HomeMy WebLinkAboutOrdinance 22567-01-2017 Ordinance No.22567-01-2017 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AMOUNT OF $15,000.00, IN THE WATER CAPITAL PROJECTS FUND, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE WESTCLIFF DRAINAGE IMPROVEMENTS PH 2A SURREY STREET PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2016-2017 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the amount of $15,000.00, in the Water Capital Projects Fund, from available funds, for the purpose of funding the Westcliff Drainage Improvements PH 2A Surrey Street Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 22394-09-2016 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: This Mayor and Council Communication (M&C) is for the purpose of recommending a $15,000.00 appropriation of Water Department funding to fund a portion of Change Order No. 1 to the Westcliff Drainage Improvements project. On August 2, 2016, (M&C C-27847) City Council authorized a contract with Woody Contractors, Inc., in the amount of$965,889.00 for Westcliff Drainage Improvements PH 2A Surrey Street. This project also includes replacement of a deteriorated water main which is funded by the Water Capital Projects Fund. Upon approval of this M&C, Change Order No. 1, in the amount of$60,843.00, will be submitted for administrative authorization. Based on data from core borings, it was necessary to replace the planned asphalt and crushed stone base interim pavement with a stronger asphalt and concrete base. An appropriation to the Water Capital Projects Fund is needed to cover a portion of this change order. This project will have no impact on the Water Department Operating Budget. This project is located in COUNCIL DISTRICT 9, Mapsco 397 C2. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION I CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Water Capital Projects Fund.
