HomeMy WebLinkAboutResolution 3773-08-2009A Resolution NO 3773-08-2009 REQUESTING FINANCIAL ASSISTANCE FROM THE DRINKING WATER STATE REVOLVING FUND THROUGH THE AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009 SPECIAL CAPITALIZATION GRANT Whereas, the Texas Water Development Board s mission is to provide leadership, technical services, and financial assistance to support planning, conservation and responsible development of water for Texas, and Whereas, through the Amencan Recovery and Reinvestment Act of 2009 (ARRA), the United States Congress appropriated funding to the U S Environmental Protection Agency which has been delegated to the Texas Water Development Board s Dnnkmg Water State Revolving Fund- Special Capitalization Grant; and Whereas, Texas Water Development Board wishes to maximize the use of the ARRA funds to meet the objectives of ARRA and to meet the needs of public health protection of the state and to restore and maintain the chemical, biological and physical integrity of the State s public drinking water through the use of the Special Capitalization Grant; Whereas, the City of Fort Worth (City) seeks to construct the City's Village Creek Reclaimed Water Delivery System to create water markets and make more efficient use of existing water supplies, Whereas, the City deems it necessary to apply to the Texas Water Development Board for financial assistance in an amount not to exceed $22,620 000 for the construction of the Village Creek Reclaimed Water Delivery System, and Whereas, on July 17 2009 the Texas Water Development Board issued the City official notice of its eligibility and invitation to submit an application for such financial assistance (as shown m Exhibit A) and Whereas, such application for financial assurance is due not later than August 18 2009 and Whereas, in accordance with the rules and regulations of the Texas Water Development Board, which governs the procedures of making such application, the governing body of the City is required to adopt a resolution to accompany such application, and ORT W®RT T RESOLUTION NO 3773-08-2009 Whereas, rt is hereby officially found and determined that the meeting at which this Resolution was considered was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551 Texas Government Code. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS 1 That the Texas Water Development Board is hereby requested to grant financial assistance m an amount not to exceed $22,620 000 to the Crty for construction of the Village Creek Reclaimed Water Delivery System, such amount to include the cost for easement acquisition. 2 That the City Manager of the City is hereby authorized to execute and submit to the Texas Water Development Board an application for such financial assistance; and the City Manager together with the City's Bond Counsel, Financial Advisor and Consulting Engineers named m such applicarion, are hereby authorized to appear before the Texas Water Development Board m support of such application and project. 3 That the City Manager is further specifically authorized to make the required assurances to the Texas Water Development Board m accordance with the rules, regulations and policies of the Texas Water Development Board. 4 That rt is hereby found and determined that the Crty cannot reasonably finance the proposed project without financial assistance m the amount requested, and that the immediate consideration of this application is requested. 5 That a certified copy of this Resolution shall be attached to the application for financial assistance herein authorized to be prepared and submitted to the Texas Water Development Board. Please consider this letter as your invitation to submit an application for financial assistance to the Texas Water Development Board (Board). Projects were prioritized for receipt of ARRA funding based on applicant representation regarding the readiness of the projects and related construction contracts to proceed by a certain date. Applicants who receive this invitation will be required to include with the application: .Sealed plans and specifications; .Copies of fully executed consultant, util><ty service or other related contracts; .Final environmental reviews and determinations; .Demonstration that all real estate matters (title, easements, site location and long-term leases) are resolved; .All necessary and applicable permits for completion of the project; •A business case detailing the project's green qualifications; and .All other information necessary for a funding commitment fi-om the Board to ensure an expedited closing timeframe (a maximum of 90 days) following the commitment. Project 62400 was selected because it was tdentified as having a green component. If it is determined in review of an application that a project that was prioritized for funding on the basis of being green does not meet EPA criteria for green, the project will be disqualified for ARItA funding. The application deadline for those projects invited to apply for special capitalization grant funding under ARRA is 30 days from receipt of this formal invitation or August 18, 2009 by 5:00 p.m. A complete application must be submitted to the Board by this deadline in order to receive funding under ARRA. The Davis Bacon Act (wage rates), Buy American requirements (American-made iron, steel and manufactured goods), and Disadvantaged Business Enterprise compliance are all applicable. There will be a general WebEx information session on July 22, 2009 at 3.30 pm CST for invited DWSRF entities. The information session is designed to provide an overview of requirements regarding the engineering, environmental and legal aspects of a complete application. It will also bean opportunity to ask questions about the application process. The following are instructions to participate in this information session.
