HomeMy WebLinkAboutResolution 3829-12-2009A Resolution NO 3829-12 2009 AUTHORIZING THE CLOSURE OF A PORTION OF THE 200 BLOCK OF WEST BOWIE STREET FROM ST LOUIS AVENUE ON THE WEST TO A POINT 50' FROM THE CENTER OF THE UNION PACIFIC RAILROAD TRACKS ON THE EAST WHEREAS, the Crty of Fort Worth desires to physically and permanently close the 200 Block of W Bowie Street to the North Fort Worth Addition, from St. Louis Avenue on the west to a point 50 from the center of the Union Pacific tracks on the east being approximately 146 feet long, 50 feet wide and containing 7,300 square feet, more or less, and WHEREAS, the Plan Commission of the City of Fort Worth has reviewed this request and recommends that the request be approved. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT A portion of the 200 Block of West Bowie Street at the Union Pacific Railroad crossing (DOT No 415 947K, railroad milepost 248.35), and as more specifically described to Exhibit A, attached hereto and incorporated herein, shall be physically closed with a barricade, with the Crty to retain title to the public right-of way m said street, retaining any and all easements for existing and prospective utilities and retaining the right of access at all times for the purpose of maintaining existing and prospective utility facilities located m the aforesaid portions of said street. The City reserves the right, at the sole discretion of the City Council, to reopen by resolution the aforesaid street rtght-of way to public travel at any time by directing the removal of the aforesaid barricade, reconstruction of the roadway and the installation of appropriate railroad traffic control devices. DATE Tuesday December 15 2009 REFERENCE NO *C-23976 LOG NAME 20BOWIECLOSURE SUBJECT Adopt a Resolution Authorizing the Closure of a Portion of the 200 Block of West Bowie Street from St. Louis Avenue on the West to a Point Fifty Feet from the Center of the Union Pacific Railroad Tracks on the East to Close the Railroad Crossing Authorize a Crossing Closure Agreement with the Texas Department of Transportation and the Union Pacific Railroad Company Will Reimburse the City Up to $7 500 00 and Adopt Appropriation Ordinance RECOMMENDATION It is recommended that the City Council 1 Adopt the attached resolution authorizing the closure of a portion of the 200 block of West Bowie Street from St. Louis Avenue on the west to a point 50 feet from the center of the Union Pacific Railroad tracks on the east in order to close the railroad crossing 2. Authorize the City Manager to enter into a Crossing Closure Agreement with the Texas Department of Transportation and the Union Pacific Railroad Company to close the railroad crossing in which the Texas Department of Transportation will reimburse the City up to $7 500 00 for the installation of barricades and other closure expenses and 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the 2007 Critical Capital Projects Fund by $7 500 00 DISCUSSION The Transportation and Public Works Department (T/PW) requests the permanent closure of a portion of the 200 block of West Bowie Street, east of St. Louis Avenue at the Union Pacific Railroad Company (UPRR) tracks In the spring of 2009 the JMSL Neighborhood Association requested that T/PW consider the closure of this road to restrict the number of vehicles that drive through their neighborhood T/PW evaluated the proposed closure and recommended that the street be closed since loss of this roadway access has no adverse affect on traffic circulation in the area T/PW submitted a permanent street closure application and on September 23 2009 the Plan Commission unanimously approved the closure without public opposition (Case No VA-09-029) Under an agreement with the Texas Department of Transportation (TXDOT) and the UPRR, TXDOT will reimburse the City's expenses up $7 500 00 to close the railroad crossing to vehicular and pedestrian traffic.
