HomeMy WebLinkAboutResolution 3752-06-2009RESOLUTION NO 3752-06-2009 A Resolution NO 3752-06-2009 SUPPORTING THE CREATION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF FORT WORTH AND THE FORT WORTH INDEPENDENT SCHOOL DISTRICT FOR THE PURPOSE OF PROMOTING THE DEVELOPMENT OF A JOINT USE ELEMENTARY SCHOOL/COMMUNITY CENTER WHEREAS the City of Fort Worth desires to cooperate and loin with other local governments to enter into Interlocal Agreements for the purpose of fulfilling and implementing their respective public and governmental purposes, needs, objectives, programs, functions and services, and WHEREAS the City of Fort Worth Comprehensive Plan and the Park, Recreation and Open Space Master Plan serve as guidelines regarding desired land use, sustainable development, environmental quality economic growth and other activities intended to enhance the quality of life for all Fort Worth residents, and WHEREAS the Comprehensive Plan and the Park, Recreation and Open Space Master Plan call for maximizing public resources by pursuing point development and use of programs and facilities with qualified non-profit agencies and independent school distracts wherever and whenever feasible; and WHEREAS the City's 2004 Capital Improvement Program allocated $2,500 000 for the design and construction of a community center m the southside area of the City and WHEREAS the Fort Worth Independent School Distract's 2007 Capital Improvement Program allocated $12,000 000 for the design and construction of an elementary school in the Paschal High School attendance zone; and WHEREAS, the City of Fort Worth recognizes that the development of a combined elementary school/community center m Rosemont Park will maximize public resources and be highly beneficial to the taxpayers and residents of both the City of Fort Worth and the Fort Worth Independent School Distract by 1) improving the quality of life for the residents in the community 2) encouraging and providing opportunities for recreational and leisure activities to enhance physical and mental development and wellbeing for the residents, and 3) enabling the efficient and effective provision of educational services and activities, and RESOLUTION NO 3752-06-2009 WHEREAS pursuant to the authority granted by the Interlocal Cooperation Act, Section 791 001 et seq of the Texas Government Code, the City of Fort Worth wishes to express its commitment to entering into a design and development mterlocal agreement with the Fort Worth Independent School Distract for the purpose of cooperating m the development of a ~omt-use elementary school/community center m Rosemont Park utihzmg funds from the City's 2004 Capital Improvement Program and other funds which maybe appropriated by the City and WHEREAS the City Council, m accordance with the Texas Parks and Wildlife Code, Chapter 26, authorized the conversion of approximately 15 45 acres of parkland at Rosemont Park, for the construction of a ~omt use facility and elementary school m partnership with the Fort Worth Independent School District; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF FORT WORTH. SECTION 1 The City Council does hereby express its interest and commitment to entering into an mterlocal agreement for the development of a~omt-use facility m Rosemont Park, which will mutually benefit the residents of the City of Fort Worth and the Fort Worth Independent School District; SECTION 2 The Crty Council authorazes the City Manager to earnestly pursue the development of an Interlocal agreement with the Fort Worth Independent School District for the point development and use of a combined elementary school/commumty center in Rosemont Park; SECTION 3 The City Council authorazes the City Manager to pursue the development of a lease agreement with the Fort Worth Independent School Distract for approximately 15 45 acres of parkland located at Rosemont Park as the site of the elementary school/commumty center and lease the 6 7 acres of property owned by the Fort Worth Independent School District for development and use as a neighborhood park. DISCUSSION This M&C proposes the adoption of a resolution by the City Council to support the negotiation of an interlocal agreement with the Fort Worth Independent School District (FWISD) for the development of an elementary school/community center in Rosemont Park, including a lease of school district land for use as a neighborhood park. The approval of this M&C and the attached resolution would formally endorse and authorize negotiation of an agreement to facilitate the construction of a joint-use elementary school/community center in Rosemont Park and development of a piece of school district property as a neighborhood park. The 2004 Capital Improvement Program allocated $2 500 000 for the construction of a southside community center in Council District 9 From May 2007 to January 2009 a total of six community meetings were held to obtain input from citizens who live in the service area to seek their ideas on desired programs that could be held in the proposed center Input was also obtained on possible locations among those identified as feasible based on a select set of criteria At the final community meeting (convened by Council Member Joel Burns on January 8 2009) consensus was registered in support of locating the center in Rosemont Park. At the January 28 2009 Parks and Community Services Advisory Board (PACSAB) meeting the Board endorsed staffs recommendation to construct the new community center in Rosemont Park. During a part of the period in which the site selection process was being conducted staff from the Parks and Community Services Department (PACSD) and FWISD held discussions which resulted in an expressed mutual interest for the potential development of a joint-use facility if the Rosemont site were selected as the location for the community center The 2007 FWISD Capital Improvement Program included $12 000 000 for the construction of a new Paschal Relief Elementary School to serve this sector of the district. This potential public public partnership represents an ongoing effort by the PACSD and the FWISD to work together when possible and feasible in order to maximize existing resources The City of Fort Worth Comprehensive Plan the Park, Recreation and Open Space Master Plan and the Neighborhood and Logname: 80ROSEMONTSCHOOLRESOLUTION Page 1 of 2 Community Park Dedication Policy dictate that the PACSD should seek partnerships with area independent school districts and local non-profits to provide programs and facilities in a way that best maximizes public resources The proposed partnership would represent accomplishment of this policy directive Moreover the recommended interlocal agreement with the FWISD represents a unique opportunity to leverage public funds resulting in the development of a joint-use facility that will provide both community services and educational programs in one facility With extended operating hours that promote maximum use of the facility utility and other operating costs can be shared between the FWISD and the City of Fort Worth resulting in savings to the tax payer The proposed partnership will significantly increase the hours and use of the occupied space On May 12 2009 in accordance with the Texas Parks and Wildlife Code Chapter 26 the City Council authorized the conversion of approximately 15 45 acres of parkland at Rosemont Park for the construction of a joint-use facility and elementary school in partnership with the Fort Worth Independent School District (M&C L 14769) On May 27 2009 the Parks and Community Services Advisory Board endorsed staffs recommendation that the City Council adopt a resolution in support of an interlocal agreement with the Fort Worth Independent School District for the development of joint-use facilities in Rosemont Park Adoption of the attached resolution will formalize the partnership and allow the City of Fort Worth and the FWISD to proceed with negotiations to develop an interlocal agreement for the design and construction of the elementary school/community center In addition the agreement will define the terms for lease of approximately 6 7 acres of FWISD property located east of and adjacent to Rosemont Middle School for use as a public park. Upon approval of the proposed resolution by the City Council and FWISD Board of Education staff from both organizations will collaborate in the development of the agreement which will specify the lease terms development guidelines and operational conditions for the Rosemont Park joint-use facility and the FWISD property located adjacent to Rosemont Middle School Following staff negotiations an M&C will be brought before Council outlining the proposed terms and seeking authorization to execute the interlocal agreement for design construction and property lease If approval is received staff will negotiate the major terms of a second interlocal agreement for the management and operation of the joint-use facility and present those terms to the City Council and the Board of Education for consideration Rosemont Park Is located in COUNCIL DISTRICT 9 FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that this action will have no material effect on City funds FUND CENTERS TO Fund/Account/Centers FROM Fund/Account/Centers CERTIFICATIONS Submitted for City Manager's Office b~ Originating Department Head.
