REQUESTING THAT THE FORT WORTH CRIME CONTROL
AND PREVENTION DISTRICT ORDER AN ELECTION
REFERENDUM BE HELD ON NOVEMBER 3, 2009, ON THE
CONTINUATION OF THE CRIME CONTROL AND
PREVENTION DISTRICT AND ITS ONE-HALF CENT SALES
TAX FOR A PERIOD OF FIVE YEARS.
WHEREAS the current authorization for the Fort Worth Crime Control and Prevention District
created under Article 2370c-4 V.A.C S and now codified under Chapter 363 of the Texas Local
Government Code will expire on September 30 2010• and
WHEREAS Chapter 363 of the Texas Local Government Code provides for a process by which
the Fort Worth Crime Control and Prevention District shall continue beyond September 30 2010 if an
election is held and the majority of votes cast m said election are m favor of the continuation of the
District; and
WHEREAS Chapter 363 further provides that the Board of Directors of the Fort Worth Crime
Control and Prevention Distract shall order said election if a majority of the Fort Worth City Council
adopts a resolution requesting a continuation, after notice and public hearing on the matter and
WHEREAS at its regular meeting of August 11 2009 the Fort Worth City Council, after notice
thereof as required by law held a public hearing on the question of whether to continue the Fort Worth
Creme Control and Prevention District, at which hearing all persons were given the opportunity to
present evidence on the matter and
WHEREAS following said public hearing, the Fort Worth City Council desires that the Fort
Worth Crime Control and Prevention District and its one half cent sales tax be continued for an
additional five (5) years, and that the Board of Directors of the District order a referendum election to be
held on November 3 2009 on continuation of same;

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS
SECTION 1 That the Fort Worth Crty Council requests the Board of Directors of the Fort
Worth Crime Control and Prevention District to order a referendum election to beheld on November 3
2009 on the continuation of the Distract and rts one half cent sales tax for five (5) years, at which
election the qualified voters residing m the District shall have the opportunity to vote on the following
proposition.
`Whether the Fort Worth Creme- Control and Prevention District
should be continued for five (5) years and the Fort Worth Creme
Control and Prevention Distract sales tax of one-half cent should be
continued for five (5) years?"
SECTION 2. That rt is hereby officially found and determined that the meeting of the Fort
Worth Crty Council at which this Resolution was adopted was open to the public, and that public notice
of the time, place and purpose of said meeting was given, as required by Chapter 551 of the Texas
Government Code.
SECTION 3 That this Resolution shall take effect upon adoption.

Conduct a Public Hearing .on and Consideration of a Resolution Requesting that the Fort Worth Crime
Control and Prevention District Board Order an Election Referendum to be Held on November 3 2009 on
the Continuation of the District and its One-Half Cent Sales Tax For a Period of Five Years
RECOMMENDATION
It is recommended that the City Council
1 Hold a public hearing concerning the attached resolution requesting the Fort Worth Crime Control and
Prevention District Board order an election referendum to be held on November 3 2009 on the
continuation of the District and its one-half cent sales tax for a period of five years and
2. Adopt the attached resolution requesting said election
DISCUSSION
On March 4 1995 the voters of the City of Fort Worth approved the creation of the Fort Worth Crime
Control and Prevention District (District) for a period of five years together with cone-half cent sales tax
to support the District's operations. Pursuant to Section 363 301 of the Texas Local Government Code
the District will dissolve September 30 2010 unless the District holds a continuation referendum and a
majority of votes cast in the referendum are in favor of the continuation
The City Council has indicated that it desires that the Crime Control and Prevention District and its one-
half cent sales tax be continued for an additional five years. Pursuant to Section 363.251 of the Local
Government Code the Crime Control and Prevention District Board is required to hold a referendum on
the question of continuing the District and its sales tax if the City Council requests the referendum Before
the City Council may adopt the resolution making the request, it must first hold a public hearing on the
matter
Accordingly City staff recommends that the City Council conduct the required public hearing and upon
completion of the public hearing vote on the adoption of the attached resolution Should the City Council
adopt the attached resolution the request far a referendum will be presented to the Fort Worth Crime
Control and Prevention Board at its August 13 2009 meeting
