HomeMy WebLinkAboutResolution 3739-05-2009A Resolution NO 3739-05-2009 AUTHORIZING THE EMPLOYMENT OF MCCALL, PARKHURST AND HORTON, LLP, AND KELLY, HART AND HALLMAN, LLP, AS OUTSIDE LEGAL COUNSEL FOR ASSISTANCE IN THE ANALYSIS AND EVALUATION OF VARIOUS OPPORTUNITIES TO REDUCE CITY COSTS OR INCREASE CITY REVENUES WHEREAS, m order to reduce City costs and/or increase City revenues, the City Manager's Office desires to explore various cost saving or revenue-producing opportunities, and WHEREAS, as part of that process, it will be necessary to research and analyze federal and state laws, rules and regulations, including whether a particular course of action will be impacted by federal income tax consequences and regulatory restraints on existing outstanding tax-exempt public securities and whether a particular course of action will impact the City's outstanding legal obligations, credit ratings, and future access to credit markets, and WHEREAS, the law firms of McCall, Parkhurst and Horton, LLP and Kelly Hart and Hallman, LLP currently serve as co-bond counsel for the City and have the staff, experience and resources needed to oversee this type of specialized and highly complex research and analysis, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS I. That the Crty is hereby authorized to retain the law firms of McCall, Parkhurst and Horton, LLP and Kelly Hart and Hallman, LLP as outside counsel pursuant to Section 3 Chapter VI of the City Charter to assist the Crty Attorney in the research and analysis of the impact of federal and state laws, rules, and regulations on potential courses of action that the Crty might take for cost savings or revenue production. II. No`. 3739-05-20D9 DATE Tuesday May 19 2009 LOG NAME 12KHH MCCALL REFERENCE NO G-16569 SUBJECT Adopt Resolution Authorizing the Employment of McCall Parkhurst and Horton LLP and Kelly Hart and Hallman, LLP as Outside Legal Counsel in an Amount Not to Exceed $50 000 00 for Assistance in the Analysis and Evaluation of Various Opportunities to Reduce City Costs or Increase City Revenues RECOMMENDATION It is recommended that the City Council adopt the attached Resolution authorizing the employment of McCall Parkhurst and Horton LLP and Kelly Hart and Hallman LLP as outside legal counsel for assistance in the analysis and evaluation of various opportunities to reduce City costs or increase City revenues DISCUSSION As part of its effort to recommend a budget for the 2009-2010 fiscal year the City Manager's Office desires to explore various cost saving or revenue producing opportunities As the staff develops ideas in this respect, it will be necessary for attorneys to research and analyze federal and state laws rules and regulations including whether a particular course of action will be impacted by federal income tax consequences and regulatory restraints on existing outstanding tax-exempt public securities as well as the impact that a particular measure might have on the City's outstanding legal obligations credit ratings and future access to credit markets The City Attorney recommends that the City Council adopt the attached Resolution authorizing the retention of the law firms of McCall Parkhurst and Horton LLP and Kelly Hart and Hallman LLP to assist the City Attorney's Office with the legal work that this project will require McCall Parkhurst and Horton LLP and Kelly Hart and Hallman LLP serve as the City's co-bond counsel and are familiar with the manner in which various City operations and systems have been funded and possess the experience necessary to oversee the type of specialized and complex research and analysis that will be required in this endeavor FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that funds are available in the current operating budget, as appropriated of the General Fund FUND CENTERS TO Fund/Account/Centers FROM Fund/Account/Centers GG01 539120 0905500 CERTIFICATIONS Submitted for City Manager's Office bx.
