rather than homeowners, received the initial notice of the intent to begin annexation proceedings, WHEREAS these subdivision had purchasers of property who bought homes unaware that these properties were subject to annexation by the City of Fort Worth, WHEREAS Section 43 052(e) of the Texas Local Government Code provides that a municipality may amend its annexation plan at any time to remove an area proposed for annexation, WHEREAS the property owners and the City of Fort Worth have agreed that the City will remove the approximately 82-acre tract of land from the City's annexation plan at this time so that annexation maybe considered at a later date; WHEREAS the area can be included into the annexation plan again 12 months after the date of this amendment, defined in Section 43 052(e) so that annexation maybe considered in 2013 and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH 1 That the City's annexation plan, approved on December 14 1999 by the adoption of Resolution No 2598 is hereby amended to remove approximately 82 acres encompassing the Hillsborough, Lee Ray's Place, and Wilshire Valley subdivisions, as shown on Exhibit A and described m Exhibit B and RESOLUTION NO 3717-03 2009 2 Further that the annexation plan shall be amended to include the area so described 12 months after the date of this plan amendment in order to consider the area for annexation to 2013 This resolution is adopted and effective this 10th day of March, 2009 Mike Moncnef, a ~rr`lt ~r) fr l"/'~~~ ""~„~. ~- ~ ~.. 44~y `~~ ATT'EST~ of thel~rtv of Fort Worth APPROVE CITY COUNCIL MAR 1 0 2009 =, c ~ s~ APPROVED AS TO FORM AND LEGALITY ~~ Sarah Fullenwtder Assistant City Attorney ~~~ City Secretary of the City of Fort UVarth, Texas ~~ ~ ~ RESOLUTION NO 3717-03-2009 LEGAL DESCRIPTION FOR AREA 15-2 REMOVED FROM ANNEXATION PLAN APPROXIMATELY 82 ACRES SITUATED IN THE J R. No 3717-03-2009 DATE Tuesday March 10 2009 REFERENCE NO PZ 2817 LOG NAME 06AMEND AREA 15 AX PLAN 3-09 SUBJECT Approve Resolution Amending the City of Fort Worth s Annexation Plan to Remove an Approximately 82 Acre Tract of Land Located South of Ray White Road and North of Wall Price Keller Road RECOMMENDATION It is recommended that the City Council approve the attached resolution amending the City's annexation plan to remove an approximately 82 acre tract of land covering the Hillsborough Lee Ray's Place and Wilshire Valley subdivisions from the plan DISCUSSION On November 27 2007 (M&C PZ 2760) the City Council adopted the nineteenth amendment to the City's annexation plan to add approximately 304 acres in far north Fort Worth referred to as Area 15 Under state law the City Council can annex Area 15 for full purposes beginning on November 27 2010 This resolution addresses a portion of Area 15 (AX-08-005) generally located south of Ray White Road and north of Wall Price Keller Road in Tarrant County When the initial annexation notices were mailed to the property owners in 2007 several builders owned a large number of lots instead of individual home owners Property owners who bought homes in these newer subdivisions were unaware that their properties were subject to annexation proceedings Council Member Espino and property owners from the Hillsborough Lee Ray's Place and Wilshire Valley subdivisions have agreed that 82 acres should therefore be removed from the City's annexation plan at this time to allow home owners time to receive adequate notice of annexation proceedings The subdivisions would be added back to the annexation plan one year from the date of removal which would allow annexation in 2013 rather than 2010 The remainder of the enclave would stay in the annexation plan as amended in November 2007 and be considered for full-purpose annexation between November 28 and December 29 2010 The property is contiguous to COUNCIL DISTRICT 2 FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that this action will have no material effect on City funds FUND CENTERS TO Fund/AccountlCenters FROM Fund/AccountJCenters CERTIFICATIONS Logname 06AMEND AREA 15 AX PLAN 3-09 Page 1 of 2 Submitted for City Manager's Office b~ Originating Department Head.
