HomeMy WebLinkAboutResolution 3737-05-2009A Resolution NO 3737-05-2009 AUTHORIZING EXECUTION OF AN INTERLOCAL AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION TO FLAG VEHICLE RECORDS OF INDIVIDUALS WHO HAVE OUTSTANDING WARRANTS FOR FAILURE TO APPEAR OR FAILURE TO PAY A TRAFFIC FINE ON A COMPLAINT INVOLVING VIOLATION OF A TRAFFIC LAW WHEREAS, Section 702 003 of the Texas Transportation Code provides that a municipality ma,y contract with a County Tax Assessor Collector or the Texas Department of Transportation (`TxDOT") to provide information indicating that an individual has an outstanding warrant from that municipality for failure to appear or failure to pay a fine on a complaint that involves the violation of a traffic law and that the Assessor Collector or TxDOT may refuse to register a motor vehicle owned by an individual who has such a warrant and WHEREAS, the City of Fort Worth desires to enter into an Interlocal Agreement with TxDOT under which the City will provide TxDOT with information indicating individuals who have outstanding warrants from the City for failure to appear or failure to pay fines on complaints involving violations of traffic law and TxDOT will for a fee make a notation of the outstanding warrants in its records in order to decrease the likelihood of such vehicles being registered unless the warrants are resolved NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT The City Manager or his designee is authorized to execute an Interlocal Agreement with the Texas Department of Transportation to provide TxDOT with information and payment in exchange for TxDOT entering notations into the motor vehicle records of individuals who have outstanding City warrants associated with violations of traffic laws PASSED ,AND APPROVED by the City Council of the City of Fort Worth Texas on this the 5th dray of May 2009 APPROVE ATTE - .v=~ _ ,/' ~ ~~= CITY C0~INCIL ~. s -= y ~ I - ;~ :~'~ N1:4Y 4 5 2009 Marty~;Hendrix C~-ty~'`Secretary ~rj` w~^n„~ ~~ '+, '~,~,-~'" *~+~ City Secretary of the r"r ff ~ ~ ,~`~ City of Foxt Worth, Texas ORT W T City of Fort Worth, Texas Mayor and Council Communication ~~~ h COUNCIL,ACTION: Approved on 5/5/2009 -Res. No. 18598-05- y,,. 2009 DATE Tuesday May 05 2009 LOG NAME 38SCOFFLAW REFERENCE NO C-23503 SUBJECT Adopt Resolution Authorizing Interlocal Agreement with the Texas Department of Transportation to Flag Registrations of Vehicle Owners with Outstanding Warrants for Traffic Offenses and Adopt Supplemental Appropriation Ordinance RECOMMENDATION It is recommended that the City Council 1 Adopt the attacf~ed resolution authorizing an Interlocal Agreement with the Texas Department of Transportation to flag registrations of vehicle owners who have outstanding warrants against them for failure to appear or failure to pay a fine on a complaint that involves a violation of a traffic law and 2 Adopt the attached supplemental appropriation ordinance increasing estimated receipts and appropriations in the General Fund in the amount of $28 006 00 from available funds in order to fund the Interlocal Agreement through the end of the current fiscal year DISCUSSION Section 702 003 of the Texas Transportation Code provides that A county assessor-collector or the [Texas Department of Transportation] may refuse to register a motor vehicle if the assessor-collector or the department receives under a contract information from a municipality that the owner of the vehicle has an outstanding warrant from that municipality for failure to appear or failure to pay a fine on a complaint that involves the violation of a traffic law Pursuant to this provision the Texas Department of Transportation (Tx~DOT) has developed a process and system to 'flag records of motor vehicle owners who have these tykes of warrants In order to encourage individuals to resolve their outstanding traffic-law warrants the Municipal Court Services Department recommends entering in to a contract with TxDOT for the 'flagging" service TxDOT's interlocal agreement for providing the service requires that the City Council adopt a resolution or ordinance authorizing the contract. The proposed resolution is attached for Council approval The Municipal Court Services Department estimates that the annual expense to transmit information to TxDOT will be $102 000 00 The expense for the remainder of Fiscal Year 2008-2009 will not exceed $28 006 00 The term of the aglreement will begin when the agreement is fully executed by both parties.
